Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Ford on October 17, 2016, at 6:06 pm. Present: 9 - Mayor Sean Ford , Council Member Jadie Carson, Council Member Rick A. Teter, Mayor Pro Tem René Bullock, Council Member Crystal Elliott, Council Member Jason McEldowney, Council Member Steven J. Douglas, Council Member Andrew Amador and Council Member Paolo Diaz 2. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Audience Introduction The audience introduced themselves. 4. Proclamations and Recognitions 16-46 Recognition of the CPRA 2016 Fellow Award Parks Recreation and Golf Director Keith introduced Tim Moore as the recipient of the Colorado Parks and Recreation Association's 2016 Fellow Award. Mr. Moore has served Commerce City for 40 years. This Recognition was discussed and closed 5. Citizen Communication Suncor representatives provided council with a recap of the power outage event at the refinery last week. They explained that air quality monitoring went into effect immediately and is still in effect. Chief Vincel from South Adams County Fire District appeared before council to review the district's protocol in hazmat incidents. A representative from Congressman Perlmutter's Office provided council with an itinerary of upcoming events. Harvest Thomas, 7110 E. 60th Wy., provided council with an update from the Adams 14 School District. Mr. Thomas asked about the procedure for installing speed bumps on Oneida in front of Rose Hill Elementary. Commerce City Page 1 City Council Meeting Minutes - Final October 17, 2016 6. Approval of Minutes Min 16-76 Meeting minutes of August 15, 2016 A motion was made by Mayor Pro Tem Bullock, seconded by Council Member McEldowney, to allow Mayor Ford to abstain from voting on the meeting minutes of August 15, 2016, because of his excused absence. VOTE: 8 aye, 1 abstain (Ford) A motion was made by Council Member McEldowney, seconded by Council Member Teter, that the minutes be approved. VOTE: Aye: 8- Council Member Carson, Council Member Teter, Mayor Pro Tem Bullock, Council Member Elliott, Council Member McEldowney, Council Member Douglas, Council Member Amador and Council Member Diaz Abstained: 1- Mayor Ford 7. Consent Agenda A motion was made by Council Member McEldowney, seconded by Council Member Amador, to approve the consent agenda as presented. Ord 2108 AN ORDINANCE AMENDING SECTION 21-9210 OF THE COMMERCE CITY LAND DEVELOPMENT CODE RELATING TO PUBLIC PARKS AND RECREATION FEES Ord 2115 AN ORDINANCE AMENDING THE 2016 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE DEPARTMENT OF JUSTICE - JAG/BYRNE GRANT FUNDS IN THE AMOUNT OF $18,766 FOR THE PURCHASE OF TASERS TO BE USED BY POLICE DEPARTMENT PERSONNEL AND AUTHORIZATION OF THE EXPENDITURE THEREOF Res 2016-116 RESOLUTION APPROVING GREATER OUTDOORS COLORADO INSPIRE GRANT AGREEMENT Res 2016-117 RESOLUTION MODIFYING THE PARKS, RECREATION AND GOLF ADVISORY COMMITTEE Res 2016-120 RESOLUTION APPROVING FIRST AMENDMENT TERMINATING TOWER ROAD IMPROVEMENTS PROJECT FUNDING AGREEMENT Res 2016-124 RESOLUTION APPOINTING MEMBERS TO DESIGNATED BOARDS AND COMMISSIONS OF COMMERCE CITY 8. Public Hearings Res 2016-39 RESOLUTION ADOPTING THE 2017 BUDGET AND CERTIFICATION OF THE MILL LEVY FOR THE CITY OF COMMERCE CITY Mayor Ford opened the public hearing. Finance Director Carstens presented the proposed 2017 budget to council. Ms. Carstens stated that the total budget is $71.5 million and there is $39,581,438 in general fund reserves. Council is asked to continue the hearing to November 7, 2016. A motion was made by Council Member McEldowney, seconded by Council Member Amador, that this resolution be continued to November 4, 2016. VOICE VOTE: Unanimous, all present affirmed. 9. Ordinances on 1st Reading Ord 2111 AN ORDINANCE AUTHORIZING THE LEASING OF CERTAIN CITY PROPERTY AND THE EXECUTION AND DELIVERY BY THE CITY Commerce City Page 3 City Council Meeting Minutes - Final October 17, 2016 OF A SITE LEASE, A LEASE PURCHASE AGREEMENT, AN ESCROW AGREEMENT AND OTHER FINANCING DOCUMENTS IN CONNECTION THEREWITH; SETTING FORTH PARAMETERS AND RESTRICTIONS WITH RESPECT TO THE FINANCING; AUTHORIZING THE REFUNDING OF CERTAIN CERTIFICATES OF PARTICIPATION; RATIFYING ACTION PREVIOUSLY TAKEN CONCERNING THE REFERENCED TRANSACTIONS; AND PROVIDING OTHER MATTERS RELATING THERETO A motion was made by Council Member McEldowney, seconded by Council Member Teter, that this ordinance be introduced by council as seated and approved on first reading. VOTE: Aye: 9- Mayor Ford, Council Member Carson, Council Member Teter, Mayor Pro Tem Bullock, Council Member Elliott, Council Member McEldowney, Council Member Douglas, Council Member Amador and Council Member Diaz 10. Administrative Council Business Council Member Amador reported on a mobile home on blocks with no skirting around the bottom and a structure with a cardboard roof located at approximately 59th & Highway 2. Mr. Amador also expressed concern with the number of campers parked in the WalMart parking lot. Council Member Douglas asked if the rough patches on the Tower Road detour route can be patched. Council Member Douglas and Mayor Pro Tem Bullock gave a brief presentation on the highlights of the Leadership Conference they recently attended. 11. Reports City Manager McBroom highlighted items off his weekly report provided to council earlier via email. Mayor Ford and council reported on their attendance at various meetings and events. 12. Adjourn to NIGID Meeting The meeting adjourned at 7:50 pm. In accord with the city charter, the city attorney read the title to all ordinances and resolutions adopted by council at this meeting.
