PRESENT: Mayor Pro Tem Denise Mitchell; Councilmembers Kabir, Kennedy, Esters, Whitney, Adams, Rigg, and Mackie. ABSENT: None. ALSO PRESENT: Kenneth Young, City Manager; Bill Gardiner, Assistant City Manager; Janeen S. Miller, City Clerk; Suellen Ferguson, City Attorney. Mayor Pro Tem Mitchell called the meeting to order at 1:12 p.m. A motion was made by Councilmember Esters and seconded by Councilmember Adams to enter into a Closed Session. Mayor Pro Tem Mitchell read the closing statement: Pursuant to the statutory authority provided under General Provisions Article § 3-305(b), I move that the City Council enter into a Closed Session for the following reasons: 1) To comply with a specific constitutional, statutory, or judicially imposed requirement that prevents public disclosures about a particular proceeding or matter; 2) To conduct or discuss an investigative proceeding on actual or possible criminal conduct; and 3) To consult with counsel to obtain legal advice. The Council will not return to Open Session after the Closed Session ends. The motion passed 8-0, and the Special Meeting was concluded at 1:14 p.m. __________________________________ Janeen S. Miller, City Clerk College Park City Council Meeting minutes March 11, 2023 Page 2 CLOSED SESSION March 11, 2023 Pursuant to the statutory authority provided under General Provisions Article § 3- 305(b), the College Park City Council met in a Closed Session on Saturday, March 11, 2023. Public notice of the closed session was provided as required. The closing reasons were as follows: 1) To comply with a specific constitutional, statutory, or judicially imposed requirement that prevents public disclosures about a particular proceeding or matter; 2) To conduct or discuss an investigative proceeding on actual or possible criminal conduct; and 3) To consult with counsel to obtain legal advice. The subject of the Closed Session was to receive confidential information about a current legal matter. The Mayor and Council began in an Open Meeting in the Council Chambers at 1:12 p.m. A motion was made by Councilmember Esters and seconded by Councilmember Adams to enter into the Closed Session. Mayor Pro Tem Mitchell read the closing statement, and added that the Council will not return to Open Session after the Closed Session ends. The motion passed 8-0. The Closed Session was attended by Mayor Pro Tem Mitchell; and Councilmembers Kabir, Kennedy, Esters, Whitney, Adams, Rigg and Mackie. Others invited to attend were City Manager Kenneth Young, Assistant City Manager Bill Gardiner, City Clerk Janeen S Miller, City Attorney Suellen Ferguson, State’s Attorney Aisha Braveboy, and Chief of the County Special Victims and Family Violence Unit Jessica Garth. The guests briefed the Council on the investigation and charges against the former Mayor and took questions. The City Attorney provided legal advice to the Council in regard to the same matter. No action was taken. A motion was made by Councilmember Mackie and seconded by Councilmember Kennedy to adjourn the meeting. The motion carried 8-0 and the closed session ended at 2:04 p.m.
