BOROUGH OF CONWAY COUNCIL REGULAR MEETING MINUTES Council Chambers, 801 First Avenue, Conway, Pennsylvania December 21, 2022 MEETING was called to order at 7:01 p.m. with Mr. Tim Antoline presiding. The following members of Council and officials of the Borough were present: Mr. Tim Antoline, Mr. John Antoline, Mrs. Hertneky, Mr. Scott Levenson, Mr. Aaron Patrick, Mrs. Patty Then, Mayor Debbie Rose, Borough Secretary Margie Nelko, Borough Solicitor Kate Diersen. ABSENT: Mr. Joe Bohach PLEDGE OF ALLEGIANCE PUBLIC COMMENT (Agenda Items): None RECOGNITION OF VISITORS: Mark Hertneky of 1436 Second Avenue FINANCE & ADMINISTRATION COMMITTEE REPORT: - Mrs. Then, Chairperson of the Finance and Administration Committee, presented Council with updates regarding the following issue(s). 1. List of Bills - A list of expenditures for the time period of December 8, 2022 through December 21, 2022, in the amount of $112,967.62 from the General Fund, and expenditures in the amount of $10,338.27 from the Water & Sewer Fund were presented to Council for review. After some review, the motion by Mrs. Then, seconded by Mr. Levenson to approve the List of Bills as presented was unanimously carried. 2. Budget Reports – These reports were ordered received and filed. 3. Treasurer Report – These reports were ordered received and filed. After some review and discussion regarding the Water Deposit Fund, a motion from Mr. J. Antoline, seconded by Mr. Levenson to transfer the Water Deposit Fund to the Water & Sewer Fund and then close the Water Deposit Fund was unanimously carried. 4. Swift 911 – There was discussion regarding the Swift 911 System being phased out and replaced with Rave. PARKS & RECREATION COMMITTEE REPORT: Mrs. Hertneky, Chairperson of the Parks and Recreation Committee, presented Council with updates regarding the following issue(s). 1. Gratty Park Swing Replacement – A new handicap swing was purchased, in the amount of $505.00, to replace the broken one at Gratty Park. The broken swing is to be removed and the new swing will be put up in the Spring. PLANNING, ZONING & ORDINANCE COMMITTEE: – No Report. Mr. T. Antoline thanked Mr. Patrick for his service to the Conway Borough Council. PUBLIC SAFETY COMMITTEE REPORT: No Report. PUBLIC RELATIONS COMMITTEE REPORT: Mr. Levenson, Chairperson of the Public Relations Committee, presented Council with updates regarding the following issue(s). Page 01 12-21-2022  1. Police Regionalization Update – An update regarding meeting discussions was present to Council. 2. Hiring of Two (2) Full-Time Police Officers – There was discussion regarding the recent Civil Service Exams for the purpose of hiring new full-time police officers. After some review and discussion, the motion of Mr. Levenson, seconded by Mr. J. Antoline to hire Mr. Donald Dobson, Jr. and Mrs. Amanda Stitt as Full-Time Police Officers effective January 01, 2023 was unanimously carried. There was discussion regarding departments having a hard time keeping part-time police officers and how the Borough could retain the part-time police officers that we have on staff. After some discussion, the motion Mr. Levenson, seconded by Mr. Patrick to increase the hourly rate for Part-Time Police Officers from $22.00 per hour to $25.00 per hour effective January 01, 2023 was unanimously carried. PUBLIC WORKS COMMITTEE REPORT: – No Report. There was discussion regarding the need to purchase four (4) fire hydrants. It was noted that a motion was made at the Workshop Meeting of December 7, 2022, to approve the purchase of two (2) fire hydrants. There was discussion regarding the liquid manganese (slicer) being used on the roads at night to help with snow/ice. It was noted that with the holiday approaching someone should be on standby. MAYOR’S REPORT: Mayor Rose presented Council with updates regarding the following issue(s): 1. Police Report – This report was ordered were received and filed. Mayor Rose left the meeting at this time (7:55 p.m.) ENGINEER’S REPORT: 1. PSAB (PA Small Water and Sewer Program) Grant – The Borough Secretary presented an overview and stated that the grant has been submitted before the due date. SOLICITOR’S REPORT: The Borough Solicitor noted that the 2023 Tax Anticipation Note Opinion Letter was being worked on. CORRESPONDENCE: 1. Act 205 2022 Distress Determination Score Notice – This document was ordered received and filed. 2. Harshman CE Group, LLC – Monthly Report –This document was ordered received and filed. 3. Norfolk Southern Railyard Sample Analysis Report (Dated 08/22/2022) – This document was ordered received and filed. 