DETAILED DESCRIPTION OF SUBJECT MATTER:
Our Wastewater Engineer, David Arnott appeared before the City Council on December
4, 2018 to share efforts and interests in enhancing programs to regulate the discharges
of industrial strength wastes into the Wastewater Treatment Plant. Dave described the
need to work with the industrial community to limit the pollutants discharges which
ultimately affect the limits that the Wisconsin DNR places on the WWTP permit.
Attached is a task order drawn up by Ruekert-Mielke to commence this project. The
work to set up the system is recommended to set up ordinances, educate affected
customers to the WWTP on the program and determine the appropriate regulatory
levels will coincide with the operations of the WWTP and the requirement of our
discharge permit.
The 2019 budget has an amount set for non-specific project engineering, which this
work would qualify. The budget in this line item would cover the costs of this task order.

This is Task Order No. 2019-01,
consisting of 4 pages.
Task Order
In accordance with paragraph 1.1 of the Master Professional Service Agreement between City of
Columbus (City) and Ruekert & Mielke Inc. (R/M) for Professional Services – Task Order Edition, dated
April 6, 2010 ("Agreement"), City and R/M agree as follows:
1. Specific Project Data
A. This project will include establishing local discharge limits for significant sewer
users, including but not limited to American Packaging and Enerpac. The local
discharge limits prohibit wastewater pollutants (constituents) from being
discharged to the sanitary sewer system. These pollutants can interfere with the
designed operation of the collection system or treatment facilities; pass through
the treatment works to cause the treatment works to exceed the limits presented
by the WPDES permit; or interfere with the sludge management program.
Discharge permits will be prepared for the existing, significant sewer users and
serve as a template for future permitting. The project will include suggestions for
modifying and updating the Sewer Use Ordinance. Sections will be modified or
added for discharge prohibitions, discharge limitations, local limitations,
wastewater discharge permits, and pretreatment.
2. Scope of Services for R/M
A. R/M would provide the following services to develop local limits:
1. Establish toxic substance concentrations for non-industrial sewer
users.
2. Review and identify the toxic removal efficiency of the Columbus
WWTP.
3. Identify background, toxic concentrations of the water in the
Crawfish River.
4. Summarize water quality-based effluent limits for toxic substances.
5. Calculate allowable pollutant loadings to prevent pollutant
pass-through, treatment process interference, and sludge
management program interference.
6. Compare allowable pollutant loadings and identify controlling
value.

7. Identify and summarize loadings available to industry and
pollutant concentrations available to industry.
8. Establish flow-based concentrations for pollutants.
B. R/M will provide the following services for preparing the discharge permits for
existing, significant sewer users, including but not limited to: American
Packaging, Enerpac, Ottery Brothers, LLC, Roberts Mfg., and Fromm:
1. Meet with significant sewer users to review the purpose and scope
of the program, and to obtain information on the source, location,
and characteristics of their wastewater discharges.
2. Inspect significant, sewer user facilities.
3. Provide sewer user questionnaires to the significant sewer users,
coordinate the completion of questionnaires, and review the
finished questionnaires.
4. Obtain and review the information available for the sewer users
including the wastewater flow schematic and site plans.
5. Prepare an outline of the discharge permit and review with City
staff.
6. Prepare discharge permits for two, significant sewer users. Permits
will contain sections including: description of industrial operations,
monitoring facility requirements, monitoring requirements,
reporting requirements, access to monitoring facilities, basis of
user charge, local limitations, notification of process changes, and
provisions for modification of the permit.
7. Meet with significant sewer users to present their permits.
8. Coordinate finalizing and implementing the discharge permit
program with the significant users and the City.
C. R/M will provide the following services for modifying and updating the
Sewer Use Ordinance:
1. Review the existing Sewer Use Ordinance and identify the sections
that need to be modified and updated.
2. Modify and update sections of the Sewer Use Ordinance.
3. Provide a draft of ordinance changes to the City for review and
comments.
4. Update draft to incorporate City comments.
5. Provide final Sewer Use Ordinance to the City for council’s
approval and incorporation into the City’s Code of Ordinances.

6. Assist City in notifying significant sewer users of the Sewer Use
Ordinance update and its impact on their wastewater management.
3. City's Responsibilities
The City shall have those responsibilities set forth in Section II of Agreement, subject to the

B. Provide the current Sewer Use Ordinance.

Schedules are subject to change due to activities beyond the control of Ruekert & Mielke, Inc. In
general, the tentative schedule is as follows:

April 2019 Incorporate City comments and finalize project.

DETAILED DESCRIPTION OF SUBJECT MATTER:
At the January 15th COW, the Council give support for going forward on a project to
refinish the wood floors at the Pavilion, which would utilize funds from the Columbus
Historic Landmarks Preservation Commission. It was there that information was
provided regarding a generous donation of funds was to be coming in to address a
number of projects with the Pavilion, which is great.
To formalize the plan for the project for HLPC will be good for Tuesday night, but I want
you to know that I intend to forward official agreements with contractors to the Council
for formal approval before work is undertaken with the City as a signatory to the
agreement.

