MINUTES CLEVELAND MUNICIPAL PLANNING COMMISSION TUESDAY, APRIL 18, 2017 AT 6:00 PM CLEVELAND MUNICIPAL BUILDING 190 CHURCH STREET NE The regular meeting of the Cleveland Municipal Planning Commission was called to order by Dee Burris, Chairman, at 6:01 P.M. Members present were Dee Burris, David May, Jr., Clarke Taylor, Gary Dennis, Larry Presswood, Maryl Elliott, Walt Vineyard, Bill Hamilton and Tricia Pennington. There were no members absent. Legal Counsel present included John Kimball, Attorney for the City of Cleveland. Staff present included Corey Divel, Senior Planner, Jonathan Jobe, Director of Development and Engineering Services, Darla Jenkins, Executive Secretary, Melinda Carroll, Assistant City Manager/Operations. Others present included Jim Richmond of Richmond Surveying, Mitch Kinder of Cleveland Surveying, Dustin Hawkins of D & S Custom Homes, Billy Thomas of Splendor Supply, Max Phillips, President of River County Association of Realtors, Heath Davis of Award Realty, Charlotte Peak, Blake Allison & Dennis Epperson of Epperson Homes, Chad Dean of Dean Custom Homes, LLC, Larry Bowers of the Cleveland Daily Banner, Lake Mantooth and Tom Cassada, City Councilman. The minutes of the March 21, 2017 regular meeting were presented for approval. David May, Jr. made the motion to approve and Walt Vineyard seconded the motion. Tricia Pennington recused herself. A vote of 8-0 passed the motion. There were no Public Hearings. In Consent Agenda, a. Request by Cleveland/Bradley Industrial Development Board for site plan approval of Spring Branch Industrial Park located on Cherokee Gateway Boulevard. Property is zoned Commercial Highway and located within the Interstate Gateway Corridor Overlay Zoning District (pg1). b. Request by Charlotte Peak for preliminary/site plan approval for Stephens Place Lots 1 & 4 located on Stephens Rd. Property is zoned R2 Low Density Single and Multi-Family Residential Zoning District. Plat by Brown Surveying Company (pg3). Bill Hamilton made the motion to approve the items in the Consent Agenda. Tricia Pennington seconded the motion. Voting 9-0, the planning commission passed the motion. There was no Old Business. In New Business, a. Request by Donald Harris for preliminary plat approval for Douglas Court. Property is located at Georgetown Pike and 18 th St NW and is zoned R1 Single Family Residential Zoning District. Plat by Richmond Surveying Company (pg6). David May, Jr. made a motion to approve. Gary Dennis seconded the motion. A vote of 9-0 passed the motion. b. Consideration of a rezoning of approximately 1.9 acres of property located at Tennessee Nursery Rd and Martin Dr NW (Tax Map 49 Parcel 1.04 and Tax Map 49B Group E Parcel 28.00) from R1 Single Residential Zoning District to MU Mixed Use Zoning District (pg8). Maryl Elliott made a motion to deny the request to rezone. Larry Presswood seconded the motion to deny. Voting 9-0, the planning commission voted to deny the request for rezoning. c. Request to apply infill standards for a property located on Aurora and 13 th St SE (pg11). Tricia Pennington made a motion to approve. Bill Hamilton seconded the motion. A vote of 9-0 passed the motion. d. Consideration of a resolution to adopt a Plan of Service for about 3.9 acres, more or less, for property located at 1682 South Lee Hwy (pg13). David May, Jr. made a motion to postpone this item until the next planning commission meeting. He requested the people requesting the annexation of this location be in attendance. Maryl Elliott seconded the motion. A vote of 9-0 passed the motion to postpone this item. Because of this motion to postpone request of annexation, Items e. (resolution to annex) and f. (ordinance to rezone annexation) were not considered for vote. e. Consideration of a resolution to annex about 3.9 acres, more or less, for property located at 1682 South Lee Hwy (pg21). Because of this motion to postpone request of annexation, Items e. (resolution to annex) and f. (ordinance to rezone annexation) were not considered for vote. f. Consideration of an ordinance to zone about 3.9 acres, more or less, for property located at 1682 South Lee Hwy (pg23). Because of this motion to postpone request of annexation, Items e. (resolution to annex) and f. (ordinance to rezone annexation) were not considered for vote. g. Consideration of an amendment to the zoning ordinance to create provisions which allow greater density in the zoning districts which allow multi-family uses (pg25). Tricia Pennington made a motion to recommend approval of the zoning ordinance with changes as proposed by staff that the amendment only be applied to areas which are permitted to be developed to the R3 standards. Gary Dennis seconded the motion. A vote to 9-0 passed the motion. h. Consideration of an amendment to the zoning ordinance concerning setbacks within residential zones (pg28). Clarke Taylor made a motion to amend the zoning ordinance concerning setbacks within the residential zones. Bill Hamilton seconded the motion. Corey Divel will prepare a final version for the May planning commission meeting. A vote of 9-0 passed this motion. i. Discussion of possible amendment to the zoning ordinance concerning waiting period for re-application for zoning change after denial of the same property by Planning Commission (pg31). Maryl Elliott made a motion to leave the waiting period to one (1) year. Bill Hamilton seconded the motion A vote of 9-0 passed the motion. In the Chairman’s report, Maryl Elliott stated a sign advertising a downtown restaurant had been placed at the monument and did not think it was an appropriate place for it. Corey Divel stated he would contact the codes department with this message. Maryl Elliott also mentioned an article in the Chattanooga News Free Press concerning short term rentals. She stated the planning commission should review this matter. There was no Director’s report. The meeting adjourned at 7:00 P.M.
