COLBY COMMON COUNCIL August 6, 2024 Page 1 The regular meeting of the Colby Common Council was called to order at 6:30 P.M. by Mayor James Schmidt. On roll call: O’Brien, T Schmidt, Baumgartner, Hesgard, Hederer and Lindeman. Also present were Mayor James Schmidt, Deputy Clerk Callie Weber, DPW Higley and MSA Engineer Dan Knoeck. Agenda was posted by the clerk. The agenda will stand as the order of the meeting. Minutes of the June 27th meeting minutes were pre-read and reviewed. Motion was made by Schmidt, seconded by Lindeman to approve the minutes as presented. Motion carried with a voice vote. Financial Statement and Bills were discussed. Motion was made by Hederer, seconded by Hesgard to approve the financial statement and bills. The amounts approved are as follows: General Fund $170,805.85; Capital Fund $48,746.26; Water Department $37,129.77; Sewer Department $15,871.75; Net payroll $25,526.32. Motion carried with a voice vote. Motion was made by Hederer, seconded by O’Brien to approve Pay Request #2 to Haas Sons for the Venzke Dr/Frontage Rd Project in the amount of $35,146.09. Motion carried with a voice vote. Motion was made by Hederer, seconded by O’Brien to approve Change Order #1 to Haas Sons in the amount of $6,408.00. The work includes dense graded base course, excavation of barn foundation, and GeoGrid BX 1200 over barn foundation. Motion carried with a voice vote. Public Comment: Lori Voss attended and introduced herself as a candidate for the 69th Assembly. Voss explained her past experiences and roles she has played in the communities of Colby & Abbotsford. Colby/Abbotsford Police Commission met on July 8th. Minutes and Expenditures were approved by the commission. Chief's Report: K-9 Hemi was deployed 12 times in June, resulting in three arrests. Chief Bowman said one deployment discovered a substantial amount of cocaine, which led to a search warrant being obtained. Additional drugs, drug paraphernalia and a substantial amount of cash was confiscated. Suspects are currently being charged in that case. There were 841 total CAPD activities reported for the month of June. There have been 5,271 total CAPD activities reported for the first six months of 2024, compared to 3,801 activities for the first six months of 2023. Chief Bowman said the CAPD had a very busy month of June. Chief Bowman reported on a double homicide involving a Hispanic family that occurred July 5 in Abbotsford. He sent out two press releases about the incident. Two girls, ages 6 and 10, were allegedly killed by their father, and their COLBY COMMON COUNCIL August 6, 2024 Page 2 mother, who was also attacked, is currently in a local hospital in critical condition. The suspected killer was apprehended with wounds to his chest area. Chief Bowman said there would be substantial overtime expenses, as CAPD officers had to hold the crime scene and keep custody of the suspect in a local hospital. Chief Bowman said the suspect was discharged from the hospital July 8 and was transferred to the Clark County Jail. He said resources and manpower were provided by the State Crime Lab and the Clark County Sheriff's Department. He said mental health counseling was being offered to CAPD officers who responded to the grisly scene. Public Works Committee met on July 9th. East Street Project Funding & Engineering: The city had applied for Local Roads Improvement Program funding and was awarded $764,000 of the total estimated cost of $1,987,000, which leaves $1,223,000 as municipal costs. The committee discussed delaying the construction of this project until we are confident that we will have TID revenues from the SC Swiderski project. They discussed getting a quote for engineering costs from MSA to start the process. Update on 2nd Street Finalization Project: Mayor Schmidt had talked with the city’s attorney. The attorney had sent out a letter to Francis Melvin that would require action or response from them in six months, which will be the end of October 2024. If we hear nothing from Francis Melvin by that time, the city will make the final payment for the N 2nd Street Project and this will be completed. 