The Board of Zoning Appeals met on Thursday, September 14th, 2023, at 5:15 p.m. in the Council
Chambers located at 45 E. Broad Street, Cookeville, Tennessee.

Consider for Approval the Agenda as Submitted. Elwood Ervin made the motion to approve
the agenda as submitted. Connie McCormick seconded the motion, and the motion was carried
unanimously. Approved.
Consider for Approval the Minutes of August 10th, 2023. Elwood Ervin made the motion to
approve the minutes of August 10th, 2023 as submitted. Connie McCormick seconded the motion,
and the motion was carried unanimously. Approved.
Consider a request for a variance to reduce the fence height requirements from 60 inches to
56.5 inches for a total variance of 3.5 inches and an administrative review of the Chief
Building Official’s determination that an existing perimeter fence does not meet the
requirements for a swimming pool fence established in the Zoning Code Section 206,
Additional Standards, Section 206.25 Swimming Pools, 206.25B, for the property located at
328 South Dry Valley Road (Tax Map 052, Parcel 027.00). Request submitted by Lee
Williams. This item was postponed at the July 13th Board of Zoning Appeals meeting. Mr.
Christopher Phillips stated that the Petitioner has requested this item be postponed until the
October 12th Meeting if necessary.
Elwood Ervin made the motion to postpone the request until the October 12th Board of Zoning
Appeals meeting if necessary. Connie McCormick seconded the motion, and the motion was
carried unanimously. Approved.
Consider a request for a variance to reduce the front yard setback from 30 feet to 12 feet for
a total variance of 18 feet and to reduce the rear yard setback from 20 feet to 16 feet for a
total variance of four (4) feet to allow an addition to an existing nonconforming structure on
the property located at 715 Mahler Avenue (Tax Map 053-B, Group E, Parcel 009.00).
Request submitted by Aaron Bernhardt on behalf of Broad Street Properties. Mr. Christopher
Phillips stated that Mr. Aaron Bernhardt, on behalf of Broad Street Properties, has submitted a
variance request to reduce the front yard setback from 30 feet to 12 feet for a total variance of 18
feet and to reduce the rear yard setback from 20 feet to 16 feet for a total variance of four (4) feet
to allow an addition to an existing nonconforming structure on the property located at 715 Mahler
Avenue.
Analysis: The subject property is identified as Tax Map 053B, Group E, Parcel 009.00 and
contains approximately 0.21 acres (9,147.6 square feet). The property is zoned UNV, “University.”
An existing nonconforming structure is located on the subject property.
Mr. Bernhardt has submitted a site plan showing a proposed addition to the existing
nonconforming structure. The building area within required setbacks for the current lot is
approximately 840 square feet. The existing nonconforming structure is approximately 1,890
square feet. The proposed addition will add approximately 300 square feet to the structure. The

existing building is nonconforming to the setback requirements for the UNV Zoning District. The
UNV District requires a 30-foot front setback, 10-foot side setback, and 20-foot rear setback.
The existing structure currently encroaches approximately 12-feet into the rear yard setback at the
northeast corner and approximately 16-feet into the front yard setback at the southwest corner.
The proposed addition will be located along the southern portion of the existing structure. The
addition would encroach into the rear yard setback approximately four (4) feet at the existing
structure and approximately two (2) feet at the proposed southeastern corner and would encroach
into the front yard setback approximately 18-feet at the southwest corner and 16-feet at the edge
of the existing building. The addition will not encroach into the required side yard setback at the
southern property line.
A legal nonconforming structure is a structure that existed prior to the establishment of zoning
regulations to which the structure does not comply. Under the provisions of Tennessee Code
Section 13-7-208, nonconforming uses are allowed to remain in perpetuity provided they do not
cease operation for a period of at least 30 consecutive months. They also have the right to expand
on existing property provided there is enough space to meet the area requirements (setbacks) of
the zoning district.
In the opinion of the Planning Division, the irregular shape of the property presents a hardship.
The existing property and structure is nonconforming to many requirements of the Zoning Code,
including the front and rear setback requirements. The proposed addition does not encroach into
the required 10-foot side yard setback requirement. The proposed addition will not be detrimental
to the public welfare or injurious to other property in the area.
