CLEARWATER CEMETERY DISTRICT Clearwater Cemetery District Board Meeting October 10, 2025 6:30 PM, City Hall 1. Call to Order Board member Erwin called the meeting to order at 6:36p.m. 2. Roll Call Tim Erwin, Trustee Ninnescah Township was the only one present at the time of roll call. David Loos, Trustee Ohio Township, arrived at 6:47pm Others present: Courtney Zollinger, City Administrator, and Mike Weakly, Cemetery Sexton. 3. Approval of Agenda MOTION: Loos moved, Erwin seconded to approve the agenda as submitted. Voted and passed unanimously. 2-0 4. Consent Agenda a. Minutes 9/11/2025 b. September Accounts Payable c. September Receipt Report d. October Payroll MOTION: Loos moved, Erwin seconded to approve the consent agenda as presented. Voted and passed unanimously. 2-0 5. Reports • 75% through the year. Revenues are at 88.9% and expenses are at 31.3% • All forward facing web pages for Find my Gravesite are now up for viewing. https://clearwaterks.org/cemetery-district/ There is a separate one for each cemetery. • All functions are now implemented for Cemify and working great. A burial report and lot report for Clearwater is part of this report. The sales function didn’t get fully implemented until late September. • Wichita Tree trimmed the trees along Tracy. There was $5,000 in the budget and it cost $2,775. • Reddi Fence repaired Ruby Cemetery gate/fence. • Weakley reported that the new trees are doing well and all equipment is in good shape. • 1 Burial and one lot sale in September MOTION: Loos moved, Erwin seconded to accept the reports. Voted and passed unanimously. 2-0 6. Business – a. Senate Bill – Logan Patric was not able to attend the meeting but reported he is still working with the revisor on how to make the third member work in a way that would make the CLEARWATER CEMETERY DISTRICT board happy. They are not aware of any cemetery districts in Kansas that are elected by ballot. : SENATE BILL NO. ____ By Senator Blasi AN ACT concerning cemeteries; authorizing the reorganization of the Clearwater cemetery district; deleting Ohio township from the district. Be it enacted by the Legislature of the State of Kansas: Section 1. (a) The board of trustees of the Clearwater cemetery district located in Sedgwick county is authorized to reorganize such cemetery district by adoption of a resolution of reorganization to exclude Ohio township from the district. Such resolution shall be adopted by a unanimous vote of the trustees. The reorganized cemetery district shall have three members: one member from the city of Clearwater, one member from the Ninnescah township and one at-large member. The resolution shall provide for the election of a third at-large member of the board of trustees at the next meeting of the board. The third member may reside in either the city of Clearwater or Ninnescah township and shall represent the entire district. The Ohio township and the reorganized Clearwater cemetery district may enter into an interlocal cooperation agreement regarding the future care of cemeteries and the sharing of existing tax funds. (b) A copy of the reorganization resolution shall be mailed to the Sedgwick county clerk. The reorganization of the cemetery district shall be deemed effective on January 1, 2026. Sec. 2. This act shall take effect and be in force from and after its publication in the Kansas register. 25rs2418 The board did not have any follow up comments. Logan Patrick said he would be at the next meeting of the Cemetery Board. b. Financial Distribution – Zollinger sent the board an updated spreadsheet that was used when the topic of disorganization was discussed a couple years ago. The assed valuations were updated as well as operating expenses and property values.  CLEARWATER CEMETERY DISTRICT The numbers show that Ohio Township provides 27% of the taxes and Noel Cemetery, the only cemetery located in Ohio Township, is about 2% of the expenses and value of properties in the District. Erwin voiced concerns about losing revenue Ohio Township brings to the District. Ohio Township could take a large portion of the assets if they are removed from the district. Ninnescah Township board is going to take a lot of convincing to agree to allow Ohio Township to exit the Cemetery District. Loos stated that the Ohio Township board has expressed they don’t want to take any portion of the assets as their fair share. Zollinger stated she would add to the spreadsheet to indicate operating costs versus operating and improvement costs since the District has invested in improving the new section of Clearwater Cemetery. The expenditures are not a true representation of operating costs. No action taken. 7. Executive Session – No Executive Session 8. Comments – No comments 9.
