Call to Order/Roll Call A special meeting of the City Council of the City of Commerce City was called to order by Mayor Huseman on December 12, 2022, at 8:36 PM. A motion was made by Council Member Madera, seconded by Council Member Hurst, to excuse members not present. VOTE: 7 - Aye, 1 - Excused (Allen-Thomas) Present: 6 - Mayor Benjamin Huseman, Council Member Oscar Madera, Council Member Susan Noble, Council Member Craig Hurst, Council Member Sean Ford and Council Member Kristi Douglas Excused: 1 - Mayor Pro Tem Jennifer Allen-Thomas 2. Noticed Council Business 22-211 Reconsideration of the Motion to set a Public Hearing for the Third Creek West Filing No. 2 Final Plat A motion was made by Mayor Huseman, seconded by Council Member Madera, to rescind the motion to call up the Third Creek West Filing No. 2 Final Plat for public hearing by the Planning Commission and City Council. VOTE: 7 - Aye, 1 - Excused (Allen-Thomas) 22-212 A Grant Application Letter of Intent for grant funding as part of the Inflation Reduction Act A motion was made by Council Member Madera, seconded by Council Member Hurst, to have the City of Commerce City support the letter of intent being submitted by December 15. Executive Session Commerce City Page 1 City Council Meeting Minutes - Final December 12, 2022 22-213 An executive session pursuant to C.R.S. § 24-6-402(4)(f) for the purposes of discussing personnel matters, specifically the terms of an employment contract with and the appointment of Jason Rogers as City Manager, and, pursuant to C.R.S. § 24-6-202(4)(e) for the purpose of determining negotiating positions and instructing negotiators with regard to the finalization of the same. To the extent necessary, the City Council may also confer with the City Attorney pursuant to C.R.S. § 24-6-402(4) (b) to receive legal advice with regard to such contract terms. A motion was made by Council Member Ford, seconded by Council Member Kim, to extend the automatic time of adjournment of the meeting by thirty minutes. VOTE: 7 - Aye, 1 - Excused (Allen-Thomas) A motion was made by Council Member Madera, seconded by Council Member Ford, to adopt Resolution 2022-115. A motion was made by Council Member Madera, seconded by Council Member Ford, to enter into an executive session pursuant to C.R.S. sections 24-6-402(4) (f) & (g) for the purposes of discussing personnel matters specifically related to the recruitment of a City Attorney, and reviewing and discussing applications and materials related to candidates for the position of City Attorney which are documents protected by the mandatory nondisclosure provision of the Colorado Open Records Act.
