MINUTES OF THE COHOES PLANNING COMMISSION MEETING HELD ON
MARCH 6, 2006 AT 6:30 P.M. IN THE COMMON COUNCIL CHAMBERS OF CITY
HALL

MINUTES
Vice-Chairman Badgley called the meeting to order at 6:35 p.m. He asked the recording
secretary to call the attendance.
The first item on the agenda was the consideration of minutes. Vice Chairman Badgley stated
that the minutes from the January 9, 2006 and February 6, 2006 are being TABLED.
PUBLIC HEARING AND CONSIDERATION OF A MINOR SUBDIVISION PLAT
ENTITLED, “SUBDIVISION OF LANDS OF SCOTT BOISVERT, # 61-67 EGBERT
STREET & CORNERS OF HARMONY & MORRIS STREETS,”
Vice-Chairman Badgley opened the public hearing on the Minor Subdivision Plat entitled
“Subdivision of lands of Scott Boisvert # 61-67 Egbert Street and corners of Harmony & Morris
Street”. Vice-Chairman Badgley asked Ms. Thomas if she had any comments. Ms. Thomas
stated that Mr. Boisvert has applied for a building permit to build an open deck on his home at 67
Egbert Street. It was discovered at that time that he didn’t have adequate setbacks between the
deck and the property line, so he has come in with a proposed plan to subdivide the piece of land
adjacent and to the south of his property at 67 Egbert Street and subdivide out a five foot (5’) by
one hundred foot (100’) piece of land and combine that into his property at 67 Egbert. He also
owns a piece of property adjacent to these two pieces to the east and he wants to subdivide out a
portion of this as well and to clarify that the five foot (5’) by one hundred foot (100’) piece of
land does contain pieces from both of the two (2) parcels. Vice Chairman asked if there were
any comments, since there were no comments from the public the Public Hearing closed at 6:40
p.m.
Since there were no other questions from the Board members Resolution #10 for 2006 and the
roll call vote read as follows:

Resolution of the Cohoes Planning Commission Approving the Final Subdivision Plat
entitled, “Subdivision of Lands of Scott Boisvert, #61-67 Egbert Street & Corners of
Harmony & Morris Streets,” SBL#10.7-6-11, #10.7-6-12 & #10.7-6-13
Clarence Badgley_ _______ presented the following Resolution, which was
seconded by Sharon Gariepy .
WHEREAS, Mr. Scott Boisvert, of 67 Egbert Street, Cohoes, County of Albany, New York did
present for approval pursuant to Section 250 of the City Code, an application for approval of the
Final Subdivision Plat entitled, “Subdivision of Lands of Scott Boisvert, #61-67 Egbert Street &
Corners of Harmony & Morris Streets,” City of Cohoes, County of Albany, New York, and
WHEREAS, said Planning Commission did meet at its offices at Cohoes City Hall, New York, on
the 6th day of March, 2006, at 6:30 o'clock P.M., and did then and there hear all persons interested
in the subject matter concerning the same, Now,
THEREFORE, BE IT RESOLVED, that the application for approval of the Final Subdivision Plat
entitled, “Subdivision of Lands of Scott Boisvert, #61-67 Egbert Street & Corners of Harmony &
Morris Streets,” City of Cohoes, County of Albany, New York, be and the same is hereby approved
as per plans submitted.
THE FOREGOING RESOLUTION was put to vote as follows:

CONSIDERATION OF AN AREA VARIANCE FOR AN ADDITION (GARAGE) AT 1
GATEWAY DRIVE SUBMITTED BY MR. JERRY DAWSON.
Ms. Thomas stated that Mr. Dawson would like to add a garage on to his home on 1 Gateway
Drive, this garage would be on the Gateway Drive side. His parcel is on a corner of Gateway
Drive and Wilson Lane. Ms. Thomas went on to say that Mr. Dawson needs front setbacks from
both the Gateway Drive and the Wilson Lane portion. The proposal he is asking for is a twenty-
six foot (26’) variance from the thirty-five foot (35’) that is required from the front street line of
his property that will result in him being nine feet (9’) from the front line of his property with the
addition. The addition is for the purpose of a garage. Vice Chairman Badgley asked for an
explanation from Mr. Dawson. Mr. Dawson stated that he has a bad water situation on his
property and he would like to backfill the driveway to stop the water from coming in. The yard
is all dug up now this is a plus what we want to do is back fill all around and put the driveway
down to parallel the gateway so that water stops running down into his property. It has been an
issue for two years (2). The city had put a storm drain in last year and I need to run this entire
pipe out of my yard out to the storm drain. After a brief discussion Mr. Scavo made a motion to
the Zoning Board of Appeals that the application be approved as per plans submitted. Resolution

Resolution of the Cohoes Planning Commission Recommending Approval to the Zoning
Board of Appeals for an Area Variance to construct a one-story addition (garage) to a
single family home, not to exceed 35’ in height, at 1 Gateway Drive, SBL#10.13-2-24
John Scavo __ ___________ presented the following Resolution, which was
seconded by Mark DeFruscio .
WHEREAS, Mr. Jerome Dawson of 1 Gateway Drive, Cohoes, County of Albany, New York did
present for approval pursuant to Section 285-10 (B) of the City Code, an application for a 26’
variance from the required 35’ building setback from the front street line at the same address, and
WHEREAS, said Planning Commission did meet at its offices at Cohoes City Hall, New York, on
the 6th day of March, 2006, at 6:30 o'clock P.M., and did then and there hear all persons interested
in the subject matter concerning the same, Now,
THEREFORE, BE IT RESOLVED, that the application for a 26’ variance from the required 35’
building setback from the front street line at 1 Gateway Drive, Cohoes, County of Albany, New
York, be and the same is hereby recommended for approval to the Zoning Board of Appeals as per
plans submitted.
