Determination of Quorum A quorum was determined. IV. Approval of Agenda Mrs. Schiff made a motion to approve the agenda and Mr. Wade seconded the motion with all commissioners in favor. V. Approval of Minutes for June 1, 2021 meeting Mr. Wade made a motion to approve the June minutes and Mrs. Schiff seconded the motion with all commissioners in favor. VI. Hearing of Citizens Generally No citizens spoke. VII. Public Hearings A. PC RESOLUTION NO. 21-9 AND AN ORDINANCE NO. 21-17 To grant a special exception permit to Roslyn Farm Corporation to permit a substance abuse clinic at 300A Temple Lake Drive, also known as parcel identification number 68215800008, which is zoned GB – General Business District. Mrs. Brown presented to Planning Commission the proposed conditions for the special exception permit. She explained the definition of a substance abuse clinic and the reason a special exception permit was necessary. She also included visuals which showed the location for the proposed substance abuse clinic. Mrs. Brown listed the following conditions of the permit, if Planning Commission were to approve it: 1. Hours of operation will be Mon-Fri 6AM-4PM; 2. Hours of operation Sat-Sun 6AM-10AM.; 3. All office visits will be by appointment, except for emergencies; and 4. The clinic will comply with all federal, state, and local requirements. Mrs. Brown read an email from Mr. Jason Kelly of Pivot Physical Therapy, who expressed his opposition to a substance abuse clinic leasing the space next door to him. Mr. Kelly was concerned that there would be drug addicts loitering around the facility who would put his patients at risk. The property owner, Nick Walker of Roslyn Farm Corporation, was present to answer questions in regards to the building and parking lot. Applicants, Mr. Jonathan Coleman and Mr. David Banks of Foundation Medical Group, came to the podium and presented information about their organization and what the business would entail. They provided commissioners with a packet of information about the business. In response to the email, Mr. Coleman and Mr. Banks emphasized that addiction can happen to anyone, such as kids in school having “pill parties”, or parents on pain medications that are opioids. They stated that they only disperse medication from 6 a.m. to 11 a.m. by appointment and there is no concern of loitering as most patients are working individuals. They also stated that the rate of substance abuse has increased 139% as a result of the pandemic, and there have been 93,000 deaths as a result of overdoses. Mr. Coleman remarked that they wanted to build a nice clinic in a nice area that people wouldn’t be afraid to seek treatment from. They emphasized that patients must be in an active treatment involving therapy to be receiving medication. Mr. Hartson asked where the nearest comparable facility was located. Mr. Coleman stated there was one in Richmond, and that there may be one trying to open in Petersburg. Mr. Hartson then asked about onsite security in order to address concerns from Mr. Kelly’s email. Mr. Banks stated they have their own security as well as their own security camera system. Mr. Hartson asked if they have armed guards during operation. Mr. Banks replied that they would have armed guards. Mr. Coleman additionally stated that medications are locked in a safe behind an additional locked door behind a cage. Mr. Wade asked what other businesses they run. Mr. Coleman stated that he has two businesses on Turner Rd in Chesterfield County which utilize a 2.1 and 2.5 substance use program. 2.1 is when patients come in for 4 hours a day, 3 days a week to receive treatment. 2.5 is 5 hours a day, 4 days a week. This is a different level than the proposed facility with a pharmacy attached. Mr. Wade asked how long he had been operating those businesses and Mr. Coleman stated it had been three and a half years. Mr. Wade then asked if they had ever had problems where the police needed to be called. Mr. Coleman stated that he had called the police in three instances that were easily handled. Mr. Wade asked Mrs. Brown and Mr. Walker how long Mr. Kelly has been in business at the property adjacent to the proposed clinic. Mrs. Brown replied that the email states he has been doing business in Colonial Heights for 15 years, but wasn’t sure about that specific location. Mr. Walker stated that Mr. Kelly had been a tenant since 2009. He also stated that Mr. Kelly had called him with concerns about the proposed clinic. Mr. Wade asked the term of the lease and Mr. Walker stated that it would be a long-term lease which are usually 7-10 years, but that the details had yet to be determined pending the approval of the special exception permit. Mr. Wade