Recommendation: Approval of the variance request.
Mr. Elwood Ervin asked if the property is changing uses.
Mr. Jon Ward replied yes, it is conforming to the University Zoning District.
Elwood Ervin made the motion to approve the variance request as recommended by staff. Nancy
Bohannon seconded the motion, and the motion was carried unanimously. Approved.
Consider a request for a variance to reduce the rear yard setback from 20 feet to 10 feet for
a total variance of 10 feet for a proposed accessory structure located at 255 East 8th Street
(Tax Map 040-N, Group J, Parcel 001.00). Request submitted by Joshua Seabold. Mr.
Christopher Phillips stated that Mr. Joshua Seabold has submitted a variance request to reduce the
rear yard setback from 20 feet to 10 feet for a total variance of 10 feet for a proposed accessory
structure located at 255 East 8th Street.
Analysis: The subject property is identified as Tax Map 040-N, Group J, Parcel 001.00 and
contains approximately 0.46 acres. The property is zoned RS-10, “Single-Family Residential.” An
existing single-family dwelling unit is located on the subject property. The request was submitted
to allow for the construction of a new two (2) story garage and to limit the cutting of the existing
established trees and landscaping, per the petitioner’s request.
Mr. Seabold has submitted a site plan showing a proposed new garage located in the southwest
corner of the subject property. The proposed garage is sited approximately 10 feet into the required
20-foot rear setback line. The proposed two (2) story garage consists of approximately 1,872
square feet. Section 204.8G of the Zoning Code states,
“In the RS-20, RS-15, RS-10, RS-5, and RD Districts, accessory structures less than four
hundred (400) square feet in size may be located no closer than five (5) feet from and rear

property line and any side property located to the rear of the principal structure. In all other
districts accessory structures shall meet the setbacks required for the principal structure.”
The proposed garage is required to meet the 20-foot rear setback requirement of the RS-10 District.
The request to reduce the rear setback requirement would allow the existing established trees and
landscaping to remain. A 10-foot reduction in the 20-foot setback would represent a variance of
50 percent.
Section 233.9D, Section 3 Variances, states that granting a variance requires the following criteria
to be met:
I. The particular physical surroundings, shape, or topographic conditions of the specific
property involved would result in a particular hardship upon the owner as distinguished
from a mere inconvenience, if the strict application of this Zoning Code were carried
out.
In the opinion of the Planning Department, no apparent hardship is present on the subject property
to warrant a variance. No topographic constraints or other natural constraints are present on the
property. However, the Board of Zoning Appeals has historically considered variances up to 10
percent where no hardship is present. A 10 percent reduction in the rear yard setback for the subject
property would constitute a two (2) foot reduction.
Recommendation: Denial of the variance request.
David Dickerson stated that he lives right next door to the property in question and he fully
supports their request. He believes that it would benefit the neighborhood to build the garage and
keep all of the trees. He further stated that no one would ever see it, so no one would know it’s
there and wouldn’t have an impact on the neighborhood. He stated that the neighborhood supports
the request as it gives more privacy for all neighbors.
Joshua Seabold, petitioner, stated that he doesn’t expect much of anything and just wanted to keep
building as far away from 8th street as possible. His hardship would be cutting down the historic
magnolia tree. He stated that he would try to not cut tree down with either decision but is afraid of
having to cut it down. He believes that the request isn’t disruptive and won’t be seen from 8th
Street.
Mr. Ward stated that Mr. Seabold has submitted plans to the Historic Board and the suggestion of
the guidelines is to keep façade of historic homes.
Mr. Seabold stated that he wants to avoid cutting tree at all costs.
Mr. Dickerson stated that it would make his house better to not have any fences and have trees
everywhere.
Mr. Ervin stated that it is difficult to grant a 50% variance and this sets a precedent for all requests
moving forward.
Mr. Dickerson stated that in this case, it would lessen changing the neighborhood by building
garage in the far corner.
Mr. James Dial made the suggestion to table or postpone this request to see if Mr. Seabold is going
to lose the tree and then bring it back before board once the distance is figured out.
Mr. Ward stated that in order to do that, construction will have to start with footers so it would be
difficult to move.
