Call to Order/Roll Call A special meeting of the City Council of the City of Commerce City was called to order by Mayor Huseman on May 8, 2023, at 6:02 PM. A motion was made by Council Member Kim, seconded by Council Member Hurst, to excuse those members not present. VOTE: 7 - Aye, 2 - Excused (Allen-Thomas, Douglas) Present: 8 - Mayor Benjamin Huseman, Council Member Oscar Madera, Council Member Renee Millard-Chacon, Council Member Susan Noble, Council Member Craig Hurst, Council Member Craig Kim, Council Member Sean Ford and Council Member Kristi Douglas Excused: 1 - Mayor Pro Tem Jennifer Allen-Thomas 2. Executive Session 23-074 An executive session regarding the City Attorney recruitment pursuant to C.R.S. 24-6-402(4)( g) and (e) for the purpose of reviewing and discussing applications and materials related to a candidate for the position of City Attorney which are documents protected by the mandatory nondisclosure provision of the Colorado Open Records Act, interviewing the candidate, and determining positions relative to matters that may be subject to negotiations; developing strategy for negotiations; and instructing negotiators relating to the same. A motion was made by Council Member Ford, seconded by Council Member Hurst, to enter into an executive session of the City Council, pursuant to C.R.S. sections 24-6-402(4)(f)(I) & (e)(I), for the purpose of discussing personnel matters specifically related to the recruitment of a city attorney and for instructing negotiators with regard to the same. VOTE: Aye: 7- Mayor Huseman, Council Member Madera, Council Member Millard-Chacon, Council Member Noble, Council Member Hurst, Council Member Kim and Council Member Ford Commerce City Page 1 City Council Meeting Minutes - Final May 8, 2023 Excused: 2- Mayor Pro Tem Allen-Thomas and Council Member Douglas 23-101 An executive session pursuant to C.R.S. 24-6-402(4)(a), 4(b), & 4(e) for the purchase, acquisition, lease, transfer, or sale of any real, personal, or other property interest relating to City property around the Civic Center, for the purpose of determining positions relative to a matter that may be subject to negotiation, developing strategy for negotiations; and instructing negotiators regarding a potential land exchange and redevelopment opportunity regarding the same, and for receiving legal advice regarding the implications of a potential land exchange. A motion was made by Council Member Hurst, seconded by Council Member Ford, to enter into an executive session pursuant to C.R.S. 24-6-402(4)(a), 4(b), & 4(e) for the purchase, acquisition, lease, transfer, or sale of any real, personal, or other property interest relating to City property around the Civic Center, for the purpose of determining positions relative to a matter that may be subject to negotiation, developing strategy for negotiations; and instructing negotiators regarding a potential land exchange and redevelopment opportunity regarding the same, and for receiving legal advice regarding the implications of a potential land exchange. VOTE: Aye: 7- Mayor Huseman, Council Member Madera, Council Member Millard-Chacon, Council Member Noble, Council Member Hurst, Council Member Kim and Council Member Ford Excused: 2- Mayor Pro Tem Allen-Thomas and Council Member Douglas 23-102 An executive session, pursuant to C.R.S. 24-6-402(4)(b) and (e), for the purpose of conferences with the City Attorney to receive legal advice and determine positions relative to matters that are subject to negotiations, developing strategy for negotiations, and instructing negotiators regarding potential claims related to aircraft noise from Denver International Airport. Council Member Douglas entered the meeting at approximately 8:34 PM. A motion was made by Council Member Kim, seconded by Council Member Douglas, to authorize the city attorney to file litigation and take any action consistent with filing litigation against the City and County of Denver relating to airport noise. VOTE: 8 - Aye, 1 - Excused (Allen-Thomas) A motion was made by Council Member Hurst, seconded by Council Member Ford, to enter into an executive session, pursuant to C.R.S. 24-6-402(4)(b) and (e), for the purpose of conferences with the City Attorney to receive legal advice and determine positions relative to matters that are subject to negotiations, developing strategy for negotiations, and instructing negotiators regarding potential claims related to aircraft noise from Denver International Airport.
