Call To Order Hearing Officer Ablao called the meeting to order at 10:03 a.m. 2. Approval of Minutes Min 17-41 Meeting Minutes of September 8, 2017 Hearing Officer Ablao approved the minutes as presented. 3. Public Hearings Pres 17-478 Retail Marijuana Cultivation Facility Application for Green Nimbus, LLC, to be located at 9690 Dallas St., Unit H Hearing Officer Ablao opened the the public hearing. Those entering their appearance were: Senior Assistant City Attorney Rachel Allen Richard Ming Le, applicant. Tina Scott, Oedipus Petitioning Company Hearing Officer Ablao swore in the applicant and petition company representative. Richard Le testified to the facility's operating plan, owners' experience and training, product transportation and odor mitigation. Andrew Hopkins, contractor, was sworn in and testified to the construction timeline. Dallas Stayton was sworn in and testified to his lack of experience in the marijuana business. Hunter Stayton was sworn in and testified to his experience in the marijuana industry. Tina Scott with Oedipus testified that the petition results were low, but favorable. In response to Attorney Allen's questions, Mr. Le testified to his prior criminal history. Public Input: Russ Atkinson, neighboring business, expressed concern with the parking situation challenges that have developed with the influx of marijuana businesses within the Commerce City Page 1 Marijuana Licensing Authority Meeting Minutes - Final September 15, 2017 development. There was no further testimony and the hearing officer closed the public hearing. Senior Assistant City Attorney Allen asked the hearing officer to consider adding conditions to licensure to address the applicants' lack of experience in the industry, the lack of familiarity with Commerce City ordinances and training and compliance with both state and local law. Hearing Officer made the following findings: The evidence presented does support the issuance of the license. At this time there is no restriction on the number of type of marijuana licenses in or near the neighborhood. Mr. Le's commission in his background application was not intentional and occurred over 20 years and there have been no violations since. The applicant is qualified and fit to conduct the type of business proposed. The license is approved with the following conditions: The satisfactory inspection by the police department within 90 days to determine compliance with the diagram submitted with the application. The satisfactory inspection by the building and fire departments within 90 days to determine compliance with their codes. Compliance with state marijuana code, rules, regulations and all municipal ordinances and regulations concerning the operation of a marijuana business. Proof of completion of compliance training through the state within 60 days. 4. Adjourn The meeting adjourned at 10:56 a.m. Commerce City Page 2
