The report is a compilation of all the monthly reports filed by the plant operator. See Wis. Stats. § 125.51(3). Wine may be sold in original packages or otherwise in any quantity to be consumed off the premises. (5) Operator's license. a. See Wis. Stats. § 125.17. b. The clerk or deputy clerk of the city may issue a provisional operator's license to a person who is enrolled in a responsible beverage server trainer course required for applicants for operator's licenses by Wis. Stats. § 125.17(6) or have completed the training course within the last two years or have held an operator license anywhere in the state within the last two years. The provisional license may only be issued to a person who has applied for an operator's license under this subsection. A provisional license may not be issued to any person who has been denied an operator's license by the city council under this subsection. A provisional license expires 60 days after its issuance or when a license  under this subsection is issued to the holder, whichever is sooner. The official who issued the provisional license may revoke the license if he discovers that the holder of the license made a false statement on the application. The fee for a provisional license payable to the city shall be as provided in section 22-32. A written statement must be provided by a sponsor, who must have an alcohol license issued under Wis. Stat. Chap. 125, indicating that the sponsor has known the applicant, that the applicant has a place to work and that the sponsor will reimburse the city for any expenses incurred by the city in the event the city revokes the applicant's provisional operator's license. (Code 1978, § 12.07(3); Ord. No. 553-02, § I(1), 2-19-02; Ord. No. 577-03, 9-16-03) Sec. 6-39. - License restrictions. (a) Violators of liquor or beer laws or ordinances. No retail class A or B license shall be issued to any person who has been convicted of a violation of any federal or state liquor or fermented malt beverage law or the provisions of this article or whose license has been revoked under Wis. Stats. § 125.12 during one year prior to such application. A conviction of a member of a partnership or the partnership itself shall make the partnership or any member thereof ineligible for such license for one year. (b) Health and sanitation requirements. No retail class "B" or "class B" license shall be issued for any premises that does not conform to the sanitary, safety and health requirements of the state department of industry, labor and human relations pertaining to buildings and plumbing, to the rules and regulations of the state department of health and social services applicable to restaurants and to all such ordinances and regulations adopted by the city council. (c) Delinquent taxes, assessments and claims. No license shall be granted for any premises for which taxes, assessments or other claims of the city are delinquent and unpaid, or to any person delinquent in payment of such claims, including unpaid forfeiture judgments, to the city. (d) Reserved. (e) Issuance for sales in dwellings prohibited. No license shall be issued to any person for the purpose of possessing, selling or offering for sale any alcoholic beverages in any dwelling house, flat or residential apartment. (Code 1978, § 12.07(5)(c), (d), (i)—(k); Ord. No. 689-13, § 1, 6-18-13) Sec. 6-40. - Safety and sanitation requirements. (a) Application. Application for a license pursuant to this chapter shall be made to the city clerk. The city clerk shall notify the City of Columbus Police Department, the chief of the fire department that has jurisdiction over the city, and the city building inspector of the license application. These investigating officials shall inspect the premises for which the license is being requested and shall submit written reports and recommendations to the city council prior to the council's review of the application. By submitting an application for a license pursuant to this chapter, the applicant is consenting to the police department, fire department and building inspector conducting an inspection of the premises for which the license is requested. (b) Each licensed premises shall be maintained and conducted in a sanitary manner and shall be a safe and proper place for the purpose for which used. (Code 1978, § 12.07(5)(d); Ord. No. 676-12, § 1, 5-9-12) Sec. 6-41. - Form and expiration of licenses.  All licenses shall be numbered in the order in which they are issued and shall state clearly the specific premises for which granted, the date of issuance, the fee paid and the name of the licensee and, unless sooner revoked, shall expire on June 30 thereafter except as otherwise provided by law. The city clerk shall affix his or her affidavit as required by Wis. Stats. § 125.04(4). (Code 1978, § 12.07(6)) Sec. 6-42. - Transfer of licenses. (a) As to person. No licenses shall be transferable as to licensee except as provided by Wis. Stats. § 125.04(12). (b) As to place. Licenses issued pursuant to this article may be transferred to another premises once during any license year as provided in Wis. Stats. 