TUESDAY, JANUARY IBTH, 2022
This regular meeting of the Mayor and Board of Aldermen olThe City of Clevetand,
Mississippi, was duly and legally begun at 8:30 o'clock a.m. on Tuesday, January 18th,2022.
Present were: Billy Nowell, Mayor; Robert Sanders, Zinnia Howze-Wince, Brian
Bishop, Theodore "Ted" Campbell, Kirkham Povall and Cary Gainspoletti, Aldermen; Danny
Griffith, City Auomey; Dominique Green, City Clerk; Michelle Arbuckle, Deputy City Clerk;
Greg Jackson, Fire Inspector; Billy Trotter, Community Development Director; Charles A.
Bingham, Chief of Police; Stephen Ferri, Public Works Director; Clint Johnson, Airport
Director; Jason Woods, Parks and Recreation Director; Jamie Gregory-Grant, Animal Shelter
Director; Heather Williams, Human Resources Coordinator; Josh McPherson, Eley-
McPherson Engineering. Alderman Danny Abraham was absent. The meeting was duly
opened, and, upon due proclamation first made, the following proceedings were held, to-wit:

VISITORS
Deron Lindsay of Sparklight provided the company's response to the recent intemet
outages in the area due to the theft of fiber and their plans to curb future outages due to the
installation ofa backup circuit in Cleveland.
ORDER TO APPROVE CONSENT AGENDA ITEMS
After discussion, upon Motion by Alderman Sanders, second by Alderman Bishop,
and unanimously adopted, it is ordered that the consent agenda with suppo(ing
documentation attached hereto as "Exhibit A" be approved as follows.

A RESOLUTION AND ORDER AWARDING A CONTRACT FOR THE
WASTEWATER TREATMENT PLANT IMPROVEMENT PROJECT - PHASE 2
WHEREAS, legal notice has been given and published in The Clarion Ledger, a
public newspaper pubtished and having general circulation in this City and competent under
the law to make such publication, in the issues thereof dated and published on October 27th
and November 3 rd,2021 , all in the manner and form and for the length of time provided by
law and as shown by proper proof of publication duly filed and now before this Board, that
at 10:00 o'clock am on December 29th,2O2l the City Clerk would receive written
competitive bids on behalf of this Board, and thereafter this Board would award contracts
thereon, for the 2021 Wastewater Treatment Plant Improvements, Phase 2; and,
WHEREAS, bids were received for said construction and said bids were publicly
opened, read, and filed all as directed, and considered by this Board at its meeting on January
181h,2022, whereupon this Board did then and there, and does now, find and determine that
the parties to whom contracts heretofore awarded are the lowest and best bidders lor the
construction aforesaid all as set fo(h in the order of this Board duly adopted on said January
18th,2022; and,
WHEREAS, bids have been received for said construction, and said bids have been
received and filed by the City Clerk and tabulated by consulting Engineers, Eley-McPherson
Engineering, for consideration by this Board is as follows:
Joe Reed and Company - 59,446,100.26
Hemphill Construction. - $9,500,000.00
Whereupon this Board did then and there, and does now, find and determine that the party
to whom a contract is hereinafter awarded is the lowest and best bidder for the construction
aforesaid; now,
THEREFORE, BE IT RESOLVED AND ORDERED BY THE MAYOR AND
BOARD OF ALDERMEN OF THE CITY OF CLEVELAND, MISSISSPPI, as follows:
That the bid from Joe Reed and Company. for said construction in the base bid
amount of $9,446,100.26 is hereby accepted and approved, and said bid and this acceptance
shall constitute the contract therefore, until any further or necessary contract in writing may
be made and entered, ifnecessary;
That in the event, and ifand when, the contractor accepted herein cannot deliver or
fails to deliver any item agreed upon, then its contract for said construction shall terminate
and the City Clerk may automatically approve a contract for the next highest bidder to
provide such improvement and proceed with said improvement, all without further order of
this Board; and,
RESOLVED, ORDERED, AND APPROVED, upon motion made by Alderman
Gainspoletti, seconded by Alderman Povall, and unanimously adopted, this January l8th,
2022.

