BOROUGH OF CONWAY COUNCIL EMERGENCY MEETING MINUTES Council Chambers, 801 First Avenue, Conway, Pennsylvania October 10, 2023 MEETING was called to order at 6:00 p.m. with Mr. Tim Antoline presiding. The following members of Council and officials of the Borough were present: Mr. Tim Antoline, Mr. Joe Bohach, Mrs. Jocelyn Hertneky, Mr. Mark Hertneky, Mr. Scott Levenson, Mrs. Patty Then, and Borough Secretary Margie Nelko. ABSENT: Mr. John Antoline, Mayor Debbie Rose PLEDGE OF ALLEGIANCE RECOGNITION OF VISITORS: None NOTATION: Council disclosed that a special executive session (via Microsoft Teams/Meeting App) was held on October 5, 2023, to discuss a personnel matter. HIRING OF FULL TIME PUBLIC WORKS – The Public Works Committee has conducted interviews with the top candidates and is prepared to make a recommendation to Council. There was some discussion on how many candidates should be hired and the costs associated with each hiring option presented. After some review and discussion, it was the consensus of Council to hire a Public Works Supervisor. The top candidate was approached but he dropped declined due to insurance coverage by reaching out to Mr. J. Antoline. There was discussion regarding the next top three (3) candidates and their qualifications as per the resumes submitted. Only one (1) candidate has managerial and Microsoft experience. The new hire would be on a ninety (90) day probation as per the union contract. There was discussion regarding the possibility of hiring one candidate could portray nepotism by the residents. After the notation of Mr. J. Antoline’s recommendation as the Chairperson of the Public Works Committee, a motion by Mr. Bohach, seconded by Mr. Levenson to hire Nathan Welton as the Public Works Supervisor was made. A roll call vote was taken of the members of Council present. The motion tied after receiving three (3) affirmative votes and three (3) negative votes of all members of Council present. After reviewing Roberts Rules, the motion Failed due to the lack of a tie break. Mr. T. Antoline – Yes Mr. Bohach – Yes Mrs. Hertneky – No Mr. Hertneky – No Mr. Levenson – Yes Mrs. Then – No There was some concern regarding whether Mr. Hertneky and Mrs. Hertneky should have participated in the vote for the motion made. Mrs. Hertneky stated that after a discussion with the State Ethics Committee she was informed that they must abstain from voting on anything that would provide a gain for Mr. S. Hertneky. Mrs. Hertneky stated that she would abstain from the vote on the motion made if that was Council’s decision, however, it should not be necessary. It was determined that Mr. Hertneky and Mrs. Hertneky would not need to abstain from the vote on the motion made. Mr. Levenson made a motion to hire Mr. S. Hertneky as the Public Works Supervisor and then withdrew the motion after some discussion of Council. Council discussed and decided to request the three (3) candidates to meet with Council in Executive Session prior to the October 18, 2023, Regular Meeting of Council. The candidates should be scheduled every fifteen (15) minutes beginning at 6 p.m. Page 01 10-10-2023 There being no further business, the motion of Mr. Levenson, seconded by Mr. Bohach to adjourn the meeting at 6:56 p.m. was unanimously carried.
