CLEVELAND MUNICIPAL PLANNING COMMISSION
TUESDAY, AUGUST 18, 2015 AT 6:00 PM

The regular meeting of the Cleveland Municipal Planning Commission was called to
order at 6:00 P.M. by Dee Burris, Chairman.
Members present included Larry Presswood, Clarke Taylor, Tricia Pennington, Maryl
Elliott, Gary Dennis, Dee Burris and George Poe.
Members absent were Yvonne Cannon and Walt Vineyard.
Legal Counsel present was John Kimball, Attorney for the City of Cleveland.
Staff present included Corey Divel, Senior Planner, Jonathan Jobe, Director of
Development and Engineering Services, Melinda Carroll, Assistant City Manager, and
Darla Jenkins, Administrative Assistant.
Others present included Bradley and Julie Jordan, Randy Brown of Brown Surveying,
Jim Richmond of Richmond Surveying, Doug Berry of Cleveland/Bradley Chamber of
Commerce, Gary Farlow of Cleveland/Bradley Chamber of Commerce, Mitch Kinder of
Cleveland Surveying, Stacy Greene of Cormetech, John Mitchum of ReMax Realty, and
Joyanna Love of The Cleveland Daily Banner.
The minutes of the July 21, 2015 meeting were presented for approval.
Maryl Elliott made a motion to approve the minutes and Gary Dennis seconded
the motion. A vote of 7-0 passed the motion.
There were no Public Hearings.
In the Consent Agenda,
a. Request by Jason Tawfik for preliminary approval of Century Creek (Tax Map
27J Group B Parcel 15.00). Property is located on Mouse Creek Rd and is
zoned R1. Plat by Richmond Surveying Company (pg1).
b. Request by Bradley D Jordan for preliminary approval of Bradley Jordan
Property (Tax Map 050I Group H Parcel 4.00 & 4.01). Property is located on
Greenwood Ave and is zoned R3. Plat by Brown Surveying (pg2).
c. Request by Bradley D Jordan for final approval of Bradley Jordan Property
(Tax Map 050I Group H Parcel 4.00 & 4.01). Property is located on Greenwood
Ave and is zoned R3. Plat by Brown Surveying (pg3).
d. Request by SPC Properties for final plat approval of Commerce Blvd at
Pleasant Grove Church Rd (Tax Map 56 Parcels 44.00, 43.00, 43.04, 43.01) and
is zoned CH and IGC. Plat by Copp Engineering Group (pg4).
e. Request by Ann T. Duncan for final approval of Ann T. Duncan Property (Tax
Map 49L Group D Parcel 1.00, 4.00, 4.01). Property is located at Ocoee St,
Church St and 18th St NE and is zoned R1. Plat by Cleveland Surveying (pg5).
George Poe made a motion to approve the consent agenda subject to staff
comments and Tricia Pennington seconded the motion. A vote of 7-0 passed the
motion.
In Old Business,
a. Consideration and discussion of an amendment to the Zoning Ordinance
regarding Accessory Dwelling Units (pg6).
Larry Presswood made a motion to approve and George Poe seconded the motion.
A vote of 7-0 passed the motion.
In New Business,
a. Request by the Cleveland Municipal Planning Commission to rezone from R4
Mobile Home Park Zoning District to CH Commercial Highway located at the
intersection of Jones Ave SW, Jacobs Ave SW and Phillips St SW (Tax Map
57G Group C Parcel 4.00) (pg8).
Tricia Pennington made a motion to approve. Gary Dennis seconded the motion.
A vote of 7-0 passed the motion.
b. Request by Bradley Jordan for a right-of-way abandonment at 1830
Greenwood Ave NE extending off of Greenwood Ave (pg12).
Corey Divel presented an ordinance for right-of-way abandonment. The tax maps
and GIS reflected conflicting locations of the right-of-way. Staff will work with John
Kimball to correctly word the ordinance. Therefore the language in the ordinance is
subject to change. George Poe made a motion to approve and Clarke Taylor
seconded the motion. A vote of 7-0 passed the motion.
c. Consideration of an amendment to the zoning ordinance to remove Multi-
family housing from the list of conditional uses within the industrial zones
(pg17).
George Poe made a motion to approve. Clarke Taylor seconded the motion. Gary
Dennis abstained from the vote. Tricia Pennington and Dee Burris voted no. Larry
Presswood, Maryl Elliott, George Poe and Clarke Taylor voted yes. The motion
was approved with 4-yes, 2-no, and 1-abstained.
d. Consideration and discussion of a recommendation for an amendment to the
municipal code concerning the procedures for the abandonment of right-of-
way (pg22).
Tricia Pennington made a motion to approve with Clarke Taylor seconded the
motion. A vote of 7-0 passed the motion.
There was no Chairman’s Report.
In the Director’s Report,
Jonathan Jobe stated the MPO update was included in the packed as requested by
planning commissioners.
In Other Business,
Larry Presswood made a motion to overhaul or clean up the industrial
zoning ordinance. He asked the staff to meet with the Cleveland/Bradley
Chamber of Commerce to review the ordinance. He, also, requested a new
industrial zoning ordinance be presented to the planning commission.
Tricia Pennington seconded the motion. Voting to approve was Maryl Elliott,
Gary Dennis, George Poe, Dee Burris, Clarke Taylor, Larry Presswood and
Tricia Pennington.
Added August 27, 2015 per the request of Maryl Elliott and Janice Casteel:
Maryl Elliot asked what the population of Cleveland is. Corey Divel stated
about 43,000. She stated she knew they had already voted on accessory
dwellings. In the packet, the information on Clarksville, Tennessee stated
they would not advise a community with a population under 45,000 or a
college town to go the guest house route because of the potential abuse.
She stated she had voted yes to the accessory dwelling but she really
agreed with the Clarksville statement.
The meeting was adjourned at 6:45 P.M.

