Roll Call Chairperson Brinkerhoff called the meeting to order at 5:30pm Present 7 - Board Member Benjamin Huseman, Board Member David Brinkerhoff, Board Member David Brinkerhoff, Board Member Chris Gronquist, Board Member David Brinkerhoff, Board Member David Brinkerhoff, and Board Member Joanne Hernandez Call to Order Present 4 - Board Member Benjamin Huseman, Board Member Chris Gronquist, Board Member Joanne Hernandez, and David Brinkerhoff Pledge of Allegience Approval of Minutes Min 23-184 MIN 23-184 June 13, 2023 Minutes Attachments: Minutes_6_13_2023 Minutes were called for an amendment to ensure that the attendance was listed correctly to reflect that Gene Leffel was in the meeting. Approval of the minutes were called. Ayes: 5- Board Member Huseman, Board Member Brinkerhoff, Board Member Gronquist, Board Member Brinkerhoff and Board Member Hernandez Case(s) A-1765-U-23 The applicant is requesting a use-by-permit for minor vehicle repair (Jiffy Lube Multi-Care) within the C-2 (General Commercial District) zoning Commerce City Page 1 Zoning Board of Adjustment Meeting Minutes - Final July 11, 2023 district, required per Land Development Code §21-5200. Attachments: BOA Report Vicinity Map Use-by-Permit Narrative Site Plan, Landscape Plan, & Elevations Neighborhood Meeting Summary Comment Letters City Attorney, Sarah Geiger, introduced the planner and the case for the meeting. City Planner, Matt Kowalski, presented the case. At this time, Acting Chairperson Brinkerhoff asked the board if they had question for the planning department, seeing none, he invited the applicant to speak. Samantha McAbee, Jiffy Lube, 66155 Parkway Dr., and thanked the board and staff for their time. McAbee presented the services that Jiffy Lube provides how they meet Commerce City requirements. At this time, Chairperson Brinkerhoff asked if there was any comments, seeing none, he noted that there were no electronic comments. Mayor Huseman called for a motion A motion was made by Board Member Huseman: "I move that we move forward" seconded by Board Member Gronquist, that this Presentation be recommended for approvalVOTE: Ayes: 3- Board Member Huseman, Board Member Gronquist and Board Member Hernandez A-1768-U-23 The applicant is requesting a use-by-permit to allow for a religious institution within the R-2 (Single-Family Attached Residential District) zoning district, required per Land Development Code §21-5200. Attachments: BOA Report Vicinity Map Use-by-Permit Narrative Site Plan Comment Letters City Attorney, Sarah Geiger, introduced the planner and the case for the meeting. City Planner, Matt Kowalski, presented the case. There was conversation between the board renewal of Use-By Permit. At this time Acting Chairperson Brinkerhoff called the applicant. Paula Stueve, Liberty Bell Properties, 210 S 5th Ave., Brighton, CO 80601 presented her case and had conversation on parking ratio of operations and for special events. The board touched on the South Adams County Fire Station No. 21 being close to their property but it is not forecasted to be used. Also touched on noise ordinances. Commerce City Page 2 Zoning Board of Adjustment Meeting Minutes - Final July 11, 2023 Yung Hong 6981 Dexter St., Commerce City, CO 80022, voiced concerns on the parking count, Fire Department Fire Department operations, and special event logistics in the street. The board further talked of the vacancy of the building, potential hours of operations, and parking concerns. Board asks for a continuance of the meeting so that they can look at the proposed parking condition. Seeing no further comments, Acting Chairperson Brinkerhoff called for a vote. Chris Gronquist motioned: "I move that the Board of Adjustment continue the public hearing of the requested use by permit for the property located on 6951 Dexter St containing case A-1768-U-23 to next regularly scheduled Board of Adjustment hearing on August 08, 2023 to come up with a parking plan between staff and the applicant.'
