Government 101 presented by the League of Municipalities. Would like to recognize the passing of 2
of our dedicated firefighters recently – Earl Steinhorst and Fred Dartt. Thank you to the crossing guards
for keeping our kids safe during the school year.

FOG issues such as floating grease balls and grease in the clarifiers coming from both influent
wastewater, but amplified by hauled wastes. Due to greasy foam on the aeration tank we
paused some hauled waste in March 2022. We resumed paused haulers in January 2023.

rapid snow melt or combination thereof. The I/I in 2022 increased due to an increase of

DETAILED DESCRIPTION OF SUBJECT MATTER:
The Beautification Committee has been working with the Columbus school district to
come up with a logo for the new banners to be installed in the downtown area. One
former student came up with a Charlie Cardinal logo and is allowing the City /
Beautification Committee to use the logo for the new banners. The school district will be
donating funds to the Committee to help offset the cost. Paula Steiner, Chair of the
Beautification Committee, will attend the meeting to answer any questions.

Several Alders requested discussion of recognizing Pride Month, or LGBTQIA+ Month
and to raise the pride flag for this month of June as well as all future months of June.

ACTION REQUESTED OF COUNCIL:
Consider the recommendation of the Alders to recognize Pride Month or LGBTQIA+ Month
and to raise the pride flag for this month of June as well as all future months of June.
Resolution of Support of LGBTQ+ Pride Month
Whereas, the Common Council of the City of Columbus, Wisconsin welcomes and encourages
diversity and inclusion in our community; and
Whereas, June 28th, 2023 marks the 54th anniversary of the Stonewall Uprising in New York City,
which sparked the gay rights movement, and June is the nationwide month to recognize the
LQBTQ+ community; and
Whereas, celebrating pride month raises awareness and provides support and advocacy for the
LGBTQ+ community, and is an opportunity to become educated, engaged in dialogue, strengthen
alliances, and build understanding; and
Whereas, while there has been remarkable progress toward acceptance and equality, members of
the LGBTQ+ community continue to face discrimination, intolerance, and hate; and
Whereas, we must commit to supporting and accepting LGBTQ+ individuals, in particular our
youth, who compared to their peers, are far more likely to experience violence and bullying at
school; to suffer from depression; to struggle with substance use; and to have attempted suicide;
and
Whereas, we must remain vigilant in deterring oppression and discrimination against people on
the basis of sex, gender identity or expression, or sexual orientation; and
Whereas, by protecting the rights of every individual, we enhance and strengthen the value of
everyone throughout our society; and
Whereas, we affirm our support for LGBTQ+ residents in our community, and stand with them to
protect their civil rights and their ability to live openly, equally, and without fear; and
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Columbus, Wisconsin
on this the 6th day of June, 2023 that the Common Council recognizes and supports this month of
June as well as all future months of June as LGBTQ+ pride month, and shall fly the Progress Pride
Flag at the intersection of James Street and Dickason Boulevard near the memorial statue, and we
urge all residents to celebrate and build a culture of inclusion and acceptance during this month
and every month.
TERMINATION OF AGREEMENT AND MUTUAL RELEASE
This Agreement made by and between Nasco Education LLC (hereinafter
“Nasco”), and the City of Columbus, Wisconsin, a Municipal Corporation (hereinafter
“Columbus”).
WHEREAS, Nasco is a WPDES Permit holder that discharges to the City of Fort
Atkinson storm sewer that in turn discharges to the Rock River; and
WHEREAS, Columbus is a WPDES Permit holder in the Nolan Creek-Crawfish
River watershed, upstream of the Nasco outfall; and
WHEREAS, Columbus and Nasco, by contract executed by Nasco on August 28,
2018, and by Columbus on August 30, 2018 (hereinafter the “Contract”), agreed that
Columbus will generate and sell total phosphorus credits to Nasco and those credits
generated and purchased were to be used so that Nasco can achieve compliance with its
WPDES Permit; and
WHEREAS, the Contract between Columbus and Nasco was to expire in January
2031; and
WHEREAS, Nasco has informed Columbus that it no longer needs credits from
Columbus to comply with its WPDES Permit, and pursuant to section 4.2 of the Contract
Nasco and Columbus now agree to mutually terminate the Contract between the parties
under the terms and conditions set forth in this Agreement.
NOW, THEREFORE, it is mutually understood and agreed as follows:
In consideration of the mutual relinquishment of the respective legal rights with
reference to the above-mentioned Contract between Nasco and Columbus, in
consideration of this Mutual Release, in consideration of Nasco paying to Columbus the
sum of $15,000.00, in one lump sum contemporaneous with the approval of this
Agreement by Nasco and Columbus, Nasco and Columbus agree to mutually terminate
the Contract effective immediately, each party expressly releases the other, and each
other’s successors, assigns and legal representatives, from all sums of money, accounts,
actions, claims and demands (whether in law or equity, whether joint or several, whether
now known or unknown, and whether now anticipated or unanticipated), arising out of
the Contract.
Columbus and Nasco each represents and warrants that it is the sole owner of all
demands, rights, causes of action and other matters which are released herein; that the
same have not been transferred or assigned or caused to be transferred or assigned to any
other person, firm, corporation or other legal entity; that Columbus and Nasco each has
obtained all approvals necessary to enter into this Agreement; and that Columbus and
Nasco each has the full right and power to grant, execute, and deliver the releases,
undertakings and agreements contained herein.
Each of the undersigned further declares and represents that no promise,
inducement or agreement, not herein expressed, has been made to any of the undersigned,
and that this Mutual Release contains the entire agreement between the parties hereto,
and that the terms of this Mutual Release are contractual and not mere recital.
The settlement and release made and effected hereby is a compromise settlement
by each of the parties. The execution of this Mutual Release shall not be construed as an
admission of liability by any party.
Each of the undersigned states that they have read the foregoing Mutual Release
and fully understand it, that each of them knows the contents thereof, that each of them
has discussed the terms of the settlement with its client, and the client has authorized
counsel to sign this Mutual Release.
This Mutual release shall be applicable to all services provided pursuant to the
contract between the parties to the present date, and shall be effective as of the date all
parties have signed this document.
