1. Call to Order/Roll Call
A regular meeting of the City Council of the City of Commerce City was called to order
by Mayor Huseman on October 19, 2020, at 6:31 PM.
A motion was made Council Member Grimes, seconded by Council Member
Allen-Thomas, to excuse Council Member Smith. VOTE: 8 - Aye, 1 - Excused (Smith)
Present: 8 - Mayor Benjamin Huseman, Mayor Pro Tem Nicole Frank, Council Member
Oscar Madera, Council Member Jennifer Allen-Thomas, Council Member
Susan Noble, Council Member Jose Guardiola, Council Member Craig Hurst
and Council Member Meghan Grimes
Excused: 1 - Council Member Robyn Smith

20-85 Citizen Communication - City Council will conduct this meeting virtually
via Zoom as the Civic Center remains closed out of precaution for
COVID-19. There will be the opportunity for public comment at the
meeting during citizen communication and/or for each agenda item.
Comments may be consolidated under the Citizen Comment part of the
meeting. The public can submit their comments live during the meeting
via Zoom or in advance using the online form or mail. Visit
c3gov.com/council and click on “Meeting agendas” for the full meeting
agenda and "Virtual Meeting and Public Comment Instructions" for
instructions on how to submit live verbal and written comments. The
deadline to register to comment and to submit written comments is noon
on October 19.
Steve Douglas requested the city consider refunding residents that have a city
recreation pass due to the full and partial closures of the recreation facilities due to
COVID-19.
4. Presentations
Pres 20-378 COVID-19 Update
Interim City Manager Tinklenberg and Interim Deputy City Manager Blakeman provided
an update on the city's response during the COVID-19 crisis.
A motion was made by Council Member Noble, seconded by Council Member Grimes,
to amend the agenda to reopen citizen communication. VOTE: 8 - Aye, 1 - Excused
(Smith)
5. Consent Agenda
Council Member Noble requested to pull resolution 2020-85 from the consent agenda.
A motion was made by Council Member Allen-Thomas, seconded by Council
Member Madera, to approve the consent agenda as amended. ROLL CALL
VOTE:

Res 2020-85 RESOLUTION APPOINTING MEMBERS TO DESIGNATED BOARDS
AND COMMISSIONS OF COMMERCE CITY
Council Member Noble requested resolution 2020-85 be pulled from the consent
agenda to amend the resolution to make Steve Douglas the regular member and
Jordan Ingram the alternate member on the planning commission. Motion failed due to
lack of second.
6. Public Hearings
Res 2020-27 RESOLUTION ADOPTING THE BUDGET FOR THE CITY OF
COMMERCE CITY, COLORADO FOR THE YEAR 2021 AND
PROVIDING FOR 2020 COMMERCE CITY TAX LEVY
Mayor Huseman opened the public hearing.
Sheryl Carstens, Director of Finance, provided an overview of the proposed 2021
budget.
No public testimony was received.
A motion was made by Council Member Allen-Thomas, seconded by Mayor Pro
Tem Frank, that the public hearing be continued to November 2. VOTE:
Aye: 8- Mayor Huseman, Mayor Pro Tem Frank, Council Member Madera, Council
Member Allen-Thomas, Council Member Noble, Council Member Guardiola,
Council Member Hurst and Council Member Grimes

7. Resolutions
Res 2020-66 RESOLUTION ABOLISHING THE CAPITAL IMPROVEMENT PROJECT
CITIZEN ADVISORY COMMITTEE (CIPCAC)
City Clerk Dylan Gibson provided the presentation. Mr. Gibson gave a background of
the Capital Improvement Project Citizen Advisory Committee, current status of the
committee, and staff's recommendation to abolish the committee.
A motion was made by Mayor Pro Tem Frank, seconded by Council Member
Hurst, that this resolution be adopted. VOTE:

Member Allen-Thomas, Council Member Noble, Council Member Guardiola,
Council Member Hurst and Council Member Grimes

8. Administrative Council Business
A motion was made by Council Member Grimes, seconded by Council Member
Madera, to censure Mayor Huseman for a period of two regular meetings or one month
in total. VOTE: 7 - Aye, 1 - Abstain (Huseman), 1 - Excused (Smith)
A motion was made by Mayor Huseman, seconded by Council Member Guardiola, to
direct staff to enter into a supplemental agreement with Republic Services for the
purpose of placing a recycling container outside the municipal services center to allow
residents to drop off excess clean, in good condition, and recyclable cardboard.
VOTE: 8 - Aye, 1 - Excused (Smith)
20-84 LDC Oil and Gas Financial Assurances Discussion
City Attorney Robert Sheesley and Community Development Director Jason Rogers
requested council's direction on the draft financial assurances provisions in the draft
land development code amendments related to oil and gas development.
9. Council Reports
Interim City Manager Tinklenberg highlighted items presented in his weekly report
provided to council earlier. The mayor and council reported on their attendance at
various meetings and events.
10. Adjourn
The meeting adjourned at 8:07 p.m.
In accord with the city charter, the city clerk read the title to all ordinances and
resolutions adopted by Council at this meeting.
