Consent Agenda Council Member Douglas asked to remove Resolution 2016-61 from the consent agenda for separate discussion and vote. They discussed extending the contract for one year and then hiring employees to handle these services in-house versus contracting the work out. Interim Director of External Affairs Halstead stated that in 2014, the city went out for a competitive RFP to provide comprehensive public information services for the five-year program. At that time, staff held several study sessions with council about the communication services, with an acknowledgement that likely beyond the intitial five projects, there wouldn't be a significant amount of work at the level of the five-year time period that would necessitate further ongoing activities that may, or may not, be absorbed. Included in the original RFP, were three one-year renewal options in the contract, to really complete the projects at the five-year level. The proposed amendment is to complete the five-year capital improvement program with a single contractor, and later determine if there is a need to have ongoing services. A motion was made by Council Member Douglas, seconded by Council Member Carson, to amend the resolution to authorize the contract as written, with the exception that the term would be one year with an option to renew. Public Hearings Z-933-16 AN ORDINANCE REZONING THE PROPERTY DESCRIBED IN EXHIBIT “A” ATTACHED HERETO AND MADE A PART HEREOF, LOCATED AT 5844 DAHLIA STREET, COMMERCE CITY, COLORADO, FROM I-2 TO C-3 AND AMENDING THE ZONING MAP OF THE CITY OF COMMERCE CITY, COLORADO TO REFLECT SAID REZONING Mayor Ford disclosed that he has done previous work for Eric Bush, but never on this Commerce City Page 3 City Council Meeting Minutes - Final May 2, 2016 property. He sat in on a meeting with Mr. Bush and Building Official Patrick Buckley regarding redevelopment of the existing building, but not about zoning. Mayor Ford does not believe he has damaged his ability to hear this case and make a clear decision. A motion was made by Council Member Douglas, seconded by Council Member Teter, to allow Mayor Ford to participate in the public hearing. VOTE: 7 aye, 2 excused (McEldowney, Amador) Mayor Ford opened the public hearing. Planner Caitlin Hasenbalg-Long presented the case. The applicant is seeking a zone change from I-2 to C-3 at 5844 Dahlia Street. The existing structure was built in 1960 and has been zoned I-2 since incorporation. The applicant purchased the property in 2015 for development of a marijuana retail store. The planning commission held a public hearing on the application and voted 3 to 2 to forward the application to council with a favorable recommendation. A letter from a neighbor, who has a legal fence, expressed concern over liability issues with site restrictions because of the fence. Brian Ruden, appeared on behalf of the applicant. Mr. Ruden stated that if the site restrictions become an issue, he would address it then. Public Input David Soucie, appeared on behalf of the neighboring property. Mayor Ford closed the public hearing. A motion was made by Mayor Pro Tem Bullock, seconded by Council Member Teter, to accept the findings and recommendations of the planning commission. Planning Manager Steve Timms presented the case. The applicant, DIA Tech Center is seeking to amend the current planned unit development, to include two additional parcels of land and rezone the two parcels, from agricultural to planned unit development, to allow for employment uses. The planning commission held a public hearing on April 19, 2016, and voted 5-0 to forward the application to council with favorable recommendations. Mr. Thompson stated that there has been interest in developing this property. There was no additional public comment, and the public hearing was closed. Presentations Pres 16-95 Capital Program Update Program Director Scott Hergenrader stated that this is the 9th quarterly update for the 2K program. The program is tracking a $137 million gross budget that includes all the projects as well as management reserves, or program contingencies. The first debt of $78 million dollars was issued the summer of 2014, and the next issuance is expected mid-year. Other funding sources of approximately $6.9 million in grant funding is in addition to the $137 million and to date, the city has expended roughly $20 million. On the revenue side, in 2014 and 2015 the receipts have been approximately $10 to $11 million per year. Two projects are complete: outdoor pool and Fronterra Neighborhood Park. Tower Road, the new recreation center, Turnberry Park, and Villages at Buffalo Run East Neighborhood Park projects are well under way. On the CIP front, the RTD North Metro Station Area Improvements is in the pre-design phase, along with Tower Road/Pena Boulevard ramp. Pres 16-96 2016 Q1 Work Plan Update City Manager McBroom provided council with highlights from the first quarter of staff's work plan. Some of the highlights include: grand openings of three businesses, 155 attendees at the Small Business Appreciation Breakfast, 33 economic development prospect inquiries, approval of two marijuana business licenses, the city's workers compensation insurance company issued a dividend check back to the city, kick off of a new safety program, and the street sweeping program is underway. 11. Administrative Council Business Council Member Douglas asked about storm drain covers and lighting around Frontier Park, for a copy of the speed study done last year at 72nd Place and Old Quebec, and a discussion regarding the high bid submittals for Chambers Trail. 12. Reports City Manager McBroom provided highlights from his weekly report emailed to council earlier. Mayor Ford and council reported on their attendance at various meetings and events. Council Member Ellliott expressed her desire to become a Rotarian.
