CLEARWATER CEMETERY DISTRICT Clearwater Cemetery District Board Meeting December 11, 2025 6:30 PM, City Hall 1. Call to Order Board member Loos called the meeting to order at 6:30 p.m. 2. Roll Call David Loos, Trustee Ohio Township, Tim Erwin, Trustee Ninnescah Township and Burt Ussery, Mayor City of Clearwater were present. Others present: Courtney Zollinger, City Administrator, Mike Weakly, Cemetery Sexton, Logan Patrick, Majority Leader Blasi’s Office. 3. Approval of Agenda MOTION: Loos moved, Erwin seconded to approve the agenda as submitted. Voted and passed unanimously. 3-0 4. Consent Agenda a. Minutes 11/14/2025 b. November Accounts Payable c. November Receipt Report d. December Payroll MOTION: Loos moved, Ussery seconded to approve the consent agenda as presented. Voted and passed unanimously. 3-0 5. Reports • 91% through the year. Revenues are at 94.5% and expenses are at 37.2%. We will receive one more distribution from Sg County Treasurer • Received $12.61 in restitution, sold 1 lot in Clearwater, and had 2 burials in November. MOTION: Ussery moved, Loos seconded to accept the reports. Voted and passed unanimously. 3-0 6. Business – a. Resolution for Removing Ohio Township from the District Logan Patrick provided the most recent version of the senate bill based on previous conversation with the cemetery board. The bill will still have to go through committee and be accepted by state and approved by the governor. While the bill states it will be effective January 1, 2026 the bill won’t be in the Kansas registrar until a later date and will be retroactive. SENATE BILL NO. ____ By Senator Blasi AN ACT concerning cemeteries; authorizing the reorganization of the Clearwater cemetery district; deleting Ohio township from the district.  CLEARWATER CEMETERY DISTRICT Be it enacted by the Legislature of the State of Kansas: Section 1. (a) The board of trustees of the Clearwater cemetery district located in Sedgwick county is authorized to reorganize such cemetery district by adoption of a resolution of reorganization to exclude Ohio township from the district. Such resolution shall be adopted by a majority vote of the trustees. The reorganized cemetery district shall have three members: one member from the city of Clearwater, one member from the Ninnescah township and one at-large member. The resolution shall provide that the third at-large member of the board of trustees shall be initially elected by the board of trustees at the next meeting of the board following the adoption of the resolution. The third at-large member shall then stand for election on a nonpartisan basis by the voters of the district at the 2026 regular election and every four years thereafter. The third member may reside in either the city of Clearwater or Ninnescah township and shall represent the entire district. The Ohio township and the reorganized Clearwater cemetery district may enter into an interlocal cooperation agreement regarding the future care of cemeteries and the sharing of existing tax funds. (b) A copy of the reorganization resolution shall be mailed to the Sedgwick county clerk. The reorganization of the cemetery district shall be deemed effective on January 1, 2026. Sec. 2. This act shall take effect and be in force from and after its publication in the Kansas register. 25rs2418 Along with the bill the cemetery board will be required to adopt a resolution after the adoption of the bill to activate the removal of Ohio Township. The board reviewed two version where the price purchase price of cemetery plots would be considered for Ohio Township property owners after the split. The different versions were: • Cemetery Purchase Pricing Considerations for Certain Ohio Township Property Owners Property owners in Ohio Township who have paid taxes into the Clearwater Cemetery District for ten (10) or more years prior to the adoption of this Resolution, and who continue to own property the same property in Ohio Township after adoption, shall be eligible for in- district pricing, if such pricing exists at the time services are requested. • Cemetery Purchase Pricing Considerations for Ohio Township Property Owners Property owners in Ohio Township who have paid taxes into the Clearwater Cemetery District at the time of this Resolution shall receive in‑district pricing, if such pricing still exists, for a period of twenty‑four (24) months following adoption. After the 24‑month period, all residents of Ohio Township shall be considered out‑of‑district. After discussion the board had a consensus to go with the 24 month option when the time comes. No Action was taken b. Replace board that cover open graves – Mike Weakley, Sexton, asked to purchase a replacement grave covering because the 1 x 10 board that he currently uses are breaking down. He said he has seen other cemeteries use a sturdier option made out or metal but doesn’t know how much it would cost to purchase or have made.  CLEARWATER CEMETERY DISTRICT The board asked Weakley to contact Triple B and ask them to draw a rendering and come up with pricing to make a new covering and bring back the information to the next board meeting. 7.