Mr. Ervin asked if an engineer could come up with other options or layouts.

Mr. Seabold asked for what the Board wants but if it is not possible then they would like as much
of a variance that they can have.
Mr. Ervin stated that he can’t vote to grant this the way it is presented right now. He has to find
out a way to place it on property to keep magnolia tree.
Mr. Ward asked if a 5-foot variance would be better than a 10-foot variance.
Mr. Seabold stated that he doesn’t know what to ask for in specifics of modifying the request.
Mr. Ervin stated that he has things on his side for this request.
Mr. Dickerson stated that his situation is unique as his family is in a trust so his property next to
the petitioners can only be passed down to his family and isn’t just a property owner. His family
is in support of request and in this unique situation to hide the garage in the back corner, no one
will know it’s there.
Mr. Ervin made a motion to deny the request as submitted but grant a variance of up to 25% based
on the fact that it is cornered by two streets and is under approval of the Historic Commission.
Connie McCormick seconded the motion and the motion carried unanimously. Approved.
Consider a request for a special exception to allow a portion of the on-premises parking for
property located at 1370 Interstate Drive (Tax Map 066, Parcel 058.06) to be located off-
premises at 1360 Interstate Drive (Tax Map 066, Parcel 058.08). Request submitted by
Andrea Gonzalez on behalf of Chick-Fil-A. Mr. Christopher Phillips stated that Ms. Andrea
Gonzalez, on behalf of Chick-Fil-A, has submitted for approval a special exception request to
allow a portion of the required on-premises parking for property located at 1370 Interstate Drive
to be located off-premises at 1360 Interstate Drive.
Analysis: The subject property is identified as Tax Map 066, Parcel 058.06 and contains
approximately 1.26 acres. The property is zoned CG, “General Commercial.” An existing drive-
thru restaurant is located on the subject property.
Ms. Gonzalez has submitted a site plan on behalf of Chick-Fil-A to open a second drive-thru lane.
To have two (2) lanes, the restaurant will have to remove a total of 13 of the 23 parking spaces
located on the western side of the property. The new drive-thru lane will leave a total of 41 spaces
on the existing property.
Section 205.8D of the Cookeville Zoning Code requires drive-thru restaurants to provide one (1)
parking space per employee based on the largest work shift, plus one (1) space per three (3) seats
of capacity in on-site dining. Drive thru lanes must have a stacking length to accommodate 15
vehicles. Based on the provided calculations, Chick-Fil-A requires a total of 52 parking spaces
(110 seats / 3 = 36 spaces and 16 employees = 16 spaces 36+16=52 total spaces).
The proposed new drive-thru lane will reduce the on-premises parking to 41 spaces, leaving the
establishment 11 spaces short of the required parking. Ms. Gonzalez has submitted a parking
agreement with McCallister’s Deli, located on the adjacent property at 1360 Interstate Drive (Tax
Map 066, Parcel 058.08) that would allow Chick-Fil-A to use a total of 15 parking spaces within
the McCallister’s parking lot.
Section 205.4 of the Zoning Code provides: “Off-Premises Parking (Non-Residential Uses) - If
the required parking spaces for a non-residential use cannot be provided on the same lot as the
principal use, the Board of Zoning Appeals may, as a Special Exception, permit such spaces to be
located on other property, provided the following conditions are met:

205.4A The property shall be located within four hundred (400) feet of the principal use as
measured from the nearest point of the off-premises parking lot to the nearest point of the
building, structure or use served by such parking lot.
205.4B Such off-premises parking spaces are located within a zoning district which would
permit the use to which such parking is accessory.
205.4C Such off-premises parking spaces shall not exceed fifty (50) percent of the required
parking.
205.4D If such off-premises parking spaces are not in the same ownership as the use being
served by said parking spaces, then a duly executed and acknowledged written agreement
between the owner of the off-site parking area and the owner of the use shall be submitted to
the Building Official. Said agreement shall assure the continued availability and usability of
the off-premises parking for as long as required by the use and shall be recorded at the expense
of the applicant with the Putnam County Register of Deeds.
