BOARD OF ZONING APPEALS MINUTES OCTOBER 8, 2009 The Board of Zoning Appeals met on Thursday, October 8, 2009, at 5:15 p.m. in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Paul Bonner, Kay Detwiler, and Sid Gilbreath. MEMBER ABSENT: Tracy Cody and Jane Flatt. STAFF PRESENT: James Mills, Jayne Barns, and Ken Young. OTHERS PRESENT: Kenneth Price. CONSIDER FOR APPROVAL THE MINUTES OF AUGUST 13, 2009. Paul Bonner made the motion to approve the minutes of August 13, 2009. Kay Detwiler seconded the motion and the motion carried unanimously. APPROVED. CONSIDER A REQUEST FOR A VARIANCE TO REDUCE THE FRONT SETBACK REQUIREMENT IN A RS20 ZONE FROM 30 FEET TO 20 FEET FOR THE CONSTRUCTION OF A GARAGE ON THE PROPERTY LOCATED AT 1021 WATAUGA ROAD. REQUEST SUBMITTED BY KENNETH PRICE. James Mills stated that Mr. Kenneth Price has submitted for approval a request for a variance to reduce the front setback requirement for property identified as Parcel 6.00 on Tax Map 67A, Group A and located at 1021 Watauga Road. The subject property is zoned as RS-20, Single Family Residential, and consists of approximately 0.56 acre. A single family residence is currently located on the property. The variance request is for a reduction of the required front setback off Watauga Road to allow the construction of a detached garage. The minimum front setback in the RS-20 District is 30 feet and the submitted request is for a reduction to 20 feet. The subject property slopes significantly from front to rear. Photographs are included for your review. The existing residence, which was built prior to the annexation of the property and prior to any zoning requirements, is located approximately 16 feet from the front property line. The location of the residence appears to have been determined by the terrain. The topography of the property does create a significant and particular hardship and there appears to be no other feasible location on the property to locate the detached garage. In the opinion of the Planning Department the criteria specified by the Zoning Code for granting a variance are met in this case. Staff recommended approval of the request. BOARD OF ZONING APPEALS 2 OCTOBER 8, 2009 Paul Bonner made the motion to approve a 10’ Variance in the front yard setback requirement on the property located at 1021 Watauga Road. Kay Detwiler seconded the motion and the motion carried unanimously. APPROVED 10’ VARIANCE IN THE FRONT YARD SETBACK REQUIREMENTS. ADJOURNMENT: 5:21 P.M.
