Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Pro Tem Bullock on November 3, 2014, at 6:00 pm. A motion was made by Councilman McEldowney, seconded by Councilman Amador, to excuse Mayor Ford from the meeting. VOTE: 7 aye, 2 absent (Benson, Ford) Present: 7 - Council Member Rick A. Executive Session 14-63 An executive session C.R.S. 24-6-402(4)(b) for the purpose of receiving legal advice regarding recreational marijuana. A motion was made by Council Member McEldowney, seconded by Council Member Amador, that an executive session, pursuant to C.R.S. 24-6-402(4)(b) for the purpose of receiving legal advice regarding recreational marijuana be held. Proclamations and Recognitions A motion was made by Councilman Teter, seconded by Councilman McEldowney, to amend the agenda to move the Senior Advisory Committee Bi-Annual Presentation item to be heard under proclamations and recognitions. VOTE: 8 aye, 1 excused (Ford) 14-58 Recognition of Red Sweater Award Winners Recreation Supervisor Tripp introduced George Maxey and Gwen WIlson as this year's Red Sweater Award winners. Mr. Tripp explained why both senior volunteers were chosen as award recipients. 14-59 Recognition of Colorado Parks and Recreation Association's Columbine Award for Renovated Park Design for Fairfax Park Colorado Parks and Recreation Association Award Chair Rachel Wysaph addressed council and presented the city with the Columbine Award for renovated park design for Fairfax Park. 6. Approval of Minutes A motion was made by Councilman Teter, seconded by Councilman McEldowney to allow Council members Amador and Benson to abstain from voting on the minutes of September 15, 2014, because of their excused absence. Ord 2031 AN ORDINANCE AMENDING THE 2014 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE TONY GRAMPSAS YOUTH SERVICES GRANT FUNDS IN THE AMOUNT OF $79,119 FOR THE SUPPORT OF YOUTH MARIJUANA USE PREVENTION AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF. Ord 2033 AN ORDINANCE REPEALING ORDINANCE 1945 TO REMOVE FROM THE 2013 BUDGET OF THE CITY OF COMMERCE CITY THE RECOGNITION OF THE RTD BUS ROUTE GRANT FUNDS IN THE AMOUNT OF $444,000 FOR THE SUPPORT OF A NORTH AREA EXPRESS BUS ROUTE Z-910-14 AN ORDINANCE REZONING THE PROPERTY LOCATED AT 6001 DEXTER STREET, COMMERCE CITY, COLORADO, AND AMENDING THE ZONING MAP OF THE CITY OF COMMERCE CITY, COLORADO TO REFLECT SAID REZONING. 9. Public Hearings Res 2014-40 RESOLUTION ADOPTING THE 2015 BUDGET AND CERTIFICATION OF THE MILL LEVY FOR THE CITY OF COMMERCE CITY. Mayor Pro Tem Bullock re-opened the public hearing continued from October 20, 2014. Interim Finance Director Carstens highlighted the following items that were questioned during the last public hearing: recreation center expanded hours, Buffalo Run Golf Course WiFi and the Dahlia Street Trailhead. No one from the audience came forward to address council on the budget. Mayor Pro Tem Bullock closed the public hearing. A motion was made by Council Member McEldowney, seconded by Council Member Elliott, that this resolution be adopted. Presentations Pres 14-709 Capital Program Update Program Director Scott Hergenrader addressed council. Mr Hergenrader gave a program task update that included:completion of a two-day project manager training, program templates being created and ground breaking for the outdoor pool. There have been a number of procurements to date and the Fronterra Park groundbeaking is set for December 4, 2014. Pres 14-711 2014 3rd Quarter Update City Manager McBroom provided council with an update of the daily activities during the 3rd quarter of 2014. The work plans are divided into two key documents: operations and projects. Department highlights include: building permits have increased by 20%, 24 tournaments were hosted by Buffalo Run Golf Course, there was a 7.3% reduction in DUI arrests and there have been 31 employees hired. Pres 14-901 Senior Advisory Committee Bi-Annual Presentation Recreation Supervisor Derrick Tripp announced that the senior advisory committee is comprised of four subcommittees: program, outreach, umbrella and health and wellness. During 2014, 20 seats were filled on the committee, and 14 action items were completed. Thelma Cole, Sandy Carruthers, Beth Scott and George Maxey spoke about the accomplishments of each subcommittee. This Presentation was discussed and closed 11. Administrative Council Business City Manager McBroom stated that the city has offered to jointly sign a letter of support for the current alternative I-70 alignment that CDOT is pursuing. A motion was made by Councilman McEldowney, seconded by Councilman Amador, to authorize Mayor Ford to sign a letter on behalf of Commerce City to Senator Matt Jones regarding the I-70 alignment. VOTE: 8 ayes, 1 excused (Ford) A motion was made by Councilman McEldowney, seconded by Councilman Amador, to authorize staff to review the requirements necessary to support the licensing and regulation of the sale and growing of recreational marijuana in Commerce City. VOTE: 8 ayes, 1 excused (Ford) A motion was made by Councilwoman Elliott, seconded by Councilwoman Carson, to move any possible executive session on December 15, 2014, to the end of the meeting to allow time at the beginning of the meeting to honor Cultural Council Art Award Recipients. Commerce City Page 4 City Council Meeting Minutes - Final November 3, 2014 VOTE: 8 aye, 1 excused (Ford) Councilman Douglas asked about the city providing some financial sponsorship for Adams City and Prairie View High School golf teams. Council agreed to take the matter up at their next business meeting allowing each member time to learn more about the request. Councilman McEldowney spoke about a sinkhole in one of the metro districts that the community residents thought was an event the city had control over. Coiuncilman Amador asked that the Council Retreat Planning Subcommittee meeting be placed on his calendar. 12. Reports Council was provided with a briefing of a recent staff and council representative trip to Chicago to tour mixed-use development projects as the city moves forward with the development of the Mile High Greyhound Park site. 13. Adjourn to NIGID Meeting The meeting adjourned at 9:20 pm. In accord with the city charter, the city attorney read the title to all ordinances and resolutions adopted by Council at this meeting.
