MINUTES CLEVELAND MUNICIPAL PLANNING COMMISSION TUESDAY, JULY 17, 2018 AT 6:00PM CLEVELAND MUNICIPAL BUILDING 190 CHURCH STREET NE The regular meeting of the Cleveland Municipal Planning Commission was called to order by Dee Burris, Chairman, at 6:00 P.M. Members present included Bill Hamilton, Dee Burrs, David May, Jr., Clarke Taylor, Larry Presswood, Gary Dennis, Walt Vineyard and Tricia Pennington. Tricia Pennington arrived at 6:01 P.M. Members absent were Maryl Elliott. Legal Counsel present included John Kimball, Attorney for the City of Cleveland. Staff Present included Corey Divel, Senior Planner, Darla Jenkins, Executive Secretary, and Jonathan Jobe, Director of Development & Engineering Services. Others present included Tim Siniard of The Cleveland Daily Banner, Ben Nelson of Nelson Construction, Officer Brian Montgomery of the Cleveland Police Department, Charles Brown of Brown Surveying, Teresa & Mickey Torbett, Tony Kinder of Cleveland Surveying, and Dennis Epperson & Blake Allison of Epperson Homes. The minutes of the June 19, 2018 regular meeting were presented for approval. Gary Dennis made a motion at approve the minutes and Bill Hamilton seconded the motion. A vote of 6-0 passed the motion. Tricia Pennington arrived at 6:01 P.M. There were no Public Hearings. In the Consent Agenda, a. Request by Epperson Homes, LLC for final plat approval of Stone Creek Subdivision, Phase 3 located on New Murraytown Rd NW. Property is zoned R1 Single Family Residential Zoning District. Plat by Cleveland Surveying Company(pg1). b. Request by Ben Nelson for final plat approval of Joseph & Pansy Nelson Property located on Harle Ave NW and 20th St NW. Property is zoned R1 Single Family Residential Zoning District. Plat by Southeast Tennessee Land Surveying Company(pg3). c. Request by Charlotte Peak for final plat approval of Stephens Place Lot 4 Townhouses located on Stephens Rd. Property is zoned R2 Low Density Single and Multi-family Residential Zoning District. Plat by Brown Surveying Company (pg5). d. Request by Jared and Lindsey Shelton for final plat approval of Shelton Henderson Avenue Property located on Henderson Ave. Property is zoned R2 Low Density Single and Multi-family Residential Zoning District. Plat by Richmond Surveying Company(pg6). e. Request by Japanese Hibachi Express for site plan approval of a restaurant at Spring Creek Boulevard and 25th St NE. Property is zoned PUD4 Planned Unit Development(pg7). f. Request by Hartland Dental for site plan approval of a medical office at 4305 Mouse Creek Rd. Property is zoned PUD2 Planned Unit Development(pg10). Tricia Pennington made a motion to approve subject to staff comments and Bill Hamilton seconded the motion. A vote of 8-0 passed the motion. There was no Old Business. In New Business, g. Request by adjoining property owners to abandon an unopened portion of Jones Avenue SW located between Huff Ave SW and Parker St SW(pg14). David May, Jr., made a motion to approve subject to staff comments and Clarke Taylor seconded the motion. A vote of 8-0 passed the motion. h. Consideration of a rezoning request by Cleveland Rite Aid, LLC for approximately 1.27 acres of property (described as Tax Map 57M Group B Parcel 23.00) located at 1805 Dalton Pike SE from R2 Low Density Single and Multi-family Residential Zoning District to CH Commercial Highway Zoning District(pg24). David May, Jr. made a motion to approve and Larry Presswood seconded the motion. Voting 8-0, the planning commission passed the motion. There was no Chairman’s Report. There was no Director’s Report. The meeting was adjourned at 6:14 P.M.
