ADJOURNMENT  TOWN OF CLINTON HUNTERDON COUNTY, NEW JERSEY ORDINANCE # 25-07 ORDINANCE ESTABLISHING AN OPEN SPACE TRUST FUND WHEREAS, in accordance with N.J.S.A. 40:12-15.7, et seq., the Town Council of the Town of Clinton submitted to the voters of the Town a referendum authorizing the establishment of an “Open Space, Recreation, and Historic Preservation Trust Fund” (hereinafter referred to as the “Trust Fund”); and WHEREAS, the voters of the Town of Clinton adopted the referendum at the General Election held on November 5, 2024; and WHEREAS, the Town Council now desires to establish the Trust Fund. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Clinton, the County of Hunterdon, State of New Jersey as follows: SECTION 1. Chapter 104 of the Code of the Town of Clinton (the “Code”), entitled “Open Space Trust Fund” is hereby established as follows: § 104-1 Trust fund established. A. There is hereby established a reserve in the General Capital Fund which shall be known and designated as the “Open Space Trust Fund.” A special bank account shall be opened and maintained for this purpose. Funds from the Open Space Trust Fund may, as directed by the Mayor and Township Committee, be utilized for the following purposes, or any combination thereof: 1) acquisition of lands for recreation and conservation purposes; 2) development of lands acquired for recreation and conservation purposes; 3) maintenance of lands acquired for recreation and conservation purposes; 4) acquisition of farmland for farmland preservation purposes; 5) historic preservation of historic properties, structures, facilities, sites, areas, or objects, and the acquisition of such properties, structures, facilities, sites, areas, or objects for historic preservation purposes; 6) payment of debt service on indebtedness issued or incurred by a municipality for any of the purposes set forth in subparagraph (A)(1), (A)(2), (A)(3), (A)(4) or (A)(5) of this subsection; or 7) Blue Acres projects. B. Acquisition shall include by gift, purchase, or by eminent domain proceedings pursuant to N.J.S.A. 20:3-1, et seq., and shall include development easements, or other easements, vacant land, as well as land which has improvements upon it at the time of acquisition, where the principal purpose of the acquisition is for any or all of the purposes, or any combination of them, set forth above. § 104-2 Apportionment and allocation of fund. The Mayor and Town Council, annually, after the holding of one public hearing thereon, shall apportion and allocate the use of such tax receipts among the purposes set forth above. § 104-3 Funding. The Open Space Trust Fund shall be funded through the dedication to the fund of an amount not to exceed $0.02 per $100 of assessed valuation of each annual tax levy. The fund shall also be permitted to accept donations and testamentary bequests. The accumulated receipts and deposits with the fund may be utilized for the purposes set forth herein. All monies set aside for open space as of the effective date of this chapter shall be deposited in the fund. § 104-4 Sale of property. A. No property acquired with these funds shall be leased or sold, unless such action has been authorized by the Mayor and Town Council in a manner as prescribed by law. B. The Mayor and Town Council, after at least one public hearing thereon, and upon a finding that the purposes of this chapter might otherwise be better served or that any land acquired by the Town pursuant to this chapter is required for another public use, may, by ordinance, convey, through sale, exchange, transfer or other disposition, title to, or a lesser interest in, that land, provided that the Town shall replace any land conveyed under this section by land of at least equal fair market value and of reasonably equivalent usefulness, size quality and location to the land conveyed. Any money derived from the conveyance shall be deposited into the fund created hereunder. C. Any conveyance made pursuant to this section shall be made in strict accordance with the Local Lands and Buildings Law (N.J.S.A. 40A:12-1, et seq.). In the event of conveyance by exchange, the land or improvements thereon to be transferred to the trust shall be at least equal in fair market value and of reasonable equivalent usefulness, size, quality and location to the land or improvements transferred from the trust. SECTION 2. All Ordinances or parts of Ordinances inconsistent herewith are repealed as to such inconsistencies. SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof. SECTION 4. This Ordinance shall take effect upon final passage and publication according to law.  TOWN OF CLINTON HUNTERDON COUNTY, NEW JERSEY ORDINANCE #25-08 ORDINANCE AMENDING CHAPTER 64-8(H) OF THE CODE OF THE TOWN OF CLINTON ENTITLED “DOGS PROHBITED IN CERTAIN AREAS” TO ADD “PROHIBITING DOGS ON PUBLIC PLAYGROUNDS” WHEREAS, the Town of Clinton recently installed a new playground at Halstead Street Park; and WHEREAS, dogs can damage the playground surfacing; and WHEREAS, the Mayor and Town Council, therefore, desire to prohibit dogs in public playgrounds within the Town of Clinton; and NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Clinton, the County of Hunterdon, State of New Jersey as follows: SECTION 1. Section 64-8(H) of the Code of the Town of Clinton (the “Code”), entitled “Dogs Prohibited in Certain Areas” is hereby added as follows: Dogs Prohibited in Certain Areas. Dogs, whether running at large or on a leash, are prohibited on public playgrounds within the Town, including the playground at Halstead Street Park SECTION 2. All Ordinances or parts of Ordinances inconsistent herewith are repealed as to such inconsistencies. SECTION 3. This Ordinance shall take effect upon final passage and publication according to law.  