Call To Order Hearing Officer Ablao called the meeting to order at 2:32 p.m. 2. Approval of Minutes Min 18-61 Minutes of March 16, 2018 Hearing Officer Ablao approved the minutes as written. 3. Show Cause Hearings Pres 18-161 Show Cause Hearing for the Medical Marijuana-Infused Product Manufacting License and the Retail Marijuana Products Manufacturer License of Starbuds MIPS, LLC, 9670 Dallas St. Units 5 & Hearing Officer Ablao stated the show cause hearing is for the following alleged violations: not obtaining a building permit, activities to occur indoors, releasing gas into the atmosphere and odor control. Brian Ruden, appeared on behalf of the licensee. He and the city have reached a stipulated agreement in that he will admit to violating International Fire Code Section 6105.2 (Releasing Gas into the Atmosphere) due to complaints from neighboring businesses and city inspector for bleeding gas tanks in January 2018, and violating Commerce City Revised Municipal Code 8-2310 (Odor Control) due to numerous complaints from neighboring businesses and city inspectors detecting marijuana odor outside the business and within adjoining premises on several occasions from June 5, 2018, to present. The stipulated penalty agreed to, by both the city and licensee, is a $30,000 fine paid within seven days of this hearing, successfully complete and pass city inspection for the proposed odor mitigation work no later than two months of the Authority's acceptance of the stipulation and a seven day suspension served in two parts consisting of three consecutive days and four consecutive days. Mr. Ruden stated he has engineers working on the odor mitigation plans and they should be completed by end of week. He asked that the suspension be served while the odor mitigation work is being done. Hearing Officer Ablao ordered the suspension to begin at 11:59 p.m. August 27, 2018, and end at 12:01 a.m. September 4, 2018. Other Business Pres 18-159 REQUEST FOR AN EXTENSION OF LICENSING CONDITIONS FOR THE RETAIL CULTIVATION FACILITY OF DEL MUNDO, LLC, 5305 VASQUEZ #101 Raymundo Michael Ubieta appeared on behalf of the applicant seeking an extension of the condition for licensure regarding successful inspections, He hopes to be wrapping up HVAC work and scheduling final inspections within the next four to six weeks. Hearing Officer Ablao granted an extension of licensure conditions for another 90 days. Pres 18-293 REQUEST FOR EXTENSION OF LICENSING CONDITIONS OF THE RETAIL MARIJUANA STORE OF C3D, C, DBA HIGHLINE, 5846 DAHLIA ST The licensee, represented by Attorney Dave Rodman, Registration #46389, and David Soucie, appeared before the Authority to request another extension to the conditions of licensure. Fire Department Representative John Lodge stated that the licensee may have to resubmit what was reviewed in 2017 because of all the delays.