125.04(12). No person shall post such license or permit any other person to post it upon premises other than those mentioned in the application, or knowingly deface or destroy such license. (Code 1978, § 12.07(7)) Sec. 6-43. - Posting and care of licenses. Every license or permit required under this article shall be framed and posted and at all times displayed as provided in Wis. Stats. 125.04(10). No person shall post such license or permit any other person to post it upon premises other than those mentioned in the application, or knowingly deface or destroy such license. (Code 1978, § 12.07(8)) Sec. 6-44. - Regulation of licensed premises and licensees. (a) Gambling and disorderly conduct prohibited. Each licensed and permitted premises shall at all times be conducted in an orderly manner; and no disorderly, riotous or indecent conduct or gambling shall be allowed at any time on any such premises. (b) Employment of underage persons. No licensee shall employ any person who does not have a valid operator's license to serve, sell, dispense or give away any alcoholic beverage. (c) Sales by clubs. No club shall sell intoxicating liquors or fermented malt beverages except to members and guests invited by members. (d) Safety and sanitation requirements. Each licensed premises shall be maintained and conducted in a sanitary manner and shall be a safe and proper place for the purpose for which used. (e) Minimum license use requirement. A licensee shall be open for business with adequate stock and equipment for at least 125 days during the term of the license. In the event that a licensee is not open for business for at least 125 days during the license period, or the premises is closed or not operating for any period of 90 consecutive days or more, the common council may commence an action for suspension, revocation or non-renewal of the licensee's license pursuant to Wis. Stats. § 125.12. In deciding to suspend, revoke or non-renew the license, the common council may consider such factors as: Damage to the premises rendering it temporarily unfit for safe operation under the license; closing for reasonable periods to alter, repair, remodel or redecorate the premises; seasonal operation of the licensed business; acquisition of licenses by commercial lenders incidental to a foreclosure proceeding or deed in lieu of foreclosure; or any other closing for periods beyond that permitted by this section due to unusual circumstances not under the control of the licensee. (Code 1978, § 12.07(9); Ord. No. 648-09, § 1, 1-5-10; Ord. No. 725-15 , § 1, 1-8-16) Sec. 6-45. - Closing hours. No premises for which an alcohol beverage license has been issued shall remain open for the sale of alcoholic beverages: (1) If a wholesale license, between 5:00 p.m. and 8:00 a.m., except on Saturday when the closing hour shall be 9:00 p.m. (2) If a retail "class A" license, between 9:00 p.m. and 8:00 a.m. (3) If a retail "class B" license, between 2:00 a.m. and 6:00 a.m. on weekdays and between 2:30 a.m. and 6:00 a.m. on Saturdays and Sundays. On January 1, premises operating under a class B license are not required to close. No package, container or bottle sales may be made after midnight. (4) Hotels and restaurants, the principal business of which is the furnishing of food or lodging to patrons, bowling alleys, indoor horseshoe pitching facilities, curling clubs, golf courses and golf clubhouses may remain open for the conduct of their regular business but no intoxicating liquors or fermented malt beverages shall be sold during prohibited hours. (Code 1978, § 12.07(10)) Sec. 6-46. - Revocation and suspension of licenses. (a) Procedure. Whenever the holder of any license under this article violates any portion of this article, proceedings for the revocation or suspension of such license may be instituted in the manner and under the procedure established by Wis. Stats. § 125.12, and the provisions therein relating to granting a new license shall likewise be applicable. (b) Effect of revocation. Twelve months shall elapse before another license shall be granted to the person whose license was revoked. (Code 1978, § 12.07(11)) Sec. 6-47. - Nonrenewal of licenses. Before renewal of any license issued under this article is refused, the licensee shall be given written notice of any charges or violations against him or the reasons proposed for nonrenewal and a copy of any proposed motion for nonrenewal and shall have an opportunity to be heard before the city council. (Code 1978, § 12.07(12)) Sec. 6-48. - Violations by agents and employees. A violation of this article by an authorized agent or employee of a licensee shall constitute a violation by the licensee.
