Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Ford on February 5, 2018, at 6:01 p.m. A motion was made by Council Member Douglas, seconded by Council Member Diaz, to excuse Mayor Pro Tem Teter from tonight's meeting. VOTE: 8 aye, 1 excused (Teter) 2. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Audience Introduction The audience introduced themselves. 4. Proclamations and Recognitions 18-03 Police Department 2017 National Night Out Award Recognition Mayor Ford presented the members of the police department with the 2017 National Night Out Award. The Commerce City Police Department was awarded 19th place overall in the 50,000 - 100,000 population group and was 1st in the State of Colorado. 18-05 Recognize newly appointed Sergeants in the Police Department Council recognized the following newly appointed police sergeants: Tom Boskovich, Jeremy Jenkins, Brian Trujillo and Travis Fender. 18-06 GFOA Award Recognition Council recognized the finance department for receiving recognition in financial reporting for 30 consecutive years. Commerce City Page 1 City Council Meeting Minutes February 5, 2018 18-04 GFOA Award for Outstanding Achievement in Popular Financial Reporting Council recognized the finance department for receiving the 2016 Popular Financial Reporting Award. This Recognition was discussed and closed 5. Citizen Communication Susan Carabajal, no address given, thanked South Adams County Fire Department for installing smoke alarms and carbon monoxide detectors in her home. Carleen Cellar, no address given, informed council about an open house with state representatives and she expressed concern regarding her property tax bill. 6. Approval of Minutes Min 65 Meeting Minutes of December 4, 2017 Attachments: Minutes A motion was made by Council Member Douglas, seconded by Council Member Guardiola, that the minutes be approved. VOTE: Min 66 Meeting Minutes of November 20, 2017 Attachments: Minutes A motion was made by Council Member Diaz, seconded by Council Member Frank, that the minutes be approved. VOTE: Min 67 Organizational Meeting Minutes of December 4, 2017 Attachments: Minutes A motion was made by Council Member Elliott, seconded by Council Member Huseman, that the minutes be approved. VOTE: 7. Consent Agenda A motion was made by Council Member Douglas, seconded by Council Member Huseman, to approve the consent agenda as presented. ROLL CALL VOTE: Commerce City Page 2 City Council Meeting Minutes February 5, 2018 Ord 2150 AN ORDINANCE AMENDING SECTION 5-4500 OF THE COMMERCE CITY REVISED MUNICIPAL CODE TO ADOPT THE 2017 NATIONAL ELECTRICAL CODE AND REPEALING AND REENACTING SECTIONS OF THE 2006 INTERNATIONAL CODE COUNCIL ELECTRICAL ADMINISTRATIVE PROVISIONS. Presentations Pres 18-05 Senior Commission Update Attachments: Presentation Senior Commission President Reilly provided council with an update of the commission's activities to date, senior needs identified by the commission and a calendar of upcoming events. This Presentation was discussed and closed Commerce City Page 3 City Council Meeting Minutes February 5, 2018 Pres 18-12 Commerce City Historical Society Update Attachments: 2017 Accomplishments 2018 Meeting & Program Schedule 2018 Programs Letter Presentation Society board members provided council with program highlights for 2017, current financial status, current displays, programming and goals for 2018. Pres 18-18 State of the Court for 2017 Attachments: 2017 Report Order for Compliance Court Costs and Fees Petition to Seal Records 2018 Court Schedule Advisement Presentation Municipal Judge Juarez presented his annual State of the Court address. Highlights included: - two new associate judges appointed in 2017, - revenues were significantly less than previous years; however, they are trending back up in these early months of 2018 - legislative changes effecting municipal court - requested ordinance changes regarding maximum jail sentence, decriminalizing all traffic violations, municipal driving under suspension and pan handling on medians. - anticipated problems with the I-70 reconstruction - need fee schedule updates - staff efficiency Pres 18-20 Q4 Capital Program Update Attachments: Year End Reports 2014-2017 Presentation CIPCAC Co-Chairs Carabajal and Allen and Program Manager Scott Hergenrader presented council with the 16th quarterly update of the 2K Capital Bond Program that is nearing the end. Revenues as of November 2017, were $13 million and the remaining two projects are anticipated to be completed by the end of the year. Commerce City Page 4 City Council Meeting Minutes February 5, 2018 Pres 18-21 2017 Q4 Work Plan Update Attachments: Presentation Executive Report City Manager McBroom and Deputy City Manager Smith reviewed the fourth quarter work plan aligned to council's visions and goals. Highlights included: - Senior Housing: progress continues to be made towards attracting new developments in the city - Irondale Neighborhood Plan: consultant has proposed two scenarios for the future vision and is in the process of vetting those scenarios - Grade separated 120th &Hwy 85: CDOT, Weld and Denver Counties submitted federal grant applications - Competitive Youth Sports Field: on track with an update in Q2 2018 - police department assessment/reform : department of justice underwent changes to their business model; however, the police department is working with the department of justice to better the department under a new tech assist program - 216 affordable housing units and 68 new companies added to the community - audit collections are at $2.8M as of 12/31/2017 - council adopted a five-year CIPP 9. Administrative Council Business Councilman Douglas requested a study session on the boards and commissions program based on feedback from recent interviewees. Councilman Guardiola said he typed a list regarding items the subcommittee would like to address. 18-16 Additional Council Appointments Attachments: Updated Appointment List Sand Creek Board Responsibilities A motion was made by Council Member Diaz, seconded by Council Member Madera, to appoint Council Member Huseman to the Water Quality Board VOTE: 8 aye, 1 excused (Teter) 10. Reports City Manager McBroom highlighted items off his weekly report to council. Mayor and council reported on their attendance at various meetings and events. 11. Executive Session 18-18 Executive session, pursuant to CRS 24-6-402(4)(f)(l) for the purpose of the evaluation of the municipal judge A motion was made by Council Member Frank, seconded by Council Member Madera, to enter into executive session, pursuant to CRS 24-6-402(4)(f)(l), for the purpose of the evaluation of the municipal judge. Adjourn A motion was made by Council Member Huseman, seconded by Council Member Member Madera, to extend the appointment of Municipal Judge Juarez for a two-year term, ending at the first regular meeting after February 1, 2020, unless terminated, pursuant to the charter, under the terms of the existing agreement modified by a 4% increase in compensation.