asked Mr. Coleman and Mr. Banks if they had spoken to Mr. Kelly, and they stated that they had not had any contact with him. The gentlemen additionally asked Mr. Walker to clarify that his properties do not allow loitering. Mr. Walker verified that and stated that he has only ever had to call the cops once. Mr. Kohan asked Mr. Walker if there would be parking issues. Mr. Walker stated that they meet beyond the minimum zoning standards so he did not believe it would be an issue. Mr. Kohan then asked for the average stay period of patients. Mr. Coleman stated that it was a 15-minute turnaround. Mr. Hartson asked why the special exception permit was required. Mrs. Brown stated that it is specifically stated in the zoning ordinance. Mrs. Hamilton was concerned about the prenatal facility that is adjacent to the property. Mr. Walker stated that they were notified but he did not receive a response. Mr. Fisher emphasized that the business must meet federal and state requirements, in addition to City requirements. They are heavily regulated by the state, the DEA, and they have many standards they must comply with in addition to the special exception permit. Mrs. Schiff asked Mr. Coleman why Colonial Heights was chosen as a location. Mr. Coleman stated that they wanted to be a resource for Colonial Heights where there is a need as well as the adjacent Fort Lee soldiers in need. Mrs. Levinson-Melvin stated that she had attended a summit on substance abuse at Colonial Heights High School and recognized the need in the community. She also stated she had first hand experience as one of her family members had struggled with opioid addiction. Mrs. Levinson-Melvin made a motion to approve PC Resolution 21-9 and Mr. Wade seconded the motion. SUB 21-1 Riverside Park, Lots 19-22 Block 16 Subdivision Property owner “Lundie Properties LLC”, proposes a re-subdivision of parcel identification number 38000116022, property address 415 Cameron Ave, with a legal description of Riverside Park, Lots 19-22, Block 16. The subject parcel is 0.345 acres and zoned RL- Residential Low Density. The proposed subdivision will create two new parcels. Mrs. Brown presented about the current conditions of the lots and the proposed subdivision. Lot frontage would be 60 to 65 feet instead of the minimum 75 feet in the zoning code. Mr. Lundie of Lundie Properties came to the podium to speak about the property. He stated that in 2012 the zoning code changed the frontage from 50 to 75 feet, and that the two new houses would fit with the rest of the neighboring houses which have 50 feet of frontage. There was previously one house on the property. Mrs. Hamilton expressed concerns about the historic significance of the neighborhood and the addition of new properties. Her opinion was that it would maintain the street scape better to have one house facing Cameron Avenue rather than two properties facing Washington Avenue. She stated that she could not support this development. Mrs. Levinson Melvin made a motion to approve Subdivision 21-1 and Mr. Wade seconded the motion. Others, as necessary or appropriate a. City Manager – Mr. Smith Mr. Smith shared that as of July 1 the work on Violet Bank was completed. The renovations included new copper gutters. This project was funded by the Cameron Foundation. Mr. Smith also provided updates on local businesses. Crumbl Cookies was due to open August 13th and Dunkin Donuts had submitted plans for a late 2021-22 opening. He announced that there would be an event at the Keystone Tractor Museum called Colonial Heights Day on October 2nd. The Chili Peppers finished their home games, and had sold over 18,000 tickets for the season. He also mentioned the success of City employee night. b. City Attorney – Mr. Fisher Mr. Fisher made commissioners aware of two modernization projects: sidewalk installation around North Elementary across 21 parcels, and improvements along the Boulevard and Westover Avenue by McDonalds to widen the road. Mrs. Hamilton asked about rehabilitation of 608 Hamilton Avenue. Mr. Fisher stated that City Council did not approve the necessary funding of $55,000 - $60,000 to bring it up to building code standards. X. Call to Order in Council Chambers of City Hall, 201 James Avenue*. The meeting was called to order at 8:59 AM. II. Roll Call Present: Mr. Hartson Mr. Kohan Mrs. Schiff Mr. Kwiek Mrs. Levenson-Melvin Mr. Wade Absent: Mrs. Hamilton III. Boarding onto bus and site visits to new multi-family house at the following locations: A. Magnolia Green, 6700 Otterdale Road, Mosely, VA 23120 The Schell Brothers presented to Planning Commission about their involvement with the project at Magnolia Green, and explained the process for development. They