Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Ford on December, 15, 2014, at 6:07 PM. Present: 9 - Mayor Sean Ford , Council Member Jim Benson, Council Member Rick A. Teter, Council Member Crystal Elliott, Council Member Steven J. Douglas, Council Member Andrew Amador, Council Member Jadie Carson, Council Member Jason McEldowney and Mayor Pro Tem René Bullock 2. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Audience Introduction City Attorney Gehler introduced Senior Assistant City Attorney Robert Sheesley The audience introduced themselves. 4. Proclamations and Recognitions 14-64 Recognition of Cultural Council Art Show award winners Heidi McNeeley with the Commerce City Cultural Council announced the winners of the art show. 5. Citizen Communication Metro North Chamber Incoming Chair Troy Whitmore encouraged council to continue their membership in the chamber. Kaycee Pearson, a student at Turnberry Elementary, spoke to council regarding traffic safety around her school. 6. Approval of Minutes Min 14-207 Minutes of October 6, 2014 A motion was made by Council Member McEldowney, seconded by Council Member Teter, that the minutes be approved. VOICE VOTE: Unanimous, all present affirmed. VOICE VOTE: Unanimous, all present affirmed. 7. Consent Agenda A motion was made by Council Member McEldowney, seconded by Council Member Amador, to approve the consent agenda as presented. ROLL CALL VOTE: Aye: 9- Mayor Ford, Council Member Benson, Council Member Teter, Council Member Elliott, Council Member Douglas, Council Member Amador, Council Member Carson, Council Member McEldowney and Mayor Pro Tem Bullock Ord 2038 AN ORDINANCE REPEALING PARAGRAPH (E) AND AMENDING PARAGRAPH (F) OF SECTION 12-5005 OF THE COMMERCE CITY REVISED MUNICIPAL CODE PERTAINING TO RESTRICTED AND PROHIBITED SOLICITATIONS Ord 2039 AN ORDINANCE AMENDING THE 2014 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY INCREASING THE ORIGINAL BUDGETED REVENUES IN THE GENERAL FUND BY $9,000,000 FOR THE RECOGNITION OF THE ADDITIONAL 1% SALES TAX INCREASE APPROVED BY VOTERS AND TRANSFERRING $323,000 FROM THE GENERAL FUND TO THE CIPP FUND FOR THE MUNICIPAL SERVICE CENTER (MSC) BUILDING B RENOVATION AND THE EXPENDITURE THEREOF. Res 2014-110 RESOLUTION CONCURRING WITH THE COLORADO DEPARTMENT OF TRANSPORTATION RELATED TO ABANDONMENT OF STATE HIGHWAY 2, RESPONSIBLE ACCELERATION OF MAINTENANCE AND PARTNERSHIPS (RAMP) PROGRAM Res 2014-118 RESOLUTION CANCELLING CITY COUNCIL REGULAR MEETINGS THAT FALL ON OFFICIALLY SCHEDULED CITY HOLIDAYS Res 2014-119 RESOLUTION APPROVING A CONTRACT EXTENSION AND CONTRACT MODIFICATIONS BETWEEN THE CITY OF COMMERCE CITY AND WASTE MANAGEMENT OF COLORADO, INC. FOR RESIDENTIAL GARBAGE AND RECYCLING SERVICES Res 2014-120 RESOLUTION APPROVING THE GRANT OF RIGHT-OF-WAY FOR E 101ST WAY IN BUCKLEY RANCH 8. Ordinances on 1st Reading Ord 2037 AN ORDINANCE ADOPTING THE CITY OF COMMERCE CITY PUBLIC ART FUNDING PROGRAM Commerce City Page 2 City Council Meeting Minutes - Final December 15, 2014 A motion was made by Mayor Pro Tem Bullock, seconded by Council Member McEldowney, that this ordinance be introduced by council as seated and approved on first reading. VOTE: Aye: 9- Mayor Ford, Council Member Benson, Council Member Teter, Council Member Elliott, Council Member Douglas, Council Member Amador, Council Member Carson, Council Member McEldowney and Mayor Pro Tem Bullock Ord 2040 AN ORDINANCE AMENDING THE 2015 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY APPROPRIATING A PORTION OF THE UNENCUMBERED FUND BALANCE OF THE GENERAL FUND IN THE AMOUNT OF $80,000 FOR THE ANNUAL APPROPRIATION TO THE BOYS AND GIRLS CLUBS OF METRO DENVER, INC., AND THE EXPENDITURE THEREOF. A motion was made by Council Member McEldowney, seconded by Mayor Pro Tem Bullock, that this ordinance be introduced by council as seated and approved on first reading. VOTE: Aye: 9- Mayor Ford, Council Member Benson, Council Member Teter, Council Member Elliott, Council Member Douglas, Council Member Amador, Council Member Carson, Council Member McEldowney and Mayor Pro Tem Bullock 9. Executive Session 14-72 An executive session pursuant to C.R.S. 24-6-402(4)(f)(I) for the purpose of reviewing with the city manager part 1 of the city manager’s performance evaluation A motion was made by Mayor Pro Tem Bullock, seconded by Council Member McEldowney, that an executive session be held, pursuant to CRS 24-6-402(4)(f) (I) for the purpose of reviewing with the city manager, part 1 of the city manager's performance evaluation. VOICE VOTE: Unanimous, all present affirmed. 10. Administrative Council Business A motion was made by Councilman Amador, seconded by Mayor Pro Tem Bullock to direct staff to look into reviving a football game between the police department and the community. Councilman Benson said he believed the last game was in 2010. VOICE VOTE: Unanimous; all present affirmed Councilman Douglas stated that while attending the winter festival in Derby, he noticed an excessive amount of speeders driving within the area. He asked that a traffic study, as it relates to speeding, be completed in the Derby area. He also requested that the city look into providing vouchers for the homeless in the city. A motion was made by Councilman Benson, seconded by Councilman McEldowney to direct staff to look into effectively lighting the parking lot at the Buffalo Run Golf Course parking lot, visibility and safety at the intersection of 112th & Chambers and Commerce City Page 3 City Council Meeting Minutes - Final December 15, 2014 including a partition for noise control within the Bison Grill. VOICE VOTE: Unanimous; all present affirmed Councilman McEldowney asked about the city providing some form of legislative assistance to the school districts. Councilwoman Carson would like to have more joint meetings as a council with the school boards. Mayor Ford would like the city to work toward providing insurance to full-time seasonal employees. Mayor Ford asked staff to contact Union Pacific regarding trains blocking 112th again. Deputy City Manager Hayes stated that per council's request, staff researched the cost of the last facilitator hired for a council retreat. That cost was $4,500 that included pre-interviews. A motion was made by Councilman McEldowney, seconded by Councilman Benson to move forward with hiring a facilitator, within a reasonable range of $3,000, for their retreat. VOICE VOTE: Unanimous; all present affirmed Mayor Ford asked that a "thank you" card be sent to Nick's Garden Center for donating 30 trees for the Derby Winter Festival. 11. Reports City Manager McBroom highlighted items from his weekly report emailed to council earlier. Mayor and council reported on their attendance at various meetings and events. 12.