The proposed off-premises parking is also located within the CG, “General Commercial” zoning
district. The off-premises parking spaces are less than 50 percent of the required parking and are
located within 400 feet of the principal use. The submitted agreement is a duly executed and
acknowledged written agreement. The agreement assures the availability and usability of the off-
premises parking spaces through August 30, 2036, and can be extended for up to three (3)
additional five (5) year terms (through August 30, 2051). The proposed off-premises parking
spaces would bring the total number of on- and off-premises parking spaces to 56 spaces. The
agreement would need to be recorded with the Putnam County Register of Deeds to meet the
requirements of the Zoning Code.
The Planning Division has confirmed that the McCallister’s property has a parking surplus of 21
parking spaces (109 total spaces on site, 88 required).
The Planning Division has concerns with this proposal. From the submitted parking agreement,
Chic-Fil-A has had an agreement with McAllister to use 15 off-premises parking spaces since
September 6, 2021. Even with access to these additional parking spaces, it appears the current
peak time parking demand for Chic-Fil-A exceeds the available parking. This proposal would
eliminate 13 total parking spaces, which would add to the parking deficit. The adjacent property
to the west that is the location of Golden Corral, has erected signs stating, “private parking only,
unauthorized vehicles will be towed at the vehicle owner’s or operator’s expense, towing enforced
at all times”. Although it appears the special exception request to allow off-premises parking meets
the requirements of the Zoning Code, approval could have negative impacts on adjacent properties.
If adjacent properties have concerns with the proposal, additional measures could be taken to
eliminate onsite dining capacity to lessen parking demand.
Recommendation: Approval of the special exception subject to consideration of additional
measures to alleviate parking demand if determined necessary by the Board of Zoning Appeals,
subject to recording the parking agreement with the Register of Deeds
Mr. Dial asked if the offsite parking spaces are designated for employees.
Ms. Andrea Gonzalez stated that it can be set that way but she is not sure if it is.
Mr. Dial stated that the customers won’t know that they can park in the McAllister’s parking lot.

Ms. Gonzalez stated that the whole reason for the removal of parking and the biggest issue is that
most Chic-Fil-A’s have a drive thru and the reason is for adding second lane. The main point is to
alleviate traffic flow and prevent traffic flowing out onto the main road.
Mr. Ervin asked if this request would help prevent cars from looping around the building.
Ms. Gonzalez stated that this definitely should help.
Mr. Ward asked Ms. Gonzalez if the 16-employee number is accurate.
Ms. Gonzalez stated that that is the number provided by Chic-Fil-A.
Mr. Ward stated that this location causes traffic issues and neighboring businesses have issues
with people parking on their lots.
Mrs. McCormick asked of the new row of parking includes the handicap spaces.
Ms. Gonzalez stated that they are moving the ADA parking to the north of the building.
Mr. Ward asked how many spaces are proposed on the west.
Ms. Gonzalez stated that there are 10 spaces on the west side and 23 spaces on the east side.
Mr. Ward asked if they plan on keeping all interior dining.
Ms. Gonzalez responded yes.
Connie McCormick made a motion to approve the request subject to the consideration to alleviate
the parking demand and record the parking agreement with McAllister’s with the register of deeds.
Approved.

Consider a request for a variance to the grades for parking lots to allow portions of parking
areas to exceed 5% for the property located at 777 South Jefferson Avenue (Tax Map 066C,
Group B, Parcel 007.00). Request submitted by Jon Featherston of the Dimension Group on
behalf of 7-11 Speedway, LLC. Mr. Christopher Phillips stated that Mr. Jon Featherston of the
Dimension Group on behalf of 7-11 Speedway LLC., has resubmitted a variance request to the grades
for parking lots to allow portions to parking lot areas to exceed five percent (5%) for property located
at 777 South Jefferson Avenue. A previous variance was approved at the August 12, 2021, meeting for
one year and was reapproved at the August 11, 2022, meeting for one year.
An initial variance to the grades for parking lots to allow portions of parking areas to exceed 5% for
the property located at 777 South Jefferson Avenue was applied for and granted at the August 12, 2021,
Board of Zoning Appeals meeting. Section 233.9D, 3. Variances, (i) details the time limit prescribed
for a variance, “The Board of Zoning Appeals shall prescribe a time limit within which the action for
which the variance is required shall be begun or completed, or both; however, in no case shall more
than one (1) year pass before the action is begun. Failure to begin or complete, or both, such action
within the prescribed time limit shall void the variance. The variance was reapproved for one (1) year
at the August 11, 2022, meeting.
