BOARD OF ZONING APPEALS MINUTES APRIL 10, 2008 The Board of Zoning Appeals met on Thursday, April 10, 2008, at 5:15 p.m. in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Larry Burgess, Tracy Cody, Kay Detwiler, Jane Flatt, and Sid Gilbreath. STAFF PRESENT: James Mills and Jayne Barns. OTHERS PRESENT: Frank Ross and Lindsay McReynolds. CONSIDER FOR APPROVAL THE MINUTES OF FEBRUARY 14, 2008. Sid Gilbreath made the motion to approve the minutes of February 14, 2008. Tracy Cody seconded the motion and the motion carried unanimously. APPROVED. CONSIDER A REQUEST FOR VARIANCES IN THE FRONT, SIDE, AND REAR YARD SETBACK REQUIREMENTS ON THE PROPERTY LOCATED AT 764 EAST LOWELAND ROAD. REQUEST SUBMITTED BY FRANK AND CAROLYN ROSS. James Mills stated Mr. Frank Ross has submitted a request for variances from the building setback requirements for his property located at 764 East Loweland Road. The property is identified as Parcel 31.00 on Map 40N, Group B and is zoned as RS-15, Single Family Residential. Mr. Ross is requesting variances to reduce the front, side and rear building setback requirements of the RS-15 District for the purpose of expanding his residence. The RS-15 District requires a minimum front setback of 30 feet, a minimum side setback of 10 feet, and a minimum rear setback of 25 feet. The submitted petition indicates that reductions of up to five (5) feet from the front setback, two (2) inches from the side setback on one side, and ten (10) feet from the rear setback are needed to complete the desired expansion. A site plan depicting the location and scale of the planned expansion and proposed variances has also been submitted. The triangular shape of the lot on which the existing residential structure is located limits the buildable area. Also the original structure was placed at an odd angle which restricts the options for expansion. The additions proposed within the required setbacks are minimal and the expansion will not result in a structure out of character for the surrounding neighborhood. The requested variances appear to meet the general standards necessary for approval as specified in Section 233.9D (3) of the Zoning Code. Staff recommended approval of the requests based on the submitted site plan and also recommended that the variance for the side setback, located on the north side of the lot, be increased from 2” to 1’. BOARD OF ZONING APPEALS 2 APRIL 10, 2008 Tracy Cody made the motion to approve the variances based on staff’s recommendation. Kay Detwiler seconded the motion and the motion carried unanimously.
