MINUTES
MARCH 8, 2018
The Board of Zoning Appeals met on Thursday, March 8, 2018, at 5:15 p.m. in the Council
Chambers, 45 E. Broad Street, Cookeville, Tennessee.
MEMBERS PRESENT: James Dial, Elwood Ervin, Jane Flatt, Sid Gilbreath, and Nancy
Bohannon.
STAFF PRESENT: James Mills, Jayne Barns, and Jon Ward.
OTHERS PRESENT: Joe & Veronica Spiecker, and Lauren Shibakov.
CONSIDER FOR APPROVAL THE AGENDA AS SUBMITTED. James Dial made the
motion to approve the agenda as submitted. Elwood Ervin seconded the motion and the
motion carried unanimously. APPROVED.
CONSIDER FOR APPROVAL THE MINUTES OF FEBRUARY 8, 2018. James Dial
made the motion to approve the minutes of February 8, 2018. Elwood Ervin seconded the
motion and the motion carried unanimously. APPROVED.
CONSIDER A REQUEST FOR A SPECIAL EXCEPTION TO ALLOW AN
ACCESSORY DWELLING UNIT FOR OWNER OCCUPANCY ON THE
PROPERTY LOCATED AT 1765 LEE SEMINARY ROAD. REQUEST SUBMITTED
BY LAUREN SHIBAKOV ON BEHALF OF JOE & VERONICA SPIECKER. Jon
Ward stated that Lauren Shibakov with Lauren Engineering Services, on behalf of Joe and
Veronica Spiecker, submitted a request for a special exception to allow an accessory dwelling
unit for a permitted principal use on property located at 1765 Lee Seminary Road.
The subject property is identified as Parcel 121.00 on Tax Map 065, and is zoned as CI,
Commercial-Industrial Mixed Use. Properties located to the south, east, and north are also
zoned as CI, Commercial-Industrial Mixed Use. The property to the west is zoned RS 20,
Single Family Residential.
Mr. and Mrs. Spiecker have proposed to construct a series of self-service storage buildings
and an office for the business at the Lee Seminary Road location. The proposed mini-
warehouses are a permitted use in the CI Commercial-Industrial Mixed Use District. Also,
the owners have proposed to construct a dwelling unit that they will reside in on the property.
Accessory dwelling units on the same premise and in connection with the permitted principal
use are permitted on appeal in the CI District meeting the following requirements.
1. Shall be for the occupancy by the owner(s) or employee(s) of the principal use,
2. Off-street parking for each dwelling unit shall be provided so as to meet the
requirements of Section 205 of this Zoning Code,

3. A minimum square footage per dwelling unit of 650 square feet for a one-bedroom unit,
800 square feet for a two-bedroom unit, and 1000 square feet for a three bedroom unit
shall be provided,
4. All municipal building and fire codes shall be adhered to, and
5. No more than two (2) accessory dwelling units shall be permitted.
The property owners have indicated that they will reside in the dwelling unit to collect rent,
run the business, and monitor the property. A site plan for the project further indicates the
proposal will meet minimum square footage requirements for the dwelling unit. Off-street
parking is provided meeting the requirements of the Zoning Code. The property does not have
access to sewer service at this time. The proposed accessory dwelling unit will require land
area for installation of a subsurface sewage disposal system (septic system).
Additionally the proposal will require screening as established in Section 208 of the Zoning
Code.
In the opinion of the Planning Department all established conditions can be met and the
property appears to be suitable for the proposed use.
Staff recommended approval of the request, subject to compliance with all applicable
provisions of the Zoning Code.
Lauren Shibakov stated that they will be able to get septic service.
Elwood Ervin made the motion to approve the Special Exception to allow an accessory
dwelling unit for owner occupancy on the property located at 1765 Lee Seminary Road.
James Dial seconded the motion and the motion carried unanimously. APPROVED
SPECIAL EXCEPTION TO ALLOW AN ACCESSORY DWELLING UNIT FOR
OWNER OCCUPANCY.
