MINUTES CLEVELAND MUNICIPAL PLANNING COMMISSION TUESDAY, FEBRUARY 20, 2018 AT 6:00 PM CLEVELAND MUNICIPAL BUILDING 190 CHURCH STREET NE The regular meeting of the Cleveland Municipal Planning Commission was called to order by Dee Burris, Chairman, at 6:00 P.M. Members present included Larry Presswood, Clarke Taylor, Bill Hamilton, Tricia Pennington, Dee Burris, Maryl Elliott, Gary Dennis, David May, Jr. and Walt Vineyard. There were no members absent. Legal Counsel present included John Kimball, Attorney for the City of Cleveland. Staff present included Jonathan Jobe, Director of Development and Engineering Services, Darla Jenkins, Executive Secretary, Cory Divel, Senior Planner, Bryan Turner, Chief Building Official, and Melinda Carroll, Assistant City Manager/Operations. Others present included Officer Brian Montgomery of the Cleveland Police Department, Mitch Kinder of Cleveland Surveying, Randy Brown of Brown Surveying, Brian Graves of the Cleveland Daily Banner, Andrew Morgan, Kenneth Malone of Beaty’s Hardware, Clayton and Judy Beaty, Tom Cassada, and Bryan Williams of Keller Williams. The minutes of the February 20, 2018 regular meeting were presented for approval. Bill Hamilton made a motion to approve and David May, Jr. seconded the motion. The minutes were approved with a 9-0 vote. The minutes of the March 6, 2018 called meeting were present for approval. Tricia Pennington made a motion to approve and Walt Vineyard seconded the motion. Voting 9-0, the commission approved the minutes. There were no Public Hearings. In the Consent Agenda, a. Request by JTR Properties, LLC for final plat approval of JTR Properties, LLC Property located on South Lee Hwy and Beard Circle. Property is zoned CH Commercial Highway Zoning District and R2 Low Density Single and Multi- family Residential Zoning District. Plat by Brown Surveying Company (pg1). b. Request by Todd Duggan for final plat approval of Stonebriar Lot 3B located on Stonebriar Drive. Property is zoned CG General Commercial Highway Zoning District. Plat by Cleveland Surveying Company (pg3). c. Request by Mitchell Maloney for final plat approval of Weeks Horizon Townhomes, lot 7 located on Weeks Horizon Place. Property is zoned R2 Low Density Single and Multi-family Residential Zoning District. Plat by Brown Surveying Company (pg5). David May, Jr. made a motion to approve subject to staff comments. Tricia Pennington seconded the motion. A vote of 9-0 passed the consent agenda. There was no Old Business. In New Business, a. Request by adjoining property owners to abandon a portion of 7th St. SE located between Cincinnati Ave SE and Wildwood Ave SE (pg7). Larry Presswood made a motion to approve and David May, Jr. seconded the motion. A vote of 9-0 passed the zoning request. b. Consideration of a rezoning request by DCP Properties for approximately .37 acres of property (described as Tax Map 42G Group D Parcels 27.00) located at 3910 N. Ocoee St from R1 Single Family Residential Zoning District to PI Professional Institutional Zoning District (pg12). Clarke Taylor made a motion to approve subject to Andrew Morgan getting a legal opinion providing the zoning is not contrary to the restrictive covenant. Tricia Pennington seconded the motion. Larry Presswood, Dee Burris, Clarke Taylor, Tricia Pennington, Walt Vineyard and Bill Hamilton voted to approve this motion. Maryl Elliott, Gary Dennis, and David May. Jr. voted no. The vote was 6-3. c. Consideration of a rezoning request by Westmore Church of God for approximately 1.5 acres of property (described as Tax Map 41G Group A Parcels 16.00, 17.00, 18.00 & 19.00) located on Candies Ln from R2 Low Density Single and Multi-family Residential Zoning District to CG General Commercial Zoning District (pg17). David May, Jr. made a motion to approve and Bill Hamilton seconded the motion. A vote of 9-0 passed this request. There was no Chairman’s Report. There was no Director’s Report. The meeting adjourned at 6:36 P.M.
