Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Ford on December 1, 2014, at 6:00 PM. Present: 8 - Mayor Sean Ford , Council Member Jim Benson, Council Member Rick A. Teter, Council Member Crystal Elliott, Council Member Steven J. Douglas, Council Member Andrew Amador, Council Member Jadie Carson and Mayor Pro Tem René Bullock Absent: 1 - Council Member Jason McEldowney 2. Executive Session A motion was made by Mayor Pro Tem Bullock, seconded by Council Member Amador, that an executive session be held pursuant to CRS 24-6-402(4)(e) for the purpose of instructing negotiators regarding the bridges at First Creek and regarding DIA issues. VOTE: Aye: 8- Mayor Ford, Council Member Benson, Council Member Teter, Council Member Elliott, Council Member Douglas, Council Member Amador, Council Member Carson and Mayor Pro Tem Bullock 14-70 An executive session C.R.S. 24-6-402(4)(e) for the purpose of instructing negotiators regarding the Bridges at First Creek 14-71 An executive session C.R.S. 24-6-402(4)(e) for the purpose of instructing negotiators regarding DIA issues. 3. Pledge of Allegiance The Pledge of Allegiance was recited. Present: 9 - Mayor Sean Ford , Council Member Jim Benson, Council Member Rick A. Approval of Minutes Min 14-204 Special Meeting Minutes of September 8, 2014 A motion was made by Councilman McEldowney, seconded by Mayor Pro Tem Bullock to allow Councilman Douglas to abstain from voting on the minutes of September 6, 2014, because of his excused absence. ROLL CALL VOTE: 8 aye, 1 abstain (Douglas) A motion was made by Mayor Pro Tem Bullock, seconded by Council Member McEldowney, that the minutes be approved. VOTE: Aye: 8- Mayor Ford, Council Member Benson, Council Member Teter, Council Member Elliott, Council Member Amador, Council Member Carson, Council Member McEldowney and Mayor Pro Tem Bullock Abstained: 1- Council Member Douglas 7. Consent Agenda A motion was made by Council Member McEldowney, seconded by Mayor Pro Tem Bullock, to approve the consent agenda as presented. ROLL CALL VOTE: Aye: 9- Mayor Ford, Council Member Benson, Council Member Teter, Council Member Elliott, Council Member Douglas, Council Member Amador, Council Member Carson, Council Member McEldowney and Mayor Pro Tem Bullock Res 2014-98 A RESOLUTION APPROVING THE 2015 CITY OF COMMERCE LEGISLATIVE PRINCIPLES Res 2014-116 RESOLUTION REGARDING POSTING LOCATIONS FOR ORDINANCES AND PUBLIC MEETINGS 8. Public Hearings CU-107-14 CONDITIONAL USE PERMIT FOR THE OPERATION OF AN ALUMINUM RECYCLING FACILITY Mayor Ford opened the public hearing. Planner Caitlin Hasenbalg-Long testified that the applicant, Platte Valley Aluminum, is applying for a conditional use permit to operate an aluminum recycling facility. As part of the operation, there will be an aluminum sweat furnace onsite to melt scrap cast aluminum into ingots for sale back to cast aluminum producers. The planning commission held a public hearing on this case and voted unanimously to forward the case to council with a favorable recommendation. Audience Input: Guillermo Serna, 14122 E. 102nd Pl. Steve Johnston appeared on behalf of the applicant. He stated that the recycled Commerce City Page 2 City Council Meeting Minutes - Final December 1, 2014 materials are shipped to the midwest for reuse in automobile construction. Mayor Ford closed the public hearing. A motion was made by Councilman McEldowney, seconded by Mayor Pro Tem Bullock to accept the findings and recommendations of the planning commission. VOICE VOTE: Unanimous; all present affirmed A motion was made by Council Member Benson, seconded by Council Member McEldowney, that Conditional Use Permit #CU-107-14 be adopted. VOICE VOTE: Unanimous, all present affirmed. 9. Resolutions Res 2014-109 RESOLUTION REGARDING THE NAMING OF THE OUTDOOR LEISURE POOL AT PIONEER PARK Recreation Manager Karen O'Donnell gave a presentation to council. She stated that the Parks, Recreation and Golf Advisory Committee met in August and decided to hold a naming contest with submittals from the community. Out of 270 entries, Pair-O-Dice was the chosen winner; however, it was changed to Paradice Island based on council input. A motion was made by Mayor Pro Tem Bullock, seconded by Council Member Douglas, that this resolution be adopted. VOTE: Aye: 8- Mayor Ford, Council Member Benson, Council Member Teter, Council Member Elliott, Council Member Douglas, Council Member Amador, Council Member Carson and Mayor Pro Tem Bullock Nay: 1- Council Member McEldowney 10. Administrative Council Business A motion was made by Councillman McEldowney, seconded by Councilman Amador, to set the date for council's winter retreat as January 23-24, 2015, and hire a facilitator. After a brief discussion, the motion was changed to set the date only and not hire a facilitator at this time VOICE VOTE: Unanimous; all present affirmed A motion was made by Councilman McEldowney, seconded by Councilman Amador, to cancel the study sessions of December 22 and 29, 2014. VOICE VOTE: 8 aye, 1 nay (Bullock) 11. Reports City Manager McBroom highlighted items from his weekly report sent to council vial email earlier in the meeting.
