Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Ford on August 20, 2018, at 6:00 PM. Present: 8 - Mayor Sean Ford , Mayor Pro Tem Rick A. Teter, Council Member Crystal Elliott, Council Member Steven J. Douglas, Council Member Benjamin Huseman, Council Member Jose Guardiola, Council Member Nicole Frank and Council Member Oscar Madera 2. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Ward IV Applicant Interviews and Appointment Council interviewed the following applicants to fill the Ward IV vacancy: Steve Davis, Aaron Herrera, Roger Japp, Anthony L. Stellato, Heidi McNeely, Phil Noble, Michael Scanlon, Charles Dukes, David Scott, and Glenn Boldenow. After two rounds of voting, a motion was made by Mayor Pro Tem Teter, seconded by Council Member Guardiola, to eliminate those candidates who received one or zero votes from the next round of voting. VOTE: Unanimous; all present affirmed After another round of voting, a motion was made by Council Member Huseman, seconded by Council Member Madera, to reduce the list of candidates to the two who received the most votes. VOTES: Unanimous; all present affirmed After another round of voting and a deadlock, a motion was made by Mayor Pro Tem Teter, seconded by Council Member Huseman, to break the deadlock by a coin toss. VOTE: 3 - Aye, 5 - Nay (Madera, Ford, Douglas, Elliott, Guardiola) After another round of voting and a deadlock, a motion was made by Mayor Pro Tem Teter, seconded by Council Member Madera, to proceed with the rest of the agenda and revist the vote at the end of the meeting. VOTE: 7 - Aye, 1 - Nay (Huseman) 5. Citizen Communication None. 6. Consent Agenda A motion was made by Mayor Pro Tem Teter, seconded by Council Member Huseman, to approve the consent agenda as presented. ROLL CALL VOTE: Aye: 8- Mayor Ford, Mayor Pro Tem Teter, Council Member Elliott, Council Member Douglas, Council Member Huseman, Council Member Guardiola, Council Member Frank and Council Member Madera Res 2018-63 Resolution Authorizing Award of Contract for 2018 Slurry Seal and Asphalt Repair Project Res 2018-64 Resolution Authorizing Award of Contract for 2018 Mill and Overlay Project 7. Public Hearings Commerce City Page 2 City Council Meeting Minutes August 20, 2018 CU-118-18 CONDITIONAL USE PERMIT FOR THE REDUCTION IN THE FLOOR AREA RATIO IN CASE CU-118-18 Mayor Ford opened the public hearing. Planner Caitlin Hasenbalg-Long presented the case. The applicant, Winslow Crane Service, is seeking a conditional use permit for the purpose of reducing the floor area ratio in order to construct a 27,600 square foot building. Due to the large size of equipment, the site layout requires a large amount of space to safely maneuver and store cranes when not in use on a job site, which necessitates a reduced building size. This proposed facility will have space for offices and maintenance bays, including room for future growth of the business. There being no other public testimony, the public hearing was closed. A motion was made by Council Member Huseman, seconded by Council Member Teter, to accept the findings and recommendations of the planning commission. VOTE: Unanimous; all present affirmed A motion was made by Council Member Madera, seconded by Council Member Frank, that this conditional use permit be adopted. VOICE VOTE: Unanimous, all present affirmed. 8. Administrative Council Business Council continued to vote and discuss appointment of the Ward IV candidate. After another round of voting and a deadlock, a motion was made by Mayor Pro Tem Teter, seconded by Council Member Huseman, to flip a coin to determine which applicant fills the Ward IV vacancy. VOTE: 3 - Aye (Frank, Huseman, Teter), 5 - Nay (Douglas, Elliott, Ford, Guardiola, Madera) A motion was made by Mayor Ford, seconded by Council Member Madera, to set a special meeting for Wednesday, August 22, 2018, at 6:30 p.m. for a reception for council and the two remaining applicants, Mr. Davis and Mr. Dukes, and to hold a vote for the Ward IV vacancy. VOTE: Unanimous, all present affirmed. 9. Reports The mayor and council reported on their attendance at various meetings and events.
