Call to Order/Roll Call A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Pro Tem Allen-Thomas on August 21, 2023, at 6:00 PM. A motion was made by Council Member Hurst, seconded by Council Member Kim, to excuse those members not present. VOTE: 7 - Aye, 2 - Excused (Huseman, Ford) Present: 7 - Mayor Pro Tem Jennifer Allen-Thomas, Council Member Oscar Madera, Council Member Renee Millard-Chacon, Council Member Susan Noble, Council Member Craig Hurst, Council Member Craig Kim and Council Member Kristi Douglas Excused: 2 - Mayor Benjamin Huseman and Council Member Sean Ford 2. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Approval of Agenda A motion was made by Council Member Hurst, seconded by Council Member Kim, to adopt the agenda. VOTE: 7 - Aye, 2 - Excused 4. Public Comment Commerce City Page 1 City Council Meeting Minutes - Final August 21, 2023 23-175 Public Comment - City Council will conduct this meeting in person at the Commerce City Civic Center, 7887 E 60th Ave, Commerce City, CO 80022. There will be the opportunity for public comment at the meeting during public comment and/or for each agenda item. Comments may be consolidated under the Public Comment part of the meeting. The public can submit their comments live during the meeting in person, via Zoom, or in advance through mail or email. Visit c3gov.com/council and click on “Meeting agendas” for the full meeting agenda and "Virtual Meeting and Public Comment Instructions" for instructions on how to submit live verbal and written comments. The deadline to register via Zoom or submit written comments is noon on Monday, August 21, 2023. Rudy Ward spoke on homelessness. Thelma Cole spoke on the American Rescue Plan Act survey the City was conducting. Joy Bishop spoke on the process of borrowing the yard equipment from the City's lawn equipment rental program. Jackie Valdez spoke on homelessness. Shirley Henni spoke on street sweeping. Troy Younger spoke on the American Rescue Plan Act survey the City was conducting and on homelessness. Randy Wulf spoke on homelessness. 5. Proclamations and Recognitions Proc 23-20 Proclamation Declaring the Month of September 15, 2023 - October 15, 2023 as National Hispanic Heritage Month in Commerce City, Colorado Assistant City Clerk Rodriguez read the proclamation. A motion was made by Council Member Kim, seconded by Council Member Hurst, that this Proclamation be approved. Presentations Pres 23-374 Senior Commission Annual Update Jenny Penoncello, Tina Ledesma, and Mary Chan presented the Senior Commission annual update. Consent Agenda Council Member Douglas requested to remove Resolution 2023-091. Council Member Noble requested to remove Resolution 2023-099. A motion was made by Council Member Douglas, seconded by Council Member Kim, to approve the Consent Agenda as amended. Res 2023-099 A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE A CONTRACT WITH MARTIN/MARTIN, INC. FOR THE DESIGN AND CONSTRUCTION MANAGEMENT SERVICES OF THE CHAMBERS ROAD WIDENING PROJECT BETWEEN EAST 105TH AVENUE TO EAST 116TH AVENUE A motion was made by Council Member Noble, seconded by Council Member Millard-Chacon, that this Resolution be tabled. Ord 2535 SECOND AND FINAL READING OF AN ORDINANCE AMENDING THE 2023 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE ADAMS COUNTY OPEN SPACE GRANT FOR OPEN SPACE RESTORATION IN THE AMOUNT OF $260,000 AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF. 8. Ordinances on 1st Reading Ord 2528 FIRST READING OF AN ORDINANCE ADOPTING THE COMMERCE CITY 2045 COMPREHENSIVE PLAN Jim Tolbert, Assistant City Manager, introduced the presentation. Jennifer Jones, Planning Manager, and representatives from Houseal Lavigne provided an overview of the process of updating the comprehensive plan and the changes that are being proposed. A motion was made by Council Member Hurst, seconded by Council Member Kim, that this Ordinance be continued to September 18, 2023. Administrative Council Business A motion was made by Council Member Noble, seconded by Council Member Douglas, to direct staff to prepare a letter on behalf of City Council to the appropriate Environmental Protection Agency parties to express their strong disappointment in the slap on the wrist settlement with Suncor for the 2019 catalyst event, violations of safety, and lack of transparency. VOTE: 7 - Aye, 2 - Excused (Huseman, Noble) A motion was made by Mayor Pro Tem, seconded by Council Member Kim, to direct the City Manager to investigate issues with the CentralSquare software, or similar software used by Code Enforcement and other staff, to determine potential causes behind the inability to use the system during times of work and bring back information on the September 25 study session to discuss the causes and potential solutions. VOTE: 7 - Aye, 2 - Excused (Huseman, Ford) 23-212 Early Childhood Partnership of Adams County Annual Breakfast Sponsorship Request A motion was made by Mayor Pro Tem Allen-Thomas, seconded by Council Member Noble, to allocate $1,000 to sponsor the Early Childhood Partnership annual breakfast. VOTE: 7 - Aye, 2 - Excused (Huseman, Ford) 10. Council Reports City Manager Rogers highlighted items presented in their weekly report provided to council earlier. The mayor and council reported on their attendance at various meetings and events. 23-215 Review of Work Schedule .11. Adjourn A motion was made by Council Member Kim, seconded by Council Member Hurst, to adjourn the meeting. VOTE: 7 - Aye, 2 - Excused (Huseman, Ford) The meeting adjourned at 10:22 PM.
