COMMON COUNCIL PROCEEDINGS Tuesday, March 26, 2024 - 7:00 P.M. Common Council Meeting Common Council Chambers Roll call was taken. PRESENT: EXCUSED: Mayor Keeler None Council President Biggs Council Member Izzo Council Member Higgins Council Member Soloyna Council Member McCarthy Council Member Frainier Mayor Keeler, “Casey’s Pub and Grill will be opening in the Van Schaick Country Club soon. I received a phone call from Norlite. They are having a temporary shutdown, which will include a furlough of about 20-30 people. They are not sure for how long. Tonight we will be voting on several properties, these are the first of several that we will have.” Sharon Butler, Commissioner of Building and Planning have the quarterly report. (attached) Council Member McCarthy made a MOTION to approve the minutes of the January 2, 9, and 23,2024, minutes. Council President Biggs seconded the motion. Council President Biggs, and Council Members Izzo, Higgins, Soloyna, and McCarthy voted “AYE”. Council Member Frainier abstained from voting. The motion passed. Council President Biggs made a MOTION to put the Public Comment period prior to the meeting. Council Member Higgins seconded the motion. All members voted “AYE”. The motion passed. Public comment will take place before this meeting. Public Comment: Tim Thibodeau, “100 apartments were built, they promised retail space with other properties, this was never done. About Ordinance #2, this has historically been public parking, why take it from them now?” Herbert, “I live at 70 Delaware Ave., moved here in November. There are Code violations, and nothing is being done about them. Cold air is coming into my apartment.” Mayor Keeler, “We will look into this first thing in the morning and get back to you.” Common Council Meeting 3/26/2024 Page 2 of 4 Bill Smith, Jay St., “I am disappointed in a Council Member. The PAA, they were having a fund raiser and asked for a plow, and it never showed up. They are one of the biggest donators in the city.” Introduction of Local Law #1 for the year 2024 A LOCAL LAW AMENDING CHAPTER 285 OF THE CODE OF THE CITY OF COHOES REGARDING ZONING AND LAND USE A public hearing will be held on April 23, 2024, at 7:00 PM Ordinance No. 1 for the year 2024 AN ORDINANCE AUTHORIZING THE RESURFACING AND/OR REPAVING OF CERTAIN STREETS IN THE CITY OF COHOES Council Member McCarthy made a MOTION to approve Ordinance No. 1 for the year 2024. Council Member Higgins seconded the motion. All members voted “AYE”. Ordinance No. 1 for the year 2024 passed. Ordinance No. 2 for the year 2024 AN ORDINANCE APPROVING THE SALE OF A CITY OWNED PARCEL Council Member McCarthy made a MOTION to approve Ordinance No. 2 for the year 2024. Council Member Izzo seconded the motion. Council President Biggs, and Council Member McCarthy voted “AYE”. Council Members Izzo, Higgins, Soloyna, and Frainier voted “NAY”. Ordinance No. 2 for the year 2024 did not pass. Ordinance No. 3 for the year 2024 AN ORDINANCE APPROVING THE SALE OF A CITY OWNED PARCEL Council Member McCarthy made a MOTION to approve Ordinance No. 3 for the year 2024. Council Member Soloyna seconded the motion. Council President Biggs voted “NAY”. Council Members Izzo, Higgins, Soloyna, McCarthy, and Frainier voted “AYE”. Ordinance No. 3 for the year 2024 passed. Ordinance No. 4 for the year 2024 AN ORDINANCE APPROVING THE SALE OF A CITY OWNED PARCEL Council Member Higgins made a MOTION to approve Ordinance No. 4 for the year 2024. Council Member McCarthy abstained from voting. Ordinance No. 4 for the year 2024 passed. Resolution No. 13 for the year 2024 A RESOLUTION APPROVING AN EXCESS WORKERS’ COMPENSATION AND EMPLOYMENT LIABILITY INDEMNITY INSURANCE CONTRACT Council President Biggs made a MOTION to approve Resolution No. 13 for the year 2024. Council Member Izzo seconded the motion. All members voted “AYE”. Resolution No. 13 for the year 2024 passed. Resolution No. 14 for the year 2024 A RESOLUTION DECLARING THE MONTH OF APRIL FAIR HOUSING MONTH IN THE CITY OF COHOES Council Member Soloyna made a MOTION to approve Resolution No. 14 for the year 2024. Council President Biggs seconded the motion. All members voted “AYE”. Resolution No. 141 for the year 2024 passed. Resolution No. 15 for the year 2024 A RESOLUTION APPROVING A CONTRACT WITH GARLAND/DBS, INC. FOR THE CITY HALL ROOF RESORATION PROJECT PHASE II Council Member Higgins made a MOTION to approve Resolution No. 15 for the year 2024. Council Member Soloyna seconded the motion. All members voted “AYE”. Resolution No. 15 for the year 2024 passed. Resolution No. 16 for the year 2024 A RESOLUTION AUTHORIZING THE GRANTING OF REVOCABLE LICENSES FOR USE OF CITY PROPERTY AND AUTHORIZING SERVICE AGREEMENT WITH VARIOUS YOUTH LEAGUES AND PUBLIC SERVICE ORGANIZATIONS Council Member McCarthy made a MOTION to approve Resolution No. 16 for the year 2024. Council Member Higgins seconded the motion. All members voted “AYE”. Resolution No. 16 for the year 2024 passed. Resolution No. 17 for the year 2024 A RESOLUTION APPROVING THE COMPROMISE AND SETTLEMENT OF PENDING LITIGATION Common Council Meeting 3/26/2024 Page 4 of 4 Council Member McCarthy made a MOTION to approve Resolution No. 17 for the year 2024. Council Member Soloyna seconded the motion. All members voted “AYE”. Resolution No. 17 for the year 2024 passed. At 7:24 PM Council Member Higgins made a MOTION to adjourn.
