Background Based on discussion and options provided to recoup the costs of DPW staff to clear residential sidewalks, the consensus at the Committee of the Whole was to move forward with the $111.57 mobilization fee plus the $1/linear foot of snow removed. Council also asked to see a draft notice that will go out to residents which is attached for review. Fiscal Impact Costs of work by staff and equipment used will be recouped and work will not be subsidized. Recommendation 1. Approve the updated fee for sidewalk snow removal of $111.57 mobilization fee plus $1/linear foot of snow removed. 2. Approve notice to residents. 3. Decide date that this policy will be put into effect. LIST ALL SUPPORTING DOCUMENTATION ATTACHED: - Draft notice to residents ACTION REQUESTED OF COUNCIL: Review and Approve.  Draft notice to residents regarding sidewalk snow removal fee increases Dear Resident, Please be advised the sidewalk abutting your property shall be cleared within 24 hours of a snowfall according to Wisconsin State Statute § 66.0627 and Article VII Section 86-226 of the City of Columbus Code of Ordinance. In the event the City is forced to remove snow from sidewalk abutting your property, to recover all costs incurred by the DPW to perform this work, effective TBD the fee for said snow removal from residential sidewalks has been increased to $111.57 dispatch fee, plus $1 for every linear foot of snow removed on your sidewalk. Safety of citizens is of utmost importance in Columbus. If your sidewalk is not cleared within 24 hours of a snowfall and the Department of Public Works gives notice to a property owner that they are in violation and the work is not completed within 24 hours of the notice, the appropriate measures will be taken. If you know of a sidewalk that has not been cleared within the 24-hour window, please contact the Public Works Department at 920-623-5908.  MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding entered into this 17th day of December, 2019, by and between the City of Columbus (hereinafter “Columbus”), Kestrel Golf Properties LLC (hereinafter “Kestrel”) and William N. Hoffman and Julia C. Hoffman (hereinafter “Hoffman”). WHEREAS, Kestrel is the owner of Lot 1 of CSM 3981 (Tax Parcel No. 11211 1400.06); and WHEREAS, Hoffman is the owner of Lot 1 of CSM 4400 (Tax Parcel No. 11211 1187.03); and WHEREAS, Columbus has a stormwater pipe and facility that goes across, under, over and through the properties owned by Kestrel and Hoffman; and WHEREAS, in order to better manage the stormwater issues on the properties owned by Kestrel and Hoffman, and to better manage the flow of stormwater throughout this area of Columbus, Kestrel desires to install a control device in the existing stormwater management facility to regulate the water level and Hoffman desires install drain tile around the stormwater management facility and connect that facility and the drain tile to the existing stormwater structure and facility maintained by Columbus; and WHEREAS, Columbus agrees to allow Kestrel to connect to its existing stormwater pipe under certain terms and conditions as set forth in this Memorandum of Understanding. NOW, THEREFORE, for good and valuable consideration, the receipt of which is hereby acknowledged, the parties to this agreement do hereby agree as follows: 1. Kestrel and Hoffman shall, at is sole expense, be responsible for constructing any and all stormwater maintenance facilities on its parcel as it deems appropriate; provided, the facility constructed by Kestrel has a mechanism which will allow the flow of stormwater to be regulated by Kestrel and Columbus. 2. Once constructed, Kestrel and Hoffman shall be allowed to connect to the Columbus stormwater pipe that travels across the Kestrel and Hoffman properties under the following conditions: A. Kestrel and Hoffman shall make the connection to the structure maintained by Columbus at a storm water manhole location to be determined by the City of Columbus Engineer. The connection shall also be made in a manner approved by the City Engineer. B. Once the connection has been established, Kestrel and Hoffman shall be solely responsible for maintaining and repairing the connection. C. Kestrel shall be responsible for keeping the connection clean and free of debris, and also shall be solely responsible for making any repairs to the Columbus facility that are caused as a result of stormwater flow from Kestrel’s facility through the Columbus facility. 3. Kestrel agrees to use its best practices in maintaining the level of its stormwater facility so as to minimize the possibility of flooding in this area and downstream storm water pipe. Kestrel grants Columbus the authority to adjust the flow of water from the Kestrel facility if, in the opinion of Columbus, the flow of water is causing, or may cause, flooding issues downstream from the Kestrel facility. 4. Kestrel shall install flow monitors in locations to be determined by the City of Columbus Engineer to monitor the flow of stormwater through the Columbus facility if directed by the City of Columbus. 5. The facility installed by Kestrel, and the connection of the Kestrel facility to the Columbus facility, shall not be dedicated to the public and shall always remain the private property of Kestrel. 6. In the event Kestrel fails to perform its obligations under this Memorandum of Understanding, Columbus shall have the authority to make all repairs to its facility, including the connection created by Kestrel. In such an event, all associated costs will be assessed back as a special charge against the Kestrel property pursuant to §66.0627 Wis. Stats. Said charge shall be a lien on the property and shall be collected with real estate taxes. 7. This agreement shall run with the land and is binding upon the parties, their successor and assigns. Hoffman is made part of this agreement because the Columbus facility travels across the Hoffman property and Hoffman will have a drain tile pipe that will connect to the Columbus storm water pipe. Hoffman shall not be personally responsible for any of the obligations of Kestrel and their improvements and Kestrel will not be responsible for Hoffman and their improvements as set forth in this agreement.
