MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING APRIL 11, 2019 CALL TO ORDER CLOSED SESSION: 5:30 P.M. Roll Call. Present: Nick Bennett, Mayor Russ Cremer, Vice Mayor Dirk Slooten, Councilmember Phil Harris, Councilmember Absent: Joyce Overton, Councilmember Staff: Alan Flora, City Manager Ryan Jones, City Attorney Andrew White, Police Chief (1) CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION: Pursuant to Government Code Section 54956.9(B): One Potential Case. (2) CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION: (Government Code 54956.9) – City of Clearlake v. PG&E Corporation, et al., Case No. CV 1:17-CV-419398, Lake County Superior Court (3) CONFERENCE WITH LEGAL COUNSEL – LIABILITY CLAIM: Pursuant to Government Code Section 54961: Claimant: Tyler Borland; Agency Claimed Against: City of Clearlake (4) CONFERENCE WITH LABOR NEGOTIATORS: Pursuant to Government Code Section 54957.6: Agency Designated Representative: City Manager Alan Flora; Employee Organizations: Clearlake Management/Confidential Employees, Clearlake Police Officer Association, Clearlake Municipal Employees Association and Clearlake Middle Management Association. ACTION: It was moved in Closed Session by Councilmember Harris and seconded by Vice Mayor Cremer to deny the claim of Tyler Borland against the City of Clearlake. ADOPTION OF THE AGENDA There were no changes to the agenda. PRESENTATIONS: 1. Swearing-In of Police Captain Tim Celli and Community Service Officer Daniel Constancio 2. Proclamation Declaring April 14 – 20, 2019 as Public Safety Telecommunicators Week 3. Proclamation Declaring April 2019 as Child Abuse Awareness Month 4. Proclamation Declaring April 2019 as Sexual Assault Awareness Month 5. Proclamation Declaring Support for the 2020 Census 6. Presentation of the Clearlake Police Department Annual Report PUBLIC COMMENT: Patty Duke spoke regarding traffic on Old Highway 53 and Lakeshore and asked for traffic control near her home. Consent Items Recommended Action 7. Warrant Registers Receive and file 8. Minutes of the February 21, February 28, Receive and file March 14, March 21, and March 28, 2019 Council Meetings 9. Correction to Resolution No. 2019-13 Adopt Resolution Adopting the Police Captain Job Description and Salary Range; Resolution No. 2019-16 10. Updates to the Fiscal Year 18/19 Salary Adopt Resolution Schedule; Resolution No. 2019-17 11. Second Reading and Adoption of Ordinance to Hold second reading of Ordinance Amend Subdivision 3-4.5 (a)(8) of the No. 227-2019 by title only, waive further CCMin 04-11-19 Page 2 of 4 Clearlake Municipal Code “Exceptions to reading, and adopt ordinance Competitive Bidding Requirements” City Manager Flora asked to remove Item 9 for separate discussion and consideration. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Slooten to accept the Consent Calendar, except Item 9, as presented. The motion passed with a unanimous voice vote. Item #9 was discussed as a separate item. ACTION: It was moved by Councilmember Harris and seconded by Vice Mayor Cremer to accept the Consent Calendar Item 9 as presented. The motion passed with a unanimous voice vote. BUSINESS: 12. Discussion of Gravel Road Maintenance Checklist and Construction Maintenance Guide Public Works Superintendent Baker and Consultant Engineer Swartz gave the staff report. ACTION: It was the consensus of the Council to direct staff to review possibilities for speed bumps and bring back a report to the Council at a future meeting. 13. Discussion Regarding a Letter of Intent to Purchase the “Airport Property” between the City and Village Investment Partners, L.P. City Manager Flora gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Cremer to authorize the City Manager to Sign the Proposed Letter of Intent with Village Investment Partners, L.P. to Purchase the “Airport Property.” The motion passed with a unanimous voice vote. 14. Adoption of Ordinance Amending the Clearlake Municipal Code Relating to Abandoned Vehicles Chief White gave the staff report. ACTION: It was moved by Councilmember Slooten and seconded by Vice Mayor Cremer to hold the introduction and first reading of Ordinance No. 228-2019: AN ORDINANCE AMENDING CHAPTER 10, SECTION 10-6 OF THE CLEARLAKE MUNICIPAL CODE RELATED TO ABANDONED, WRECKED, DISMANTLED AND INOPERATIVE VEHICLES INCLUDING ABATEMENT THEREOF, read by title only and set second reading for the April 25, 2019 meeting. The motion passed with a unanimous voice vote.