AN ORDINANCE TO REPEAL SECTIONS 106-32(3) AND 106-35, AND REPEAL AND
RECREATE SECTIONS 106-37, 106-39, 106-44 AND 90-334
OF THE CITY CODE OF ORDINANCES
The Common Council of the City of Columbus, Columbia County, Wisconsin, does ordain
as follows:
1. Sec. 106-35. – Beautification Committee, is hereby repealed in its entirety and has no
further legal effect or authority.
2. Sec. 106-32(3) is hereby repealed in its entirety and has no further legal effect or authority.
3. Sec. 106-37. – Interference with City Forester Prohibited, is hereby repealed and recreated
to now read as follows:
No person shall interfere with the City Forester, the Forester’s authorized
representative, or its agents while they are engaged in carrying out any work or
activities authorized by this chapter.
4. Sec. 106-39(a) – Planting of Public Trees and Shrubs, is hereby repealed and recreated to
now read as follows:
(a) Tree Planting Program. The City Forester, using the Arboricultural
Specifications Manual for the City of Columbus shall recommend to the
Common Council a program for tree planting, care, and protection for
public trees and shrubs. The Common Council shall also encourage the
planting, care and protection of trees and shrubs on private premises within
the City.
5. Sec. 106-44 – Appeals, is hereby repealed and recreated to now read as follows:
Any action of the City Forester may be appealed to and heard by the Common
Council. To be effective, an appeal must be filed within 30 days after the decision
of the City Forester. The appeal shall be in writing and shall be filed with the City
Forester and with the City Clerk for placement on the Common Council’s agenda.
The appeal shall clearly specify the reasons for which a hearing is requested.
6. Sec. 90-334(1) – Plans, is hereby repealed and recreated to now read as follows:
(1) Each of the following plans and accompanying construction specifications
shall, except for the landscaping plan, be approved by the Common Council
and any other agency having relevant approving authority before
commencement of the installation of the relevant improvement. The
landscaping plans shall be reviewed and approved by the Plan Commission.
7. If any portion of this Ordinance or its application on any person or circumstances is held
invalid, the validity of this Ordinance as a whole or any other provision herein or its
application shall not be affected.
8. This Ordinance shall take effect immediately upon its passage and publication or posting,
as required by law.

DETAILED DESCRIPTION OF SUBJECT MATTER:
This issue relates to the management of driveway widths for properties along James
Street that came about as part of the James Street reconstruction.
After the James Street project, several driveways were identified that did not comply
with City Code, either to wide, dual driveway or other imperfections. Instead of requiring
the landowners to bring the driveway into compliance, Atty. Paul Johnson came up with
a document allowing the driveway to remain in place as is until such time as it needs to
be replaced by the homeowner (or the City/DOT requires it as part of a street project). If
that occurs, then the owner will need to bring the driveway into compliance.
Attached is a waiver document and list of affected properties.

This is not a conveyance as defined under Wis. Stat. § 77.21(1) and not subject to a
real estate transfer fee.
A. As of the date of execution of this Waiver, the real estate identified more
specifically on Exhibit A (the "Property") contains a driveway that does not conform
to Chapter 86 the City of Columbus Code of Ordinances ("Columbus Code");
B. Pursuant to its general powers, the City of Columbus Common Council finds that
waiving compliance with the Columbus Code will not have a detrimental effect on the
safety of the general public;

NOW THEREFORE, the City waives the requirement that the Nonconforming Lodi, WI 53555-0256
Driveway comply with the Columbus Code conditioned upon the following provisions:

Parcel Identification Number (PIN)
1. In the event the Nonconforming Driveway is damaged from any cause whatsoever and to the extent that repair costs would be equal
to or greater than 50% of the cost of installing a new driveway, or in the event that the Nonconforming Driveway is voluntarily removed
or replaced, this waiver is deemed revoked and a new driveway that meets the minimum driveway requirements of the then current
Columbus Code must be installed.
2. In the event the City deems it necessary to revoke this waiver on the basis of a need to expand capacity or improve safety, the City
reserves the right to give notice regarding the removal of the Nonconforming Driveway. The City may terminate this waiver upon thirty
(30) days written notice to the property owner. The property owner shall remove the Nonconforming Driveway maintained under this
waiver within the time specified in the notice.
3. If the City determines the maintenance or use of the Nonconforming Driveway authorized under this waiver increases the difficulty of
road maintenance, creates conditions adverse to the best interest of the highway users, the general public, or presents a threat to
road or pedestrian safety, then the property owner, upon notification by the City, shall promptly remove the Nonconforming Driveway.
4. The requirement to install a new driveway after revocation of this waiver does not relieve the property owner from complying with any
and all provisions of the Columbus Code regulating the installation of driveways.
5. Issuance of this waiver shall not be construed as a waiver of any other defect in the Nonconforming Driveway that fails to meet the
minimum requirements of the Columbus Code or as a waiver of the property owner's obligation to comply with any other requirement
imposed by the Columbus Code or state law.
6. Failure by the property owner to comply with the provisions of this waiver is cause for the City to terminate this waiver and to require
the property owner to take immediate action to comply with the Columbus Code.
