Roll Call Councilors Present: Lamb, Keller, Kolodge, Jaakola, Wilkinson, Mayor Maki Councilors Absent: None Pledge of Allegiance AGENDA MOTION: Councilor Lamb moved and Councilor Keller seconded the motion to approve the January 21, 2025 agenda as presented. The motion carried unanimously (6-0). MINUTES MOTION: Councilor Jaakola moved and Councilor Wilkinson seconded the motion to approve the Regular Meeting Minutes of the January 7, 2025 meeting as presented. The motion carried unanimously (6-0). PUBLIC COMMENTS Jamie and Andrea Anderson spoke to council members regarding damage to their home from the watermain break that took place on Maplewood Avenue on December 19, 2024. The City’s insurance carrier denied their claim due to the break not being caused by city negligence. The Anderson’s requested help from the city on next steps. Administer Peterson will contact LMC for more information on their denial. CONSENT AGENDA MOTION: Councilor Kolodge moved and Councilor Lamb seconded the motion to adopt the Consent Agenda of January 21, 2025, approving the necessary motions and resolutions. WARD 1 VACANCY MOTION: Councilor Jaakola moved and Councilor Keller seconded the motion to appoint a new Ward 1 Councilor through an application and interview process versus holding a special election. The motion carried unanimously (6-0). POLICE OFFICE HIRE – CHILDS MOTION: Councilor Wilkinson moved and Councilor Lamb seconded the motion to approve the probationary appointment of Marcus Childs to the position of Police Officer. The motion carried unanimously (6-0). SET HEARING DATE ON PROPOSED FINAL ASSESSMENTS – 8TH STREET MOTION: Councilor Lamb moved and Councilor Kolodge seconded the motion to adopt RESOLUTION NO. 25-07, A RESOLUTION TO SET HEARING DATE ON PROPOSED FINAL ASSESSMENTS FOR THE ROAD AND UTILITY IMPROVEMENTS ALONG 8TH STREET for March 4, 2025. The motion carried unanimously (6-0). WHEREAS, The City made plans to reconstruct curb and gutter, bituminous pavement, storm sewer, sanitary sewer and water utilities in 8th Street from Sahlman Avenue to Prospect Avenue as part of the City’s 5-Year Capital Improvement Program (CIP) and approved budget for 2024; and WHEREAS, The Cloquet City Council on March 6th, 2024, held public hearings to consider the improvement; and WHEREAS, said improvements were subsequently ordered and completed and the City has prepared a proposed assessment roll which is available in the office of the City Administrator for public inspection. NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF CLOQUET, MINNESOTA: 1. A hearing shall be held on March 4, 2025 in the City Council Chambers at 6:00 p.m. to pass upon such proposed assessments and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Administrator is hereby directed to cause a notice of the hearing on the proposed assessment to be published in the official newspaper as required by Minnesota Statutes and he shall state in the notice the total cost of the improvement. He shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll as required by Minnesota Statutes. The motion carried unanimously (6-0). The second reading and Council action will take place at the February 4, 2025 City Council meeting. Background/Overview City Code requires the Mayor to appoint members to the various City Boards and Commissions with the approval of City Council. This vacancy is due to the resignation of one of its members who is also on the Cloquet Youth Baseball and Softball Association (CYBSA) Board. Mr. McCausland also serves on the CYBSA Board and will provide valuable representation to the Parks Commission. Policy Objectives The CoUncil can delegate certain functions to appointed administrative Boards and Commissions. Certain Commissions are established per Minnesota Statutes and others serve, such as the Parks Commission, at ‘ the direction of the City Council. The Band estimates they need 1-2 more years to complete restoration work and additional time to monitor the creek. The City Attorney has drafted an extension agreement that revives the original agreement and extends it through November of 2027. City and Band are collectively referred to herein as the “Parties.” RECITALS A. The Parties previously entered into a Land Access Agreement dated November 8, 2016 (the “Original Agreement”), granting the Band access to certain real property owned by the City for the purpose of conducting environmental restoration work on Jolicouer Creek, said property being located in Carlton County, Minnesota, legally described as follows: That part of the SW1/4 of NE1/4 of Section 28, Township 49 North, Range 17 West, Carlton County, Minnesota, described as follows: Beginning at the SE corner of said SW1/4 ofNE1/4 of said Section 28; running thence due West 200 feet along the South line of said SW1/4 of NE1/4; thence Northwesterly at an included angle of 100 degrees and 30 minutes, 1006 feet; thence Easterly at an included angle of 78 degrees and 30 minutes, 250 feet; thence Southeasterly to the point of Beginning. In the event any provision contained in this Agreement shall be held to be invalid, unenforceable, or in conflict with the law of the applicable jurisdiction, the remaining provisions of this Agreement shall continue to be valid, enforceable, and not be affected by such holding. 5.2. Governing Law. This Agreement shall be construed in accordance with and governed by the laws of the State of Minnesota. 5.3. Entire Agreement. This Agreement contains the entire agreement between the parties relating to the subject matter hereof. There are no promises, agreements, conditions, undertakings, warranties or representations, oral or written, expressed or implied, between the parties with respect thereto except as herein set forth. 5.4. Counterparts/Facsimile. Background/Overview/Feasibility As part of the 2025 Capital Improvement Program (CIP) the Utility Department’s excavator is scheduled to be replaced at a budgeted cost of $220,000. The existing excavator (Unit 305) is 15 years old and is a critical piece of equipment for repairing water breaks and street right of way maintenance. Under the Cooperative Purchase Agreement with the State of Minnesota, local governments can purchase this equipment directly off a previously awarded state contract. This process can provide greatly discounted prices and eliminates the need for the City to advertise bids.
