Public Hearing on the proposed 2023 Budget for the City of Columbus: City Administrator Ellefson presented a power point high-lighting the budget process and City Administrator Ellefson presented 2023 Budget: overall general fund increase of $35,826 and maintained or increased commitments to: EMS, Police, Fire; road maintenance, sidewalk repair/replacement, tree removals, stormwater repair & maintenance, pavilion maintenance, historic preservation. Planning/Zoning has moved to general fund, contingency funds increased. General wage increase is proposed at 3.5%, health insurance increased 10%, garbage/recycling fees increase to $194 annually, EMS Group increased 3%, Municipal Court will be funded for partial year and eliminated in 2024. Capital Projects include City Hall roof, Folsom Street reconstruction, DPW mini-dump truck, 72" mower, and annual payment to CWL for bucket truck; Fire Dept engine & pickup truck; sidewalks. 4. Presentation of Stormwater Report – Ruekert Mielke: City Engineer Lietha presented a summary of the stormwater report Ruekert Mielke conducted. It is a very comprehensive study throughout the entire city with 94 projects identified and needing assessment, with the highest targeted areas costing approximately $5.5m. A suggestion to create a committee with businesses, residents, staff, to review the report and make recommendations and look for funding in grants or other resources. Other suggestions to go back to referendum. Concerns there is no plan in place for referendum and which projects to start with and how it would be paid for. Need to review the ordinance and have a plan in place before a committee is started. Education is a big step. Should have a plan in place when the report is released and examples of ordinances to work with. Ellefson said he could have potential funding resources report ready by February. 7. Discuss Hwy 73 Plat Signing Authority: Past practice is the clerk have signing authority. Forward to December 6 Regular meeting. 8. Discuss Pool Rates 2023: Based on the wage assessment report to bring targeted wages to a minimum, there is a shortfall in the pool budget. Discussions with Pool Manager revealed he thought he could make up the difference without rate increases. Council would like to see a report with different rate increases vs possible additional classes offered. Return to December 6 COW. 9. Discuss ATV/UTV Ordinance: Motiff suggested section 93-138 be changed to allow for city services, not recreation use; Albright suggested the sunset clause was a compromise and it no longer necessary; Atty Johnson stated the shortened version of the ordinance mirrors state law and the ordinance would not have to change when law does but does not mirror surrounding communities as they are all different. Gray suggested sending back to referendum in 2024 and the sunset would be May 1 to review. Steiner stated the back and forth is waste of time – was sent to referendum, residents voted, stop wasting time. Consensus to send back to referendum for 2024. Forward updated ordinance to December 6 Regular meeting. 10. Nutrition Site 2023 MOU – Columbia County: Only change to the MOU from previous years is they are paying nearly double the rent for the facility. Forward to December 6 Regular meeting. 11. Discuss re-naming Columbus Area Senior Center: Discussion to rename the Columbus Area Senior Center to the Columbus Community Center and rename the Community Center to the 161 Building. The preliminary project timeframe is between 2025-2028. Because this segment is considered a connecting highway, the WisDOT will be acquiring the right of way needed for the project on behalf of the City of Columbus. Someone from the City of Columbus will need to sign the plat sheets. During previous projects, the City Clerk signed the plat sheets, and staff recommend a similar arrangement for this project. Article XII – All-Terrain Vehicles and Utility-Terrain Vehicles is created to now read as follows: Sec. 98-316. – Definitions. (a) “Roadway” means that portion of a highway within the jurisdictional limits of the City of Columbus between the regularly established curb lines or that portion which is improved, designed or ordinarily used for vehicular travel, excluding the berm or shoulder. On a divided highway, the term “roadway” refers to each roadway separately but not to all such roadways collectively. Sec. 98-317. – Operation on or Near Roadways. (a) The City of Columbus Common Council hereby authorizes all roadways under its jurisdiction with a speed limit of 35 mph or lower as the route for All-Terrain Vehicles (ATV) and Utility-Terrain Vehicles (UTV). (b) The ATV/UTV route may be altered, amended or terminated by future motion of the City Council. (c) The provisions of Section 23.33 of the Wisconsin Statutes as amended from time to time are adopted as the law of the City of Columbus and incorporated herein by reference. (d) This Section shall remain in effect until May 1, 2024.  Sec. 98-318. – Municipal Use of All-Terrain Vehicles and Utility Terrain Vehicles. (a) Employees and agents of the City of Columbus shall be allowed to operate an ATV or UTV for municipal work or services on all roadways and within all parks and public spaces. 2. Severability. If any portion of this Ordinance or its application on any person or circumstances is held invalid, the validity of this Ordinance as a whole or any other provision herein or its application shall not be affected. 