1. Call to Order/Roll Call
A regular meeting of the City Council of the City of Commerce City was called to
order by Mayor Ford on December 5, 2016, at 6:30 p.m.
A motion was made by Mayor Pro Tem Bullock, seconded by Council Member
McEldowney, to excuse Council Member Carson from tonight's meeting because of
her excused absence.
VOTE: 8 aye, 1 excused (Carson)
Present: 8 - Mayor Sean Ford , Council Member Rick A. Teter, Mayor Pro Tem René
Bullock, Council Member Crystal Elliott, Council Member Jason
McEldowney, Council Member Steven J. Douglas, Council Member
Andrew Amador and Council Member Paolo Diaz
Excused: 1 - Council Member Jadie Carson
2. Pledge of Allegiance
The Pledge of Allegiance was recited.
3. Audience Introduction
The audience introduced themselves.
4. Proclamations and Recognitions
16-62 Recognition of the Commerce City Youth Commission
Community Liaison Daniela Villarreal introduced the members of the city's youth
commission. Ms. Villareal reviwed the commission's goals for 2017.
5. Citizen Communication
Glen Murray, 11010 Havana St, addressed council regarding his concern for safety at
104th & Florence St. and 104th and Havana.
Executive Director of Colorado Information Sharing Consortium Dave Shipley and
Adams County Sheriff Bureau Chief Vince Line awarded Interim Deputy City
Manager Troy Smith with a Leadership Award for his work on the formation of the
consortium.
Angela Brandt, 12168 Kitteridge St., thanked staff members for formalizing a plan to

implement safe crossing from the Outlook Subdivision across 120th Avenue.
Brian Ruden, 9670 Dalls St. Unit E + F, believes there are areas for improvement
between the city and the marijuana industry. Would like the renewal process
streamlined and the odor component of the municipal code, changed.
Jim McTurnan, general council for Starbuds, stated that the zero tolerance standard
for marijuana odor is tough for businesses and not a realistic standard. Mr.
McTurnan asked council to consider new odor regulations with a scientific
measurement component.
TJ Joudah, 9670 Dallas St. Units E + F, felt that the city has been harsh on Starbuds.
Mayor Ford responded to the marijuana license representatives by asking staff to
review the licensing process in place and present any recommendations for
improvements to council at a future study session.
Guillermo Serna, 14122 E. 102nd Pl., spoke about blighted area in Derby,
homelessness in Commerce City, and 104th & Union Pacific Railroad.
Robert Toavs, expressed concern regarding the right of entry provision in the
municipal code.
6. Consent Agenda
A motion was made by Mayor Pro Tem Bullock, seconded by Council Member
Teter, to approve the consent agenda as presented. ROLL CALL VOTE:

U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
(HUD) COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)
FUNDS IN THE AMOUNT OF $386,340 FOR SIDEWALK
CONSTRUCTION AND BUS STOP IMPROVEMENTS AND THE
AUTHORIZATION OF THE EXPENDITURE THEREOF.
Ord 2118 AN ORDINANCE AMENDING THE 2016 BUDGET OF THE CITY OF
COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE
BULLETPROOF VEST PARTNERSHIP GRANT FUNDS IN THE
AMOUNT OF $6,400.00 FOR THE BULLETPROOF VEST
PROGRAM IN THE POLICE DEPARTMENT AND THE
AUTHORIZATION OF THE EXPENDITURE THEREOF.
7. Ordinances on 1st Reading
Ord 2119 AN ORDINANCE AMENDING SECTIONS 9-3302 AND 9-3303 OF
THE COMMERCE CITY REVISED MUNICIPAL CODE RELATING TO
THE LICENSING AND REGULATION OF OUTDOOR VENDORS
A motion was made by Mayor Pro Tem Bullock, seconded by Council Member
Teter, that this ordinance be introduced by council as seated and approved on
first reading. VOTE:

Member Elliott, Council Member McEldowney, Council Member Douglas,
Council Member Amador and Council Member Diaz

Pres 16-645 Latino Engagement Taskforce Recommendations
A Cultivando representation gave a presentation to council on the recommendations
of the Latino Engagement Taskforce.
9. Administrative Council Business
City Manager McBroom
Public Works Director D'Andrea provided council with a brief presentation on CDOT's
request for council support of a FASTLANE grant application.
A motion was made by Council Member McEldowney, seconded by Mayor Pro Tem
Bullock, to send a strongly worded letter to CDOT, and direct staff to explore avenues
to engage other public officials regarding regional efforts toward....

Council Member Douglas repairing ruts along the detour route, watch commander

A motion was made by Council Member Douglas, seconded by Mayor Ford to a rapid
flashing beacon at 112th & Oakland.staff engage with a process to prioritize
crossings.
VOTE: 8 aye, 1 excused (Carson)
Ford: would like staff to speak to Flatiron Construction regarding the detour road,
Hwy 2 north of 112th ask to lower speed, 104th + Florence examine U-Turn, 104th &
Peoria median landscape, 27J under developing parking for new schoold bldgs,
liability for providing habitat (i.e. storm drains)

CM McBroom reported on sending his report to council earlier