then led the Commissioners on a tour. The tour included all community areas as well as the interior of one of the apartments. The Schell Brothers demonstrated the types of amenities available in that type of market-rate apartment as well as average costs of living for tenants. B. Regency Square, 1420 N. Parham Road, Richmond, VA 23229 The Schell Brothers stopped the bus in front of construction being done at Regency Square. They explained that these “Multi-Use” developments involving apartment complexes adjacent to a shopping mall are becoming increasingly common. While they were not involved in that particular project, they were aware of collaborative efforts between the developers and the mall to make amenities available to future tenants including restaurant discounts, gym memberships, and a rooftop bar. C. The Station at Chester Village, 11910-11912 Chester Road, Chester, VA 23831 The final stop on the tour was a construction site where the Schell Brothers were building a new apartment complex behind the Chester Village Green shopping center. They provided commissioners with renderings of the proposed apartment buildings and amenities, and discussed their commitment to building luxury apartments. IV. Return to City Hall V. WHEREAS, Christian Life Center and Swearingen Realty Company have filed an application for a special use permit to allow for an addition to the existing religious assembly, located at 505 Lakeview Avenue, also known as parcel identification number 1900010Y001, which is zoned RL – Residential Low District; and WHEREAS, Christian Life Center has entered into a contract to purchase the adjacent lot from Swearingen Realty Company, which is known as parcel identification number 1900010Y002, and is zoned RH – Residential High District; and will then vacate the boundary line between the two parcels; thereby creating one parcel consisting of 1.3 acres; and WHEREAS, a minimum of 2.0 acres are required in a residential low zoning district for a religious assembly use; and WHEREAS, a residential high zoning district does not have a minimum acreage requirement for a religious assembly; and WHEREAS, Christian Life Center is a legal non-conforming use on parcel identification number 1900010Y001; and WHEREAS, the Planning Commission held a public hearing to receive citizen comment on the issuance of a special use permit, and after due consideration the Planning Commission approved Planning Commission Resolution No. 21-11, a copy of which is attached hereto and made a part of this ordinance; and WHEREAS, the Planning Commission recommends that City Council approve this ordinance; and WHEREAS, upon recommendation of the Planning Commission, the City Council finds that the public necessity, convenience, general welfare, and good planning and zoning practice 1 ORDINANCE NO 21-23 require that this special use permit be granted; and WHEREAS, City Council further finds that after investigation by the Colonial Heights Planning Commission, that issuance of the requested special use permit to Christian Life Center and Swearingen Realty Company will not be detrimental to the safety, health, morals, and general welfare of the community involved; will conform to the principles of good planning; will not tend to create congestion in streets, drives, alleys and other public ways and places in the area involved; will not create hazards from fire, panic or other dangers; will not tend to overcrowding of land and cause an undue concentration of population; will not adversely affect or interfere with public or private schools, parks, playgrounds, water supplies, sewage disposal, transportation or other public requirements, conveniences and improvements; and will not interfere with adequate light and air; NOW, THEREFORE, THE CITY OF COLONIAL HEIGHTS HEREBY ORDAINS: 1. Christian Life Center, also known as parcel identification number 1900010Y001 is zoned RL, residential low density which requires a minimum of two acres for the development of a religious assembly. The proposed expansion would also be located on an adjoining property, owned by Swearingen Realty Company, also known as parcel identification 1900010Y002, which is currently zoned residential high district. The residential high-density zoning district does not require a minimum acreage requirement for a religious assembly; however, the applicant wishes to purchase the adjoining tract and vacate the property line. Both properties contain a total of 1.4 acres where 2.0 acres is required for a religious assembly use in the residential low zoning district classification Below, you will find more detailed information regarding the location, zoning, land use, and staff analysis. Location Located at 505 Lakeview