Roll Call Mayor Huseman not present Katelyn Memmer called roll. Present 4 - Board Member Chris Gronquist, Board Member David Brinkerhoff, Board Member Gene Leffel, and Alternate Board Member Robert Benzel Staff in Attendance: Sarah Geiger, Deputy City Attorney Jennifer Jones, Principal Planner Anita Riley, Principal Planner Nathan Chavez, Planner Tricia Mason, Community Development Manager Katelyn Memmer, Administrative Specialist Approval of Minutes: Min 22-31 Minutes of the September 08, 2020 Board of Adjustment Meeting Attachments: Minutes A motion was made by Brinkerhoff, seconded by Board Member Leffel, that this Minutes be approvedVOTE: Ayes: 2- Brinkerhoff and Board Member Leffel Abstentions: 2- Board Member Gronquist and Alternate Board Member Benzel Case(s): Pres 22-98 A-1758-H-22: Michael Martin, Omega Products International, is requesting the approval of a 14-ft. Height Exception for a 64-ft. bucket elevator and 55-ft. sand silos, for the property located at 6101 Dexter Street, zoned I-3 (Heavy Intensity Industrial District). The Height Exception review criteria can be found in Section 21-3220 of the Land Development Code Attachments: Staff Report V-Map Site Plan and Elevations Bucket Elevator Details Commerce City Page 1 Zoning Board of Adjustment Meeting Minutes - Final February 8, 2022 Sarah Geiger, Deputy City Attorney, introduced the case. Nathan Chavez, Planner, presented the case A-1758-H-22 and noted DRT recommendation of approval. Discussion from the board involved if approval would cover both 64' bucket elevator and the 55' silo, Planner, Nathan Chavez confirmed it would. And, if this approval is specific to the owner or with the land and would the owner need a bond to cover the structure if they leave the facility in the future. Sarah Geiger, Deputy City Attorney and Jennifer Jones, Principal Planner confirmed the approval is specific to the structure and not the owner. The board asked who is responsible for the sign posting on the property as it is laying on the ground. Jennifer Jones stated it is the applicant's responsibility. Seeing no further questions from the Planner, Chairman Leffel invited the applicant to speak. Mike Martin, Omega Products introduced himself and was available for questions. Answered a question about dust mitigation and air pollution, explained the sand is dried in a building and the dust remains indoors, sand is then transported via a tube like conveyer belt and is not exposed to the air. Applicant stated they will be getting the sand from several local places. Explained the sand is delivered wet in trucks and dumped in the back of the building to dry. Regarding the bond question, applicant has been in business for 50 years and doesn't plan on leaving but appreciates the question. Chairman Leffel asked if Applicant was comfortable moving forward with the vote as there is a member missing. Applicant confirmed he was okay with that. Seeing no further questions, Chairman Leffel invited the public to speak. Seeing no public comment, Chairman Leffel called for a motion. A motion was made by Brinkerhoff, seconded by Board Member Gronquist, that this Presentation be recommended for approvalVOTE: Ayes: 4- Board Member Gronquist, Brinkerhoff, Board Member Leffel and Alternate Board Member Benzel Action Items: Board Business: Next meeting should be next month.