3. Effective Date. This Ordinance shall take effect upon proper signage for all streets constituting the routes being acquired and properly posted as required by law. Municipal Court Committee. Composition. The Municipal Court Committee shall be comprised of one representative of each Member Municipality that chooses to appoint a voting representative to the committee who shall be appointed by the Mayor, President or Chairman of the Member Municipality, subject to confirmation by the respective governing body. The Chairman of the Committee will be a representative from a member municipality and will rotate on an annual basis, alphabetically, starting with the representative from Rio for 2019. If a representative cannot fulfill or chooses not to fulfill the obligation of committee chairperson for any reason, then the position of Chairperson goes to the next municipality, alphabetically. 3. Creation and Qualification of the Position of Municipal Judge. Pursuant to Chapter 755, Wisconsin Statutes, the office of Municipal Judge is hereby created. Eligibility for the office of Municipal Judge shall be as follows: To be eligible for the office of Municipal Judge a person must be a qualified elector in the Village 1  of Cambria, or the Village of Fall River, or the City of Columbus, or the City of Lodi, or the Village of Pardeeville, or the Village of Poynette, or the Village of Randolph, or the Village of Rio, or the Town of Columbus, or the Town of Dekorra or the Town of Lodi, or the Village of Arlington, or the Village of Friesland, or the Village of Wyocena 4. Election and Term of Municipal Judge. The appointed Judge must run for the election at large the following spring election, for a four (4) year term, commencing on May 1st succeeding his or her election. Electors of the Village of Cambria, the Village of Fall River, the City of Columbus, the City of Lodi, the Village of Pardeeville, the Village of Poynette, the Village of Randolph, the Village of Rio, the Town of Columbus, the Town of Dekorra, the Town of Lodi, the Village of Arlington, the Village of Friesland, and the Village of Wyocena shall be eligible to vote for the Municipal Judge of the Joint Municipal Court. 5. Creation of the Position of Clerk of the Municipal Court. Pursuant to Chapter 755, Wisconsin Statutes, the office of the Clerk of the Municipal Court is hereby created. Said Clerk shall take the position upon Hire by the Municipal Court Committee and written Appointment by the Judge. Training and compensation of said Clerk shall be as determined by the governing bodies of member municipalities. 6. Salary of Municipal Judge. The Municipal Judge shall receive a fixed salary and Municipal Judge’s training pursuant to Section 755.18, Wisconsin Statutes, the salary to be determined by the governing bodies of member municipalities, subject to Section 755.04, Wisconsin Statutes, which shall be in lieu of fees and costs. The salary shall be paid quarterly. No salary shall be paid to the Municipal Judge for any time during his or her term for which he or she has not executed and filed the official bond and oath as required by subsection (7) of this section. 7. Bond and Oath of Municipal Judge. The Municipal Judge shall, after election or appointment to fill a vacancy, take and file the Official Oath as prescribed in Section 757.02(1), Wisconsin Statutes, pursuant to Section 755.03 Wisconsin Statutes, with the Clerk of Circuit Court for Columbia County, and at the same time shall execute and file an official bond. 8. Bond and Oath of Municipal Court Clerk. The Municipal Court Clerk shall, before entering upon the duties of the office, take and file the official oath as prescribed in Section 19.01 Wis. Stats., with the City Clerk of the City of Columbus and at the same time, shall execute and file an official bond. The Columbus City clerk will provide file copies to the other seven communities. 9. Jurisdiction of Municipal Judge. The Municipal Judge shall have jurisdiction as provided by the Statutes and Laws of the State of Wisconsin and pursuant to Section 755.045, Wis. Stats. 2 10. Procedures of Joint Municipal Court. (a) The Joint Municipal Court’s location and time be determined by order of the Municipal Judge. (b) The procedure in Joint Municipal Court shall be provided by the Statutes and Laws of Wisconsin. (c) The Court Clerk or his/her designee shall make daily deposits of all forfeitures, fees, penalties, assessments and costs collected in any action or proceeding before the Joint Municipal Court. These deposits will be made to a designated bank account as determined by the Joint Municipal Court Committee. 