Res LLA Resolution amending the local licensing authority rules of procedures 2013-01 Deputy City Clerk Cheryl Scott stated that the Colorado General Assembly adopted Senate Bill 11-066, which took effect August 10, 2011. The bill allows local licensing authorities to assume sole authority to approve, or deny, special event permit applications. The city clerk's office reports to the Colorado Liquor Enforcement Division within ten (10) days after issuance of a special events permit, the name of the organization to which the permit was issued, the address of the permitted location and the permitted dates of alcohol beverage service. Upon receipt of an application for a special events permit, the city clerk's office shall, as required by C.R.S. 12-48-107(5) (c), access information made available on the state licensing authority's website to determine the statewide permitting activity of the organization applying for the permit. The city clerk's office shall consider compliance with the provisions of C.R.S. 12-48-105(3), which restricts the number of permits issued to an organization within a calendar year to fifteen (15), before approving any application. Currently, applications for a special event permit must be filed, a minimum of, forty-five (45) days prior to the event to allow sufficient time for posting, public hearing, local approval and then state approval. Public hearings are conducted on first time applications, applications by those who have had prior compliance violations and when a written protest is filed with the city clerk.. Upon approval at the local level, the application is forwarded to the state for their approval. Special event permitting is a local issue that will not change with the adoption of this resolution. The only change will be that the state will not receive the application for approval, therefore reducing the turn around time for application processing. This proposed amendment to the licensing authority's rules of procedure align with Council's goal of Commerce City being a business friendly community.