2024 Budget: DPW Higley just asked the committee if there were any projects to discuss. Hederer asked about milling S 3rd Street for a future project. DPW Higley informed the committee of some system and equipment updates needed in the water department. Central Fire & EMS District met on July 18th. Nancy O’Brien reported on the meeting of Central Fire & EMS. Discussion was held on the old ladder truck. A motion was made by Rick Rinehart, second by James Weix to put this truck on the Wisconsin Surplus website with no reserve, to be watched prior to the bid closing. Motion carried. Chief Mueller stated that Rescue 31 needs repairs as it has some oil leaks and other maintenance needs. The immediate needs for this truck will be met at this time. Chief Mueller shared that Station 3 fundraising account purchased a new Can Am UTV, a DNR grant application has been submitted for a skid unit for this UTV. COLBY COMMON COUNCIL August 6, 2024 Page 3 Chief Mueller shared that Med 11 had the air conditioning go out, this has been repaired along with the battery being replaced. The cot in Med 21 has a hydraulic lift leak which has been fixed for now but is a temporary fix. At times this cot does not lift the patient high enough for the auto lift mechanism. Quotes were obtained for new cots, the cots are old but the cot in Med 21 is the only one problematic at this time. The commission voted to purchase a new cot for Med 21 for $31, 472.66. Mayor Schmidt: Mayor Schmidt reported on his meeting of the United Communities of Clark County. DPW Higley: The following building permits were issued: Mega Co-op, 1210 N Division St., Install Mega Car Wash sign & Mega Co-op building sign; Terry Kroening, 210 S Division St., re-roof; Nicolet National Bank, 810 N Division St., expand parking lot; Neri Acevedo, 102 S Main St., re-roof; Abby Sackman, 206 E Clark St., redo driveway; Mykhail, LLC, 512 N 2nd St., black top driveway; Richard Raatz, 210 E Broadway St., build 28x40 garage; Peter Jecevicus, 310 N 6th St., replace windows; Michael Jahnke, 601 W Adams St., re-roof; School District of Colby, 614 N 2nd St., install solar PV array; Central Fire & EMS District, 203 W Broadway St., install sign on Station #1; OK Coral Saloon, 506 N Division St., interior remodel to accommodate dances, weddings, and events; Joe Maroschek, 304 N Division St., install wheelchair ramp. DPW Higley reported on the precipitation and flows for July 2024 at the STP. He also reported on the pumpage of water for July 2024. Hesgard asked DPW Higley about 500 S Main House that burnt. DPW Higley has contacted the owners. Operator’s License: The city received the following application for an operator’s license: John Feiten, 409 N 2nd St, Colby, Patrick Mateer, Sr., N15286 Estate Dr, Abbotsford, Scot Baumgartner, 305 East St, Colby, and Emilee Weisgerber, 530 Russel Dr, Unity. – motion was made by Hesgard, seconded by Lindeman to approve. Motion carried with a voice vote. Picnic License – Colby Pullers Club: Motion was made by Lindeman, seconded by Hesgard to approve the picnic license for the Colby Pullers Club for 8/16-17/24 at the pulling track. Motion carried with a voice vote. Picnic License – St. Mary’s Knights of Columbus: Motion was made by Lindeman, seconded by Hederer to approve the picnic license for the St. Mary’s Knights of Columbus for the Fall Festival on 9/8 at the 205 S 2 nd St parking lot. Motion carried with a voice vote. COLBY COMMON COUNCIL August 6, 2024 Page 4 Picnic License – Abbotsford Sportsmen’s Club: Motion was made by Hesgard, seconded by Lindeman to approve the picnic license for the Abbotsford Sportsmen’s Club for 8/24 at the Colby Lion’s Shelter. Motion carried with a voice vote. PSC Simplified Rate Case for Water Utility: Motion was made by Schmidt, seconded by O’Brien to approve application for a simplified rate case with the PSC in the amount of 4.1%. Motion carried with a voice vote. Easement for Xcel Energy – Electric to 500 Industrial Drive: Xcel Energy is asking for an easement to provide electricity to Derrico Logistics at 500 Industrial Park. The easement is located just north of Park Street. Motion was made by Hederer, seconded by Hesgard to approve the easement for Xcel Energy. Motion carried with a voice vote. Approve/Disapprove the Revised Agreement to Operate a Joint Municipal Court for the Cities of Abbotsford & Colby: Motion was made by Schmidt, seconded by Lindeman to approve the revised agreement between Colby and Abbotsford to operate a joint municipal court. Motion carried with a voice vote. Committee meetings for August: Colby-Abbotsford Police Commission will meet on August 12, 2024 at 7:00 P.M. at the Police Department. Central Fire & EMS District will meet on August 15, 2024 at 7:00 P.M. at Station 2. Adjourn: Motion was made by Hederer, seconded by Lindeman to adjourn at 7:11 P.M. Motion carried with a voice vote.
