Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Ford on July 15, 2019, at 5:59 PM. Present: 9 - Mayor Sean Ford , Mayor Pro Tem Rick A. Teter, Council Member Oscar Madera, Council Member Nicole Frank, Council Member Steve Davis, Council Member Steven J. Douglas, Council Member Benjamin Huseman, Council Member Craig Hurst and Council Member Jose Guardiola 2. Executive Session 19-52 An executive session of the City Council and City staff, pursuant to CRS 24-6-402(4)(b and e), to discuss and determine negotiating positions regarding the annexation agreement relating to the Third Creek West annexation and to receive legal advice regarding such agreement. A motion was made by Council Member Madera, seconded by Mayor Pro Tem Teter, to enter into an executive session of the City Council and City staff, pursuant to CRS 24-6-402(4)(b and e), to discuss and determine negotiating positions regarding the annexation agreement relating to the Third Creek West annexation and to receive legal advice regarding such agreement. VOTE: Aye: 6- Mayor Ford, Mayor Pro Tem Teter, Council Member Madera, Council Member Frank, Council Member Davis and Council Member Guardiola Nay: 3- Council Member Douglas, Council Member Huseman and Council Member Hurst 3. Pledge of Allegiance Troops from Boy Scout Troop 414 and Cub Scout Troop 607 presented the colors. The Pledge of Allegiance was recited. 4. Audience Introduction The audience introduced themselves. Members of the Historical Society thanked council for their support of the Historical Society and distributed their Commerce City themed deck of cards to council. Kip Cheroutes, 2648 Belaire Street, gave an update on the Rocky Mountain Arsenal Wildlife Refuge and upcomming events. 6. Consent Agenda A motion was made by Council Member Frank, seconded by Council Member Madera, to approve the consent agenda as presented. Ord 2227 AN ORDINANCE AMENDING THE 2019 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE ADAMS COUNTY OPEN SPACE GRANT FUNDS IN THE AMOUNT OF $750,000.00 FOR THE VETERAN’S MEMORIAL PARK RENOVATION PROJECT AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF. Res 2019-69 RESOLUTION FINDING SUBSTANTIAL COMPLIANCE OF ANNEXATION PETITIONS IN CASES AN-253-19 AND AN-254-19 KNOWN AS THE THIRD CREEK WEST ANNEXATIONS AND SETTING A PUBLIC HEARING TO DETERMINE ELIGIBILITY FOR SUCH ANNEXATIONS Res 2019-78 RESOLUTION APPOINTING MEMBERS TO DESIGNATED BOARDS AND COMMISSIONS OF COMMERCE CITY 7. Ordinances on 1st Reading Ord 2232 AN ORDINANCE AMENDING THE 2019 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE COLORADO DEPARTMENT OF TRANSPORTATION GRANT IN THE AMOUNT OF $18,000.00 FOR DUI ENFORCEMENT EFFORTS AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF. A motion was made by Council Member Frank, seconded by Council Member Huseman, that this ordinance be introduced by council as seated and approved on first reading. VOTE: Aye: 9- Mayor Ford, Mayor Pro Tem Teter, Council Member Madera, Council Member Frank, Council Member Davis, Council Member Douglas, Council Member Huseman, Council Member Hurst and Council Member Guardiola Ord 2233 AN ORDINANCE AMENDING THE 2019 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE FUNDS RETURNED FROM THE CITY OF NORTHGLENN IN THE AMOUNT OF $27,678 TO BE USED AS A CONTRIBUTION TO RALSTON HOUSE, AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF A motion was made by Mayor Pro Tem Teter, seconded by Council Member Davis, that this ordinance be introduced by council as seated and approved on first reading. Administrative Council Business Mr. McBroom provided council with a draft letter in support of a charter school being built in the Reunion district at the request of the Oakwood Home Owners Association. A motion was made by Council Member Davis, seconded by Council Member Huseman, to authorize the mayor to sign the letter. VOTE: Unanimous, all present affirmed. A motion was made by Council Member Huseman, seconded by Council Member Madera, to direct staff to hold another meeting with the Oil and Gas Focus Group for the purpose of collecting their input on the draft Regional Operator Agreement. Vote: Unanimous, all present affirmed. Council Member Douglas requested an updates on when improvements would be made to 96th Avenue, current construction on Quebec Street, and when the 4th of July fireworks would be rescheduled. Mr. McBroom stated he would provide council with an update on the improvements to 96th Avenue in the near future, the construction on Quebec was a contractor doing work for Comcast, and the Rapids would be rescheduling the 4th of July fireworks for sometime in August or September. Pres 19-117 Oil and Gas Monthly Update Chris Cramer, Director of Community Development, provided the oil and gas monthly update. 9. Reports City Manager McBroom highlighted items presented in his weekly report provided to council earlier. The mayor and council reported on their attendance at various meetings and events. 10. Adjourn The meeting adjourned at 8:48 p.m. In accord with the city charter, the city attorney read the title to all ordinances and resolutions adopted by Council at this meeting.