TOWN OF CLINTON HUNTERDON COUNTY, NEW JERSEY SEWER UTILITY CAPITAL ORDINANCE #25-09 CAPITAL ORDINANCE OF THE TOWN OF CLINTON SEWER UTILITY, IN THE COUNTY OF HUNTERDON, STATE OF NEW JERSEY, AUTHORIZING THE MAKING OF IMPROVEMENTS IN, BY AND FOR THE TOWN OF CLINTON SEWER UTILITY AND APPROPRIATING THEREFOR THE SUM OF $304,600.00 FROM THE SEWER CAPITAL IMPROVEMENT FUND FOR SEWER UTILITY IMPROVEMENTS BE IT ORDAINED, by the Mayor and Council of the Town of Clinton, in the County of Hunterdon, State of New Jersey as follows: Section 1. The Town of Clinton in the County of Hunterdon, State of New Jersey, is hereby authorized to make the following improvements to the Sewer Utility in, by and for the Town, including all work, materials and appurtenances necessary and suitable therefore: ESTIMATED PURPOSE COST Water Purification System $ 30,000.00 Centrifial Blower Motors $ 30,000.00 Phospherous Analyzer $ 60,000.00 GIS Data, Maps & Applications $ 34,000.00 Paving Ramsey Road $150,000.00 TOTAL $304,600.00 Section 2. The aggregate sum of $304,600.00 is hereby appropriated from the Sewer Utility Capital Improvement Fund for Sewer Utility Improvements within the Town of Clinton Sewer Utility to the payment of the cost of the improvements as described in Section 1 hereof. Section 3. Said improvements are lawful capital improvements of the Water Utility having a period of usefulness of at least five (5) years. Said improvements shall be made as general improvements, no part of the cost of which shall be assessed against property specially benefited. Section 4. The capital budget of the Town of Clinton Water Utility is hereby amended to conform with provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Clerk and is available there for public inspection. Section 5. This capital ordinance shall take effect after final passage and publication as required by law. The Town of Clinton in the County of Hunterdon, State of New Jersey, is hereby authorized to make the following improvements to the Water Utility in, by and for the Town, including all work, materials and appurtenances necessary and suitable therefore: ESTIMATED PURPOSE COST SCADA Improvements $ 50,000.00 Valve Turner $ 15,000.00 New Truck $ 62,000.00 TOTAL $127,000.00 Section 2. The aggregate sum of $127,000.00 is hereby appropriated from the Water Utility Capital Improvement Fund for Water Utility Improvements within the Town of Clinton Water Utility to the payment of the cost of the improvements as described in Section 1 hereof. Section 3. Said improvements are lawful capital improvements of the Water Utility having a period of usefulness of at least five (5) years. Said improvements shall be made as general improvements, no part of the cost of which shall be assessed against property specially benefited. Section 4. ATTEST: TOWN OF CLINTON IN THE COUNTY OF HUNTERDON ________________________ __________________ Mayor Janice Kovach Suzannah Givone Town Clerk  TOWN OF CLINTON HUNTERDON COUNTY, NEW JERSEY BOND ORDINANCE #25-11 BOND ORDINANCE PROVIDING FOR VARIOUS CAPITAL IMPROVEMENTS IN AND BY THE TOWN OF CLINTON, IN THE COUNTY OF HUNTERDON, NEW JERSEY, APPROPRIATING $464,200 THEREFOR AND AUTHORIZING THE ISSUANCE OF $441,000 BONDS OR NOTES OF THE TOWN TO FINANCE PART OF THE COST THEREOF. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CLINTON, IN THE COUNTY OF HUNTERDON, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS: Section 1. The several improvements described in Section 3 of this bond ordinance are hereby respectively authorized to be undertaken by the Town of Clinton, in the County of Hunterdon, New Jersey (the "Town") as general improvements. For the several improvements or purposes described in Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriation made for each improvement or purpose, such sums amounting in the aggregate to $464,200, and further including the aggregate sum of $23,200 as the several down payments for the improvements or purposes required by the Local Bond Law. The down payments have been made available by virtue of provision for down payment or for capital improvement purposes in one or more previously adopted budgets. Section 2. In order to finance the cost of the several improvements or purposes not covered by application of the several down payments, negotiable bonds are hereby authorized to be issued in the principal amount of $441,000 pursuant to the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law. Section 3. Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer; provided that no bond anticipation note shall mature later than one year from its date, unless such bond anticipation notes are permitted to mature at such later date in accordance with applicable law. The bond anticipation notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with bond anticipation notes issued pursuant to this bond ordinance, and the chief financial officer's signature upon the bond anticipation notes shall be conclusive evidence as to all such determinations. All bond anticipation notes issued hereunder may be renewed from time to time subject to the provisions of the Local Bond Law or other applicable law. The chief financial officer is hereby authorized to sell part or all of the bond anticipation notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of the bond anticipation notes pursuant to this bond ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the bond anticipation notes sold, the price obtained and the name of the purchaser. Section 5. The Town hereby certifies that it has adopted a capital budget or a temporary capital budget, as applicable. The capital or temporary capital budget of the Town is hereby amended to conform with the provisions of this bond ordinance to the extent of any inconsistency herewith. To the extent that the purposes authorized herein are inconsistent with the adopted capital or temporary capital budget, a revised capital or temporary capital budget has been filed with the Division of Local Government Services. Section 6. The following additional matters are hereby determined, declared, recited and stated: (a) The improvements or purposes described in Section 3 of this bond ordinance are not current expenses. They are all improvements or purposes that the Town may lawfully undertake as general improvements, and no part of the cost thereof has been or shall be specially assessed on property specially benefitted thereby. (b) The average period of usefulness, computed on the basis of the respective amounts of obligations authorized for each purpose and the reasonable life thereof within the limitations of the Local Bond Law, is 5.87 years. (c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the Town as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $441,000, and the obligations authorized herein will be within all debt limitations prescribed by that Law. (d) An aggregate amount not exceeding $25,000 for items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated herein for the purposes or improvements. Section 7. The Town hereby declares the intent of the Town to issue bonds or bond anticipation notes in the amount authorized in Section 2 of this bond ordinance and to use the proceeds to pay or reimburse expenditures for the costs of the purposes or improvements described in Section 3 of this bond ordinance. This Section 7 is a declaration of intent within the meaning and for purposes of the Treasury Regulations. Section 8. Any grant moneys received for the purposes or improvements described in Section 3 hereof shall be applied either to direct payment of the cost of the improvements or to payment of the obligations issued pursuant to this bond ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are so used. Section 9. The chief financial officer of the Town is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Town and to execute such disclosure document on behalf of the Town. The chief financial officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the Town pursuant to Rule 15c2-12 of the Securities and Exchange Commission (the "Rule") for the benefit of holders and beneficial owners of obligations of the Town and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized bond counsel, consistent with the requirements of the Rule. In the event that the Town fails to comply with its undertaking, the Town shall not be liable for any monetary damages, and the remedy shall be limited to specific performance of the undertaking. Section 10. The full faith and credit of the Town are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Town, and the Town shall be obligated to levy ad valorem taxes upon all the taxable property within the Town for the payment of the obligations and the interest thereon without limitation of rate or amount. Section 11. Janice Kovach, Mayor Adopted: May 14, 2025 ATTEST: Suzannah Givone, RMC, CMR Town Clerk  TOWN OF CLINTON HUNTERDON COUNTY, NEW JERSEY RESOLUTION #96-25 RESOLUTION APPROVING WATER CAPACITY RESERVATION APPLICATION # L25-02 WHEREAS, on March 24, 2015, the Mayor and Council of the Town of Clinton adopted Ordinance 15-1, which amended Chapter 142 of the General Ordinances of the Town of Clinton by creating procedures for applying for and receiving approval for water reservations; and WHEREAS, the Town has received Water Reservation Application # L25-02, dated March 17, 2025, submitted in the name of Beta Land Management, LLC/The Clinton House, (Town of Clinton, Block 6, Lot 27, Tax Map Page 2); and WHEREAS, on April 11, 2025, the Town’s Water Consulting Engineer, Suburban Consulting Engineers, informed the Town of Clinton Water Committee of their recommendation of approval of the afore-mentioned application which proposes improvements to the existing property to include 180 additional seats to the existing restaurant and 11 hotel rooms; and WHEREAS, on April 16, 2025, the Town’s Water Committee held their monthly meeting in which they have reviewed the application; and WHEREAS, as the Town’s Water Committee is satisfied with the information outlined by Suburban Consulting Engineers, the application is deemed complete, to which they have granted a final approval and have imposed the conditions listed in Suburban Consulting Engineers April 11, 2025 letter. NOW, THEREFORE BE IT RESOLVED, that in accordance with Chapter 142, Section 1, Sub-section J (3) of the Town’s Ordinances, the Mayor and Council of the Town of Clinton, County Hunterdon, state of New Jersy hereby approves Water Reservation Application # L24-01 in the amount of 4,700 GPD. BE IT FURTHER RESOLVED, that this approval is valid for a period of twelve (12) months, upon which time, the applicant will need to seek approval for an extension, or the permit will be deemed invalid.