Avenue, the existing facility contains approximately 5,500 sq. ft. on an existing 0.67 parcel, identified as parcel identification number 1900010Y001, currently zoned low density residential. Section §286-406.32 (B) of the City’s use and design standards allows religious assembly, subject to a minimum lot size of two (2) acres in the RL residential low zoning district. Zoning The official zoning map shows this property zoned as RL – Low Density Residential. Surrounding Zoning North: RL – Residential Low Density South: RL – Residential Low Density East: RL – Residential Low Density West: RH – Residential High Density Comprehensive Plan Land Use Plan The City’s Land Use Plan identifies parcel 1900010Y001 as “Civic/Institutional.” Parcel identification 1900010Y002 is identified as “Multifamily.” Surrounding Land Use Existing Land Uses: North: Residential-Single-Family South: Residential-Single Family East: Residential-Single Family West: Vacant Land Use Plan: North: Low Density- Single Family South: Low Density- Single Family East: Low Density – Single Family West: High Density Residential Analysis of Request The applicant is requesting an 8,000 sq. ft. addition onto a religious assembly, with a lot area of 0.67 acres. The applicant’s lot, as well as the adjoining lot (owned by Swearingen Realty) contain a combined total of 1.4 acres where two (2) acres is required under the City’s use and design standards. This request necessitates a Special Use Permit, as the combined total square footage of both lots is smaller than the ordinance allows in the RL – Low Density Residential Zoning District Classification. Relevant Ordinance Requirements: 1. City Charter §17.11-1 Uniformity of Regulations within a District—Special Use Permits, the City Council has the authority to issue a special use permit by adopting an ordinance; however, prior to such adoption, the planning commission must investigate the circumstances and conditions and hold a public hearing. Once this occurs, “The city planning commission may recommend and the council may impose such conditions upon the use of the land, buildings and structures as will, in its opinion, protect the community and area involved and the public from adverse effects and detriments that may result therefrom”. As provided in this same section of the Charter, the Commission should investigate the circumstances and conditions to determine whether the “special use will not be detrimental to the safety, health, morals and general welfare of the community involved, will not tend to create congestion in streets, roads, alleys and other public ways and places in the area involved, will not create hazards from fire, panic or other dangers, will not tend to overcrowding of land and cause an undue concentration of population, will not adversely affect or interfere with public or private schools, parks, playgrounds, water supplies, sewage disposal, transportation or other public requirements, conveniences and improvements, and will not interfere with adequate light and air”. 2. Zoning of the City of Colonial Heights City Code, Use and Design Standards, Section §286-406.32 Religious assembly. A. General Standards: 1. Any outdoor activity area, swimming pool, ball field or court which adjoins a residential use type shall be landscaped with a minimum of one row of small evergreen trees in accordance with §286-512 along the property line adjoining the residential use type. Where nighttime lighting of such areas is proposed large evergreen trees shall be required. 2. When a place of religious assembly adjoins a residential use type, a Type C buffer yard in accordance with §286-512 shall be provided between the parking area(s) and the residential use type. B. In the RL and RM Districts, the following standards shall apply: 1. The minimum lot size shall be two acres. 2. The maximum building coverage shall be 20% and the maximum lot coverage 50% of the total lot area. 3. Zoning of the City of Colonial Heights City Code, Development Standards, Section §286-512.06 (a) (4) planting island required every 15 spaces. • The plat needs to be revised to adhere to this requirement; all other landscaping requirements will be addressed during site plan review. 4. Zoning of the City of Colonial Heights City Code, Section §286-518.18 406.32 Minimum parking required - Religious assembly. • 1 space per 6 seats in principal place of worship is required. The new facility will contain a total of 340 number of seats; 57 spaces are required; 66 spaces will be provided which exceeds the ordinance requirement. Townes, II, Land Surveyor; and (ii) A site plan will be required for the development, which complies with all other City standards and specifications.