11. Contempt in Joint Municipal Court. The Municipal Judge may impose a sanction as authorized under Section 800.12(2) Wis. Stats., for Contempt of Court as defined in Section 785.01(1), Wis. Stats., in accordance with the procedures under Section 785.03, Wis. Stats. SECTION 2. All ordinances or parts of ordinances contravening or inconsistent with the provisions of this ordinance be and are hereby repealed. SECTION 3. Each City or Village shall enter into agreement for the operation of the Municipal Court, with the other Municipalities upon mutually agreeable terms. SECTION 4. This ordinance shall take effect and be in full force and effect from and after its passage by all municipalities and publication as required by law. The City agrees to permit the use of the Senior Center Building and facilities located at 125 North Dickason Blvd in the City of Columbus for the conduct of a Senior Nutrition Program. These facilities include the kitchen and the non-exclusive use of the dining room area with table and chairs along with the restrooms. These facilities will be made available to the Program between the hours of 9:00 am and 1:00 pm for the serving of an 11:30 meal Monday through Friday of each week. The Program agrees to have a paid or volunteer Site Manager present during the serving of all meals. During the Program’s use of the building and facilities the City shall have the ability to use the same building and facilities provided the City’s use of the building and facilities does not interfere with the Program’s use of the same facilities. 2. The City will provide the Program with working appliances, electricity, heat, hot water, pest control, snow/ice removal and adequate restroom facilities. The parking lot of the Senior Center is a public parking lot and is available to the program for use. 3. The Program agrees to clean the kitchen and adjoining facilities after each use, including, but not limited to: wiping down all counter tops, cupboards, and tables daily prior to leaving the facility, disposing of all garbage and placing all trash from the Program in securely tied plastic bags and removing them from the building site. 4. The City will ensure that the area used for Meal Sites will be clean, with no garbage sitting out during the Senior Nutrition Meal times. If the space used by the Program is also used by other parties, the Program equipment should not be used including the steam table, coffee maker, silverware, etc. except upon written agreement between the Program and the other party. 5. The Program does not wish to cause any unreasonable or unnecessary loss or financial burden to the City, and therefore agrees to compensate the City for City owned equipment lost, broken, or damaged due to the negligence of agents of the Program, exclusive of maintenance or repairs resulting from ordinary use. 6. This MOU may be terminated by either party by providing a forty-five (45) day advance written notice. Any change or alteration to said MOU must be in writing and approved by both Parties. 7. This MOU is effective January 1, 2023 through December 31, 2023. The Program agrees to pay a consideration of $40 per week, not to exceed $2,080.00 annually. 8. This MOU binds each Party to secure and maintain policies of fire and extended coverage and liability insurance in amounts adequate to insure their interests in all properties located at the described location (please attach a copy of said policies). 9. The Parties agree that any additional equipment installation or deviation from routine room use by the Program will be done only with written consent of City Senior Center Director or City Administrator. 10. If painting, remodeling, or repair work will be done by the City during the Program hours, the City shall provide the Program with a 72 hour notice to allow for other arrangements to be made, if necessary. When area schools are cancelled due to weather, meal sites will also be closed and no meals will be provided that day. 14. The City will provide the Program with adequate secure space for a locked file cabinet that only Program staff have access to and adequate space for storage of equipment and supplies. 15. The Program will be in charge of ordering meals to ensure that there will be no over-ordering of meals and ensure that the meals ordered from the caterer match the reservation sheet counts. 16. The Program staff and the City staff will actively coordinate to invite diners to participate in scheduled programs. Activities promoted to diners should most often be those that are free of any charges and would not interrupt diners while they are actually eating their lunches. 17. The first and third Mondays of each month no congregate meals will be served and only home delivered meals will occur. The kitchen will still be available for use by the Program for the preparation of home delivered meals. Furthermore, the City may have up to seven additional non-consecutive days each year where no congregate meals will be served and only home delivered meals will be prepared. The City shall provide at least 30 days advance notice when no congregate meals are able to be served. 18. When the Senior Center building is in use for voting, the Program is allowed to use the Columbus Community Center, across the parking lot for services that day. The consensus was that the current Senior Center would become the Columbus Community Center, and the current Community Center will be known as the 161 Building, which reflects the building address, but also creates an identity that isn’t tied to any one type of use. Staff believe that there may be circumstances in the future that may shift staff locations, so placing more general names on the buildings should serve us well in the long run. These changes better reflect the uses of these buildings, and give flexibility for the building at 161 N Dickason to be utilized in different ways without having to change the name.
