Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Ford on October 5, 2015, at 6:00 PM. Present: 9 - Mayor Sean Ford , Council Member Jim Benson, Council Member Rick A. Teter, Council Member Crystal Elliott, Council Member Steven J. Douglas, Council Member Andrew Amador, Council Member Jadie Carson, Council Member Jason McEldowney and Mayor Pro Tem René Bullock 2. Executive Session A motion was made by Mayor Pro Tem Bullock, seconded by Council Member McEldowney, to enter into executive session, pursuant to CRS 24-6-402(4)(e) for the purpose of determining positions relative to matters that may be subject to negotiations concerning incentives for several potential economic development projects within the city, and pursuant to CRS 24-6-402(4)(e) for the purpose of instructing negotiations regarding Tower Road right-of-way . VOICE VOTE: Unanimous, all present affirmed. 15-67 An executive session pursuant to C.R.S. 24-6-402(4)(e) for the purpose of determining positions relative to matters that may be subject to negotiations concerning incentives for several potential economic development projects within the city 15-66 An executive session pursuant to C.R.S. 24-6-402(4)(e) for the purpose of instructing negotiators regarding Tower Road right-of-way 3. Proclamations and Recognitions Proc 15-28 Proclamation declaring October as Domestic Violence Awareness Month City Attorney Gehler read a proclamation declaring October as Domestic Violence Awareness Month. A motion was made by Council Member McEldowney, seconded by Council Member Amador, that this proclamation be approved. VOICE VOTE: Unanimous, all present affirmed. Proc 15-30 Proclamation recognizing National Hispanic Heritage Month City Attorney Gehler read a proclamation recognizing National Hispanic Heritage Month. A motion was made by Council Member McEldowney, seconded by Council Member Elliott, that this proclamation be approved. VOICE VOTE: Unanimous, all present affirmed. 6. Citizen Communication Derek Ross, South Adams County Fire District, appeared before council to introduce himself as a liaison to the district. Shirley Henni, 6390 Olive St, addressed council regarding speeding vehicles on East 64th. She asked for red lights around the stop signs on Olive Street. Barry Smith, 12300 Village Circle East, addressed council regarding speeding in his neighborhood and blown out tires left on the roadway He asked for a speed study. School District 27J Superintendent Fiedler appeared before council to present awards to Mayor Ford, Councilwoman Carson, and Councilman McEldowney and to ask for council's support of Resolution 2015-100. 7. Approval of Minutes Min 15-73 Meeting minutes of July 20, 2015 A motion was made by Council Member Carson, seconded by Mayor Pro Tem Bullock, that the minutes be approved. VOICE VOTE: Unanimous, all present affirmed. Min 15-76 Meeting minutes of August 3, 2015 A motion was made by Councilman McEldowney, seconded by Councilman Douglas, to allow Mayor Pro Tem Bullock and Councilwoman Elliott to abstain from voting on the minutes of August 3, 2015, because of their excused absence. VOTE: 7 aye, 2 abstain (Bullock, Elliott) A motion was made by Council Member McEldowney, seconded by Council Member Amador, that the minutes be approved. Consent Agenda Mayor Ford pulled Resolution 2015-102 from the consent agenda for separate discussion and vote. A motion was made by Council Member McEldowney, seconded by Mayor Pro Tem Bullock, to approve the consent agenda as amended. ROLL CALL VOTE: Aye: 9- Mayor Ford, Council Member Benson, Council Member Teter, Council Member Elliott, Council Member Douglas, Council Member Amador, Council Member Carson, Council Member McEldowney and Mayor Pro Tem Bullock Res 2015-79 RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF COMMERCE CITY AND BRANNAN SAND AND GRAVEL COMPANY, LLC FOR 2015 MILL AND OVERLAY PROJECT, PROJECT NO. PM-2015-04 Res 2015-102 RESOLUTION IN SUPPORT OF A VOTE AT THE NOVEMBER 3, 2015 ELECTION IN FAVOR OF THE AMENDMENT TO THE AGREEMENT BETWEEN ADAMS COUNTY AND THE CITY AND COUNTY OF DENVER REGARDING THE DENVER INTERNATIONAL AIRPORT Adams County Commissioner Steve O'Dorisio appeared before council to ask for their support of Resolution 2015-102. A motion was made by Council Member McEldowney, seconded by Council Member Teter, that this resolution be adopted. VOICE VOTE: Unanimous, all present affirmed. 9. Resolutions Res 2015-90 RESOLUTION FINDING SUBSTANTIAL COMPLIANCE OF AN ANNEXATION PETITION AND SETTING A PUBLIC HEARING TO DETERMINE IF THE PROPOSED ANNEXATION COMPLIES WITH STATUTORY REQUIREMENTS FOR SUCH ANNEXATION AN-232-15 A motion was made by Mayor Pro Tem Bullock, seconded by Council Member McEldowney, that this resolution be adopted. VOICE VOTE: Unanimous, all present affirmed. Res 2015-98 RESOLUTION APPROVING ECONOMIC DEVELOPMENT INCENTIVE FOR PETER DEFRIES CORPORATION Economic Development Director Michelle Claymore addressed council regarding this resolution and introduced a representative of Dion's Pizza. The proposed incentive package is valued at approximately $76,400. A motion was made by Council Member Amador, seconded by Council Member McEldowney, that this resolution be adopted. VOICE VOTE: Unanimous, all present affirmed. 10. Ordinances on 1st Reading Ord 2072 ORDINANCE AMENDING CERTAIN PROVISIONS OF THE CITY OF COMMERCE CITY SALES AND USE TAX CODE TO BRING IT INTO COMPLIANCE WITH REQUIREMENTS OF COLORADO LAW A motion was made by Council Member McEldowney, seconded by Mayor Pro Tem Bullock, that this ordinance be introduced by council as seated and approved on first reading. VOTE: Aye: 9- Mayor Ford, Council Member Benson, Council Member Teter, Council Member Elliott, Council Member Douglas, Council Member Amador, Council Member Carson, Council Member McEldowney and Mayor Pro Tem Bullock 11. Presentations Pres 15-387 CCHS Presentation to Council Commerce City Historical Society Representatives Debra Bullock, Esther Hall, Thelma Cole, and Reba Drotar appeared before council to provide an update on events, activities, and goals of the society. Highlights included the creation of an advisory board and the addition of exhibits at various local businesses. Since moving into the Conter Center, 690 visitors have visited the museum. Future goals include having a museum at Victory Crossing, the creation of a city historian position and creating a landmark designation program. 12. Administrative Council Business Councilman Douglas questioned the design of the turn lanes for Lutheran High School, asked about potential access issues for the businesses along State Highway 2, and stated that HOAs near the Arsenal are concerned over prairie dog control. Councilman Amador shared correspondence from Commerce City Youth Athletics regarding tax concerns. Mayor Pro Tem Bullock requested the status of an earlier request for inventory of infill within the historical part of the city. Councilman Teter has received complaints about weeds along the west side of Quebec. 13. Reports City Manager McBroom highlighted items of his weekly report emailed to council earlier.