4. Moody & Assoc. – PennEnergy Water Source Notice PER B50 7H (Economy) – Dated 12/06/2022 – This document was ordered received and filed. OLD BUSINESS: NEW BUSINESS: 1. 1st Response Medical Service Letter-Dated 12/12/2022 – This matter will be discussed in Executive Session. Page 02 12-21-2022 2. Revised 2023 Non-Uniform Minimal Municipal Obligation (MMO) – The Borough Secretary presented an overview of this matter. After some review, the motion of Mr. Levenson, seconded by Mr. Patrick to approve the Revised 2023 Non-Uniform MMO as presented by PMRS was unanimously carried. 3. 2021 Liquid Fuels Audit – After some review and discussion regarding the audit results, this matter was ordered received and filed. 4. Advertise 2023 Meeting Dates - The Borough Secretary presented Council with a draft of the advertisement for the 2023 Council and Committee Meeting Dates. After some review, a motion of Mr. J. Antoline, seconded by Mrs. Hertneky to approve the advertising of the 2023 Meeting Dates was unanimously carried. 5. 2023 Budget Adoption – The Borough Secretary verified that the advertising and viewing availability requirements were completed as required. Afte some review and discussion, the motion of Mr. Levenson, seconded by Mrs. Then to adopt the 2023 Budget as presented was unanimously carried. 6. Ordinance No. 567 – Establishing the 2023 Tax Rate – An Ordinance levying and valorem real estate taxes and fixing the tax rates for the fiscal year 2023 was presented to Council for review. The Borough Secretary verified that Ordinance No. 567 was adequately advertised under the Borough Code. After some review and discussion, a motion Mr. J. Antoline, seconded by Mr. Patrick to adopt Ordinance No. 567 was unanimously carried. 7. Resolution No. 2022-16 - A Resolution relative to the establishment and maintenance of employees’ pension, annuity, insurance and benefit fund or funds, to amend certain provisions of the Pension Plan or program applicable to the Police Employees by reducing the contribution rate for 2023 was presented to Council for review. After some discussion, the motion of Mr. Patrick, seconded by Mrs. Then to adopt Resolution No. 2022-16 was unanimously carried. 8. Resolution No. 2022-17 – A Resolution electing to secure a Tax Anticipation Note (TAN), in the amount of $200,000.00 was presented to Council for consideration. After some discussion, the motion of Mr. J. Antoline, seconded by Mr. Levenson to adopt Resolution No. 2022-17 was unanimously carried. 9. Resolution No. 2022-18 – A Resolution requesting a PA Small Water and Sewer Program Grant to be used for the 10th Street and 3rd Avenue Waterline Replacement Project was presented to Council for review. After some discussion, the motion of Mr. Levenson, seconded by Mrs. Then to adopt Resolution No. 2022-18 was unanimously carried. 10. Resolution No. 2022-19 – A Resolution requesting a PA Small Water and Sewer Program Grant to be used for the 11th Street Waterline Replacement Project was presented to Council for review. After some discussion, the motion of Mr. Patrick, seconded by Mr. Levenson to adopt Resolution No. 2022-19 was unanimously carried. 11. Resolution No. 2022-20 – A Resolution authorizing a three (3%) percent Water Rate increase beginning the first quarter of 2023 was presented to Council for review. After some discussion, the motion of Mr. J. Antoline, seconded by Mr. Levenson to adopt Resolution No. 2022-20 was unanimously carried. 12. Resolution No. 2022-21 - A Resolution authorizing a ten (10%) percent Sewer Rate increase beginning the first quarter of 2023 was presented to Council for review. After some discussion, the motion of Mr. J. Antoline, seconded by Mr. Levenson to adopt Resolution No. 2022-21 was unanimously carried. 13. Beaver County Humane Society After Hours Key Renewal – After some review and discussion the motion of Mr. Levenson, seconded by Mr. J. Antoline to approve the agreement for the year 2023 was unanimously carried. Page 03 12-21-2022  14. Letter of Interest for Council Seat Vacancy – A letter of interest was received for the vacancy seat on Council and presented for consideration. OTHER BUSINESS: None. PUBLIC COMMENT: None. EXECUTIVE SESSION: Mr. T. Antoine requested Council go into Executive Session regarding a potential litigation matter at 8:23 p.m., as per the motion of Mr. Levenson, seconded by Mr. Levenson. On the motion of Mr. J. Antoline, seconded by Mr. Patrick to reconvene at 8:51 p.m. was unanimously carried. There being no further business, the motion of Mr. J. Antoline, seconded by Mrs. Then to adjourn the meeting at 8:52 p.m. was unanimously carried. Margie L.