property located at 1200 Harrison Creek Blvd, TP # 040030801, 4220 Harrison

identified as TP# 040030805, TP# 040030806, and TP# 040030807, from PUD
with B-2, General Commercial District with conditions to PUD, with conditions.
The proposed rezoning will allow the applicant to construct 52 single-family
detached rental homes on 6.26+/- acres located along Harrison Creek Blvd
between Route 460 and Acqua Luxury Apartments. This subject property is
approximately 272,990.52 sq. ft. and has a public street frontage of approximately
261.06 feet.
b. 21-SUP-06: A petition by Eldrika Whitaker, owner/operator of Barely Used Cars
and Trucks, to establish and operate a stand-alone used vehicle sales business not
associated with a new vehicle dealership or not located upon the same parcel as
such new vehicle-dealership, if located upon parcels of less than one acre in area,
such to be permitted within the B-2 and M-1, zoning districts only, as provided
under Article 23 of the Zoning Ordinance, Section 4. Special Uses Enumerated,
(22). The proposed location is 2306 East Washington Street, Petersburg, VA.,
further identified as Tax Parcel 003030002. The subject property is within the B-
2, General Commercial District.
c. 21-REZ-07: A petition from Timothy and Jane Banks, owners/lessee, or agent to
rezone property from R-1, Single Family Residence and A-Agricultural Districts
to M-2, Heavy Industrial District to be permitted to construct and operate a
crematorium at property addressed as 3605, 3625 and 3607 Halifax Road,
Petersburg, VA. The property is further identified as Tax Parcel ID's: 096010003,
096010004 and 107020017, containing approximately a total of 37.53 acres.
d. 21-SUP-07: A petition from Timothy and Jane Banks, owners/lessee, or agent for
a Special Use Permit to allow for the construction of an office and operation of a
crematorium business along a portion of the property addressed as 3605, 3625 and
3607 Halifax Road, Petersburg, VA. The property Is further identified as Tax
Parcel ID’s: 096010003, 096010004 and 107020017, containing approximately a
total of 37.53 acres. Such SUP to be provided under Article 23 of the Zoning
Ordinance, Section 4. Special Uses Enumerated, (8).
e. 21-CPA -01: A resolution recommending approval of amendments to the City’s
Comprehensive Plan to comply with the Chesapeake Bay Preservation Act.
