MINUTES CLEVELAND MUNICIPAL PLANNING COMMISSION TUESDAY, NOVEMBER 20, 2018 AT 6:00 PM CLEVELAND MUNICIPAL BUILDING 190 CHURCH STREET NE The regular meeting of the Cleveland Planning Commission was called to order by Dee Burris, Chairman, at 6:00 P.M. Members present included Larry Presswood, Clarke Taylor, Bill Hamilton, Tricia Pennington, Gary Dennis, Walt Vineyard, Tricia Pennington, David May, Jr., Maryl Elliott, and Dee Burris. There were no members absent. Legal Counsel present included John Kimball, Attorney for the City of Cleveland. Staff present included Corey Divel, Senior Planner, Darla Jenkins, Executive Secretary, Jonathan Jobe, Director of Development and Engineering Services, and Melinda Carroll, Assistant City Manager/Operations. Others present included Amber Morris, Victoria Eachus, Kim Griffin, Candy Scoggins, Steve Scoggins, Amy Card-Lillios, Rufus Triplett, Ann McCoin, Jennie & Ken Kirkpatrick, Jo Benjamin, Gayle & Taylor Howard, Phyllis Callaway, Cole Burris, Lynn Devalt, Judy Chandler, Christina Kinzer, Amy Banks, Emma Jane Harle, Caroline Berk, Sherry Brown, Tim Siniard of The Cleveland Daily Banner, Jason Pituers, Kembry Arp, Ann Duncan, Jane Easterly, Mitchell Kinder, Vanessa Hammon, Debbie Murray, Danny Murray, Jerome Hammond, Judy Swodzinki, Randy Brown of Brown Surveying, Daniel Pelly , J.Y. Elliott, Roger Jenne, David Elliott, Michael Williamson, and Tucker Duncan. The minutes of the regular meeting of October 16, 2018 were presented for approval. David May, Jr. made a motion to approve and Gary Dennis seconded the motion. A vote of 9-0 passed the motion. The minutes of the special called meeting of November 13, 2018 were presented for approval. Maryl Elliott made a motion to approve and Tricia Pennington seconded the motion. A vote of 9-0 passed the motion. There were no Public Hearings. In the Consent Agenda, a. Request by Daniel Hagaman for preliminary plat approval of Hagaman Crossing, a cluster subdivision. Property is located at 5319 Mouse Creek Rd and is zoned R1 Single Family Residential Zoning District. Survey by Brown Surveying (pg1). b. Request by Duggan Development Co, LLC for preliminary plat/site plan approval of Stonebriar, lot 2. Property is located on Old Tasso Rd and Stonebriar Dr and is zoned CG General Commercial Zoning District. Survey by Cleveland Surveying (pg4). c. Request by Terry Posey for final plat approval of The Common at the Grove, lot 4. Property is located on Commons Ln and is zoned PUD Planned Unit Development 12. Survey by Brown Surveying (pg7). d. Request by Birger Construction Co, LLC for final plat approval of Stonebriar, lot 34 . Property is located on Bell Tower Ln and is zoned R2 Single and Multi- family Residential Zoning District. Survey by Cleveland Surveying (pg9). David May, Jr. made a motion to approve subject to staff comments and Walt Vineyard seconded the motion. A vote of 9-0 passed the items on the Consent Agenda. There was no Old Business. In New Business, e. Consideration of a rezoning request by Lee University for approximately 1.19 acres of property (described as Tax Map 49L Group E Parcels 1.01) located at 1780 Church St NE from R1 Single Family Residential Zoning District to PI Professional Institutional Zoning District (pg10). Maryl Elliott made a motion to deny and Tricia Pennington seconded the motion. Commissioners voting yes to the motion were Maryl Elliott, Tricia Pennington, Walt Vineyard and Gary Dennis. Commissioners voting no to the motion were Bill Hamilton, Dee Burris, David May, Jr., Clarke Taylor and Larry Presswood. The motion did not pass with a 4 (Yes) to 5 (No) vote. Bill Hamilton made a motion to recommend approval of the rezoning request. Larry Presswood seconded the motion. Commissioners voting yes were Bill Hamilton,  Dee Burris, David May, Jr., Clarke Taylor and Larry Presswood. Commissioners voting no to the motion were Maryl Elliott, Tricia Pennington, Walt Vineyard and Gary Dennis. The motion passed with a 5(Yes) to 4(No) vote f. Consideration of a rezoning request by Trustees of Living Word Fellowship c/o Travis Henry for approximately 1.5 acres of property (described as Tax Map 50 Parcel 4.08) located off at Unity Dr and 1445 Blythe Ferry Rd from IL Light Industrial Zoning District to R2 Low Density Zoning District (pg82). Gary Dennis made a motion to approve and Tricia Pennington seconded the motion. A vote of 9-0 passed the motion g. Consideration of a rezoning request by Timothy Morgan Lane for approximately 18.2 acres of property (described as Tax Map 50G Group A Parcel 1.00) located off of Shady Ln NE and ADP40 from IL Light Industrial Zoning District to R2 Low Density Zoning District (pg89). Tricia Pennington made a motion to approve and David May, Jr. seconded the motion. A vote of 9-0 passed the motions. There was no Chairman’s Report In the Director’s Report, The commissioners agreed to a called meeting on Tuesday, December 16, 2018 at noon. The meeting adjourned at 8:09 P.M.