The site is the location for a proposed new Speedway convenience store. This project is a
redevelopment where four (4) existing structures will be demolished. Three (3) of these structures are
located on Tax Map 066C, Group B, Parcel 007.000 and another located on Tax Map 066C, Group B,
Parcel 005.00. The entire site will also incorporate a small portion of the property at 767 South
Jefferson Avenue further identified as Tax Map 066C, Group B, parcel 004.00. The developer’s
representative has indicated this will consist of approximately 1.7 total acres of property for the
proposed Speedway store. The property is zoned CG General Commercial and is bordered by CG
General Commercial to the north, south, east, and west and PCD, Planned Commercial Development
zoning on the east side of South Jefferson Avenue.
A proposed site plan depicts access to South Jefferson Avenue at the signalized intersection that is the
entrance to the existing Wal-Mart development. The site plan depicts two (2) points of ingress/egress
on a private access driveway to the former Putnam County Fairgrounds property, and other points of

access to the north that provide additional access to the Appliance Mart retail shopping center. Putnam
County has approved easements to access the driveway to the Putnam County Fairgrounds property.
Section 205.7 of the Zoning Code, Design Requirements for Parking Spaces and Lots, Section 205.7D,
Grades, provides maximum grades for entrances connecting to a public street and parking lot:
205.7D GRADES
1. Grades within the paved area of a parking lot shall at no place be less than one (1) percent or
more than five (5) percent.
2. Grades of driveways or entrances from a public street serving a parking lot shall at no point
exceed eight (8) percent. Single- and two-family dwellings are not subject to the requirements of
this section.
The provided site plan depicts a grade of 3.32 to 3.49 percent at the access to South Jefferson Avenue,
which is compliant. Grades of 9.94 percent and 10.01 percent are proposed at the southern access to
the Putnam County Fairgrounds driveway. The northern access points were previously proposed at
10.05 percent and 11.08 percent. The revised plans show these access points at 11.52 percent and 11.08
percent. The revised plans show a slotted drainpipe as requested by Public Works added to the access
point. The site does not currently contain any stormwater management means and the submitted plans
detail stormwater management improvements added to the site. Neither of the proposed northern
connections are to public streets as stipulated in Section 205.7D.2.
The final grading plan for the development depicts three (3) instances in the parking areas access
driveways where the grade is proposed at 5.11 percent, 6.34 percent, and 6.49 percent. These areas are
located just northeast of the proposed new principal store structure. All other proposed grades appear
to meet the maximum allowable grade of five percent (5%). The Planning Department interprets
Section 205.7D.1. to apply to parking lots and the access aisles that serve actual parking spaces.
Driveways providing ingress/egress to a development are covered in Section 205.7D.2.
The existing topography of the site has approximately 15 feet of grade change from south to north.
Existing grades on the current site exceed 10 percent in several locations. Cookeville Public Works
indicated a grade of more than 17 percent in one (1) location at the northern boundary of the proposed
development site. The developer contends that the variance is necessary due to existing site and
topographic conditions, unique to the property. The Planning Department feels the topographic
conditions present a hardship for any redevelopment of the site. In the opinion of the Planning
Department, the requested variance will not be detrimental to the public welfare or injurious to other
property in the area.
Staff Recommendation: Reapproval of the request to increase the maximum grade of parking areas
to allow for maximum grades as depicted on the submitted grading plan.
Elwood Ervin made the motion to approve the variance request as recommended by staff. Nancy
Bohannon seconded the motion, and the motion was carried unanimously. Approved.
Consider a request for a variance to the maximum width of driveways to allow a driveway width

at the August 11, 2022, meeting. No changes have been made to the request. A proposed site plan for
redevelopment of the property depicts access to South Jefferson Avenue at the signalized intersection
that is the entrance to the existing Wal-Mart development.
