Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Huseman on May 28, 2020, at 7:56 PM. Present: 9 - Mayor Benjamin Huseman, Mayor Pro Tem Nicole Frank, Council Member Oscar Madera, Council Member Jennifer Allen-Thomas, Council Member Susan Noble, Council Member Jose Guardiola, Council Member Craig Hurst, Council Member Meghan Grimes and Council Member Robyn Smith 2. Presentations Commerce City Page 1 City Council Meeting Minutes - Final May 28, 2020 Pres 20-195 Requested Amendments to the Mile High Greyhound Park Phased Redevelopment Agreement and Purchase and Sale Agreement Deputy City Manager Roger Tinklenberg introduced the presentation. Management Analyst Jenna Lowery provided the presentation. Ms. Lowery gave an overview of the current project status, the reason for the proposed extension to the closing, certain other dates, and other amendments to the developer agreement and purchase and sale agreement, and possible action the Council could take on the matter. A motion was made by Council Member Frank, seconded by Council Member Allen-Thomas, to approve the proposed amendment to the Purchase and Sale agreement and Master Developer Agreement as presented in the packet. VOTE: 9 - Aye The council consented to amending the agenda to allow the consideration of Ordinance 2282 and a discussion of allocations of remaining funds from the CARES Act. A motion was made by Mayor Huseman, seconded by Council Member Allen-Thomas, to allocate $500,000 of remaining CARES Act funding to provide rent and mortgage assistance to residents of Commerce City. VOTE: 9 - Aye A motion was made by Mayor Huseman, seconded by Mayor Pro Tem Frank, to allocate $100,000 of remaining CARES Act funding to assist food banks that serve Commerce City residents. VOTE: 9 - Aye A motion was made by Council Member Noble to direct staff to prepare a proposal to reopen the city's recreation centers on a timed and limited basis. Council Member Noble withdrew their motion. A motion was made by Council Member Grimes, seconded by Council Member Noble, to direct staff to explore a program for rolling out the reopening the city's recreation centers using guidance from other communities that are doing the same and using and where possible use CARES Act funding to supplement the cost of doing so. VOTE: 8 - Aye, 1 - Nay (Allen-Thomas) Ordinances on 1st Reading Ord 2282 AN EMERGENCY ORDINANCE AUTHORIZING TEMPORARY OUTDOOR SERVICE AREAS FOR RESTAURANTS AND BARS IN THE CITY OF COMMERCE CITY, COLORADO A motion was made by Mayor Huseman, seconded by Council Member Madera, that this emergency ordinance be introduced and approved by council as seated. VOTE: Aye: 9- Mayor Huseman, Mayor Pro Tem Frank, Council Member Madera, Council Member Allen-Thomas, Council Member Noble, Council Member Guardiola, Council Member Hurst, Council Member Grimes and Council Member Smith 3. Executive Session Commerce City Page 2 City Council Meeting Minutes - Final May 28, 2020 20-34 An Executive Session pursuant to C.R.S. 24-6-402(4)(b) for the purpose of receiving legal advice relative to a potential liability claim. A motion was made by Council Member Grimes, seconded by Council Member Madera, to enter into an executive session pursuant to C.R.S. 24-6-402(4)(b) for the purpose of receiving legal advice relative to a potential liability claim. VOTE: Aye: 9- Mayor Huseman, Mayor Pro Tem Frank, Council Member Madera, Council Member Allen-Thomas, Council Member Noble, Council Member Guardiola, Council Member Hurst, Council Member Grimes and Council Member Smith 4. Adjourn The meeting adjourned at 11:45 p.m. In accord with the city charter, the city attorney read the title to all ordinances and resolutions adopted by Council at this meeting.