ORDER TO DECLARE 199I PIERCE ARROW PUMPER FIRE TRUCK AS
SURPLUS AND REMOVE FROM INVENTORY
After discussion, upon Motion by Alderman Bishop, second by Alderman Campbell,
and unanimously adopted, it is ordered to declare a 1991 Pierce Arrow Pumper Fire Truck
(Asset #3173) as surplus and remove from inventory.

ORDER TO APPROVE SALE OF 199I PIERCE ARROW PUMPER FIRE
TRUCK TO RIVERSIDE FIRE DEPARTMENT
After discussion, upon Motion by Alderman Bishop, second by Alderman Campbell,
and unanimously adopted, it is ordered to approve the sale ofthe l99l Pierce Arrow Pumper
Fire Truck to the fuverside Fire Depa(ment for a total amount of $15,000.

ORDER TO APPROVE EMPLOYEE ACTION RECOMMENDATIONS
After discussion, upon Motion by Alderman Sanders, second by Alderman Campbell,
and unanimously adopted, it is ordered to approve the employee action recommendations as

After discussion, upon Motion by Alderman pova , second by Alderman campbelr,

going into executive session to discuss pending litigations, employee action
recommendations, potential property acquisition matter related to the airport ani Tumtable
Place, and a matter related to a purchased cemetery plot.

EXECUTIVE SESSION
Discussions ensued conceming each topic addressed in the above motion. However,
no board action was taken, unless as noted otherwise.
After discussion, upon Motion by Alderman povall, second by Alderman
Gainspoletti, and unanimously adopted, it is ordered to approve a memorandum of
understanding with the Air Repair, Inc. as detailed per EXHIBIT B.
After discussion, upon Motion by Alderman povall, second by Alderman
Gainspoletti, and unanimously adopted, it is ordered to approve a memorandum of
understanding with Jimmie P. and Elizabeth G. Rocconi or the Estate of Jimmie p. Rocconi.
Deceased, and the Rocconi Family Trust as detailed per EXHIBIT C.
After discussion, upon Motion by Alderman Campbell, second by Alderman Bishop,
and unanimously adopted, it is ordered to approve the refund of$650 to the Estate ofRomey
Clayton Ray for the prior purchase of a cemetery plot from the New Cleveland Cemetery.
Upon motion by Alderman Povall, second by Alderman Campbell, and unanimously
adopted, it is ordered that the Board come out ofexecutive session and re-enter open session.

With there being no further business of the Board that still needs attention, upon

BE IT RESOLVED AND ORDERED BY THE MAYOR AND BOARD OF ALDERMEN OF
THE CITY OF CLEVELAND, MISSISSIPPI that the transfers and claims detailed on the
Municipal Claims Docket of said City for the dates of Januaryr lst - January l8't,2022,
aggregating $l,452,234.31 and all hereby approved for payment to the fund and claimant in the
amount and from the particular fund as set forth in each of said transl'ers and claims on said
docket, and said amount is hereby appropriated for the immediate payment of each and all of
said transfers and claims from the respective funds as shown on said docket to be payable as
aforesaid. RESOLVED AND ORDERED as a part of the consent agenda.

PROCEOURES FOR SIDEWALK SALES
The purpose of this procedure is to establish guidelines that regulate SIDEWALK SALES in the Crosstie
Historical Downtown district.
GUIOELINES
1. Temporary exterior banners must be located so it does not present a hazard to the public and shall
not exceed more than 25% of the available storefront space.
2. Tents, trailers and other temporary structures are not permitted and no sales or display of
merchandise is p€rmitted in the parking areas.
3. Sidewalk sale merchandise may only be located on the sidewalk directly in front of the store
having the sale,
4. Oisplay of items for sale shall not rmpede foot traffic. A path of 5 feet wide shall be
reserved for pedestrians.
5. Sale dates must be approved by the Board of Alderman.
6. Flammable or hazardous items are prohibited.
7. Tables, rack, and other structures dedicated to merchandise display may only be located on the
sidewalk directly in front of the store, and shall not exceed more than 75% of the available storefront
space.
