MINUTES Regular Meeting of the College Park City Council Tuesday, January 23, 2018 Council Chambers 7:30 p.m. – 8:05 p.m. PRESENT: Mayor Wojahn; Councilmembers Kabir, Kennedy, Brennan, Dennis, Day, Rigg (arrived at 7:31 p.m.), Kujawa and Mitchell. ABSENT: None. ALSO PRESENT: Scott Somers, City Manager; Bill Gardiner, Assistant City Manager; Janeen Miller, City Clerk; Suellen Ferguson, City Attorney; Bob Ryan, Director of Public Services; Terry Schum, Director of Planning; Gary Fields, Director of Finance; Miriam Bader, Senior Planner; Steve Beavers, Community Development Coordinator; Chris Keosian, Student Liaison; Julianne Heberlein, Deputy Student Liaison. Mayor Wojahn opened the Regular Meeting at 7:30 p.m. ANNOUNCEMENTS: Councilmember Dennis announced the Coffee Club at Jason’s Deli tomorrow. Councilmember Rigg announced a District 3 forum on the Bozzuto/Quality Inn development tomorrow night in the Council Chambers. CITY MANAGER’S REPORT: Mr. Somers announced the Bowling event on Sunday. AMENDMENTS TO AND APPROVAL OF THE AGENDA: Item 18-CR-01 was removed from the agenda, and instead will be discussed in a Closed Session to be held after tonight’s meeting (Rigg/Day 8-0-0). The agenda was approved as amended (Dennis/Brennan) 8-0-0. PUBLIC COMMENT ON CONSENT AND NON-AGENDA ITEMS: Dave Dorsch, 4607 Calvert Road: We are giving away a lot of the City’s money on the Bozzuto development. It sounds like a high-quality project that would be good for the City, but at what price? College Park is becoming more attractive to developers and we have the upper hand. Miss College Park 2017, Krissy Beauchamp: She discussed her tenure as Miss College Park, her platform of suicide prevention, and her appearances. PRESENTATIONS: Janis Oppelt, Chair, Committee for a Better Environment, and Mayor Wojahn, presented the CBE Green Awards to the following: • Environmental 3-R's 'Reduce, Reuse, Recycle' - La Prima Catering • Environmentally Friendly Landscaping and Beautification - Frank and Fay Hawkins • Conservation of Natural Resources – Stasia and Myron Hutchinson • Other Environmental Achievements – Donna Weene & Girl Scouts for regular trash cleanups College Park City Council Meeting Minutes January 23, 2018 Page 2 CONSENT AGENDA: A motion was made by Councilmember Day and seconded by Councilmember Dennis to adopt the Consent Agenda, which consisted of the following: 18-G-13 Approval of Fire Department Capital Equipment Grants of $20,000 each to College Park Volunteer Fire Department, Branchville Volunteer Fire Company, and Berwyn Heights Volunteer Fire Department & Rescue Squad, for a total amount of $60,000 budgeted in the FY ‘18 Capital Improvement Fund, account 001-1010-510-25-40 – Gary Fields, Director of Finance 18-G-14 Approval of Minutes: January 2, 2018 Worksession; January 2, 2018 Special Session; January 9, 2018 Regular Meeting The motion passed 8-0-0. ACTION ITEMS: 18-G-15 Approval of Bozzuto development agreements: Declaration of Covenants and Land Use, Agreement, and Maintenance Agreement Mayor Wojahn noted there is an updated Agreement in the red folder. A motion was made by Councilmember Day and seconded by Councilmember Rigg that the Mayor and City Council approve the Declaration of Covenants, Maintenance Agreement and Agreement in substantially the form attached. There were no comments from the audience or from the Council. The motion passed 8-0-0. 18-G-16 Appointments to Boards and Committees A motion was made by Councilmember Kujawa and seconded by Councilmember Mitchell to appoint Jane Hopkins to the Recreation Board. The motion passed 8-0-0. COUNCIL COMMENTS: None. COMMENTS FROM THE AUDIENCE: Oscar Gregory, 9723 Limestone Place: The 2017 Charter changes were haphazard and didn’t take into account residents’ concerns. ADJOURN: A motion was made by Councilmember Rigg and seconded by Councilmember Kujawa to adjourn the Regular Meeting and to reconvene into a Worksession. Miller, CMC Date City Clerk Approved Pursuant to §C6-3 of the College Park City Charter, at 7:26 p.m. on Tuesday, January 16, 2018, a motion was made by Councilmember Brennan and seconded by Councilmember Day to enter into a Closed Session to consult with Counsel on a legal matter; consider a matter that concerns the proposal for a business or industrial organization to locate in Prince George’s County; and to discuss a matter directly related to a negotiating strategy before a contract is awarded. The motion passed 5 – 0 – 0 and Council entered the Closed Session at 7:26 p.m. Present: Mayor Wojahn; Councilmembers Brennan, Dennis, Day, Rigg, and Kujawa. Absent: Councilmembers Kabir, Kennedy and Mitchell. Also Present: Scott Somers, City Manager; Bill Gardiner, Assistant City Manager; Suellen Ferguson, City Attorney; Janeen Miller, City Clerk; Terry Schum, Director of Planning; Miriam Bader, Senior Planner. Topic Discussed: The City Council received legal advice re: financing options on the proposed Bozzuto development and on the status of contract negotiations. Action Taken: None. Adjourn: A motion was made by Councilmember Kujawa and seconded by Councilmember Dennis to adjourn the closed session, and with a vote of 5 – 0 – 0, Mayor Wojahn adjourned the closed session at 7:41 p.m. Pursuant to §C6-3 of the College Park City Charter, at 9:30 p.m. on Tuesday, January 23, 2018, a motion was made by Councilmember Rigg and seconded by Councilmember Kujawa to enter into a Closed Session to consult with Counsel on a legal matter. The motion passed 8 – 0 – 0 and Council entered the Closed Session at 9:38 p.m. Present: Mayor Wojahn; Councilmembers Kabir, Kennedy, Brennan, Dennis, Day, Rigg, Kujawa and Mitchell. Absent: None. Also Present: Scott Somers, City Manager; Bill Gardiner, Assistant City Manager; Suellen Ferguson, City Attorney; Janeen Miller, City Clerk. College Park City Council Meeting Minutes January 23, 2018 Page 4 Topic Discussed: The City Attorney advised the Council about the legal aspects of proposed Charter Amendment options. Next steps were discussed. Action Taken: None. Adjourn: A motion was made by Councilmember Brennan and seconded by Councilmember Mitchell to adjourn the closed session, and with a vote of 8 – 0 – 0, Mayor Wojahn adjourned the closed session at 10:27 p.m. Pursuant to Section 3-103 of the General Provisions Article of the Annotated Code of Maryland, the College Park City Council met in an Administrative Function session in the City Council Chambers of City Hall on Saturday, January 27, 2018 for a portion of the City Council Retreat. The Administrative session dealt with improving interpersonal communication between the Mayor and Council. The motion to enter into the Administrative session was made by Councilmember Day and seconded by Councilmember Rigg. The motion passed 7-1-0 (Kabir opposed). Present: Mayor Wojahn, Councilmembers Kennedy, Kabir, Brennan, Dennis, Day, Rigg, Kujawa and Mitchell. Also Present: City Manager Scott Somers, Assistant City Manager Bill Gardiner, and Consultant Terrie Glass from Zelos, Inc.