Section 205.9 of the Zoning Code, Access Control and Requirements for Curb Cuts (Driveways) and
Culverts, Section 205.9B, Maximum Width of Access Points and Driveways provides that “For any
non-residential use, a point of access for vehicles onto a street, excluding the necessary turning radius,
shall not exceed 40 feet in width.” Speedway requests that a driveway access point of 50 feet in width
be allowed to align with the existing driveway on the west side of South Jefferson Avenue that provides
access for the Walmart shopping development. This is a signalized intersection that provides four (4)
lanes of ingress/egress for the Walmart shopping center with a divided landscaped median where
signage is located. They further contend that the width is necessary for fuel and other delivery truck
access. A provided access location/width exhibit provided by Speedway depicts the turning movements
of fuel delivery and other delivery trucks, depicting that the width is necessary to navigate the fuel
pump canopy and navigate the interior of the site.
The Planning Department finds justification in the request due to the existing width of the access point
on the west side of South Jefferson Avenue. Also, this intersection is controlled with a traffic signal,
which alleviates other concerns with uncontrolled access management. In the opinion of the Planning
Department, the requested variance will not be detrimental to the public welfare or injurious to other
property in the area.
Staff Recommendation: Reapproval of request to increase the driveway access requirement from 40
feet to 50 feet for a total variance of 10 feet.
Mr. JD Parks stated that he believes it makes sense to make the entry point 50 feet in order to line it
up with the Walmart entrance but has a concern that the new entrance will make it difficult to enter in
on the fairground access on South Jefferson.
Mr. Christopher Phillips stated that the entrance to the fairgrounds on South Jefferson Avenue is a
private access driveway and the access drive will be assessed with new development.
Michael Detwiler made the motion to approve the variance request as recommended by staff. Elwood
Ervin seconded the motion, and the motion was carried unanimously. Approved.

Pools, 206.25B, for the property located at 328 South Dry Vally Road (Tax Map 052, Parcel 027.00).
Request submitted by Lee Williams. Mr. Jon Ward stated that Mr. Lee Williams has submitted a request
for a variance to reduce the fence height requirements from 60 inches to 56.5 inches for a total variance of
3.5 inches and an administrative review of the Chief Building Official’s determination that an existing
perimeter fence does not meet the requirements for a swimming pool fence as established in the Zoning
Code Section 206, Additional Standards, Section 206.25 Swimming Pools, 206.25B, for his property
located at 328 South Dry Valley Road. The request was submitted to allow the existing perimeter fence to
function as the required fence around a swimming pool area.
Analysis: The subject property is identified as Parcel 027.00 on Tax Map 052 and contains approximately
19.57 acres. The property is zoned RS-20, “Single-Family Residential” as are the adjacent properties to the
north, west, and south. The property is bordered by the corporate city limits to the east.
During inspection of the new house construction on the subject property, the Codes Division notified Mr.
Williams that a fence would be required around the newly constructed pool. Mr. Williams has submitted a
request to allow the existing perimeter fence located on the subject property to meet the requirements of a
swimming pool fence established in the Zoning Code.
Section 206, Additional Standards, Section 206.25 Swimming Pools, 206.25B states:
The swimming pool area shall be walled or fenced so as to prevent uncontrolled access by children
and pets from the street or from adjacent properties. Said fence or wall shall be not less than five
(5) feet in height and maintained in good condition. All gates shall be self-closing.
The petitioner has provided an exhibit depicting fencing along the perimeter of the property. The existing
fence is 56.5 inches tall and consists of five (5) strands of high tensile wire. The Codes Division verified
the fence height but was unable to verify existing fencing along the northeastern, eastern and southeastern
areas of the property. The Codes Division determined that the existing fencing does not meet the
requirements established in Section 206.25B. The International Building Code requires a swimming pool
to have a fence four (4) feet in height, but further requires that openings in a barrier around a swimming
pool shall not allow passage of a four (4) inch sphere. No gates are present as required by code. The
petitioner has stated that a gate could be installed on the driveway to satisfy this requirement.
The property consists of approximately 20 acres. The nearest residence is approximately 450 feet from the
swimming pool. The request to reduce the fence height requirement from 60 inches to 56.5 inches represents
a 5.8 percent variance from the required height. In the opinion of the Planning Division, the variance to the
height requirements would not be detrimental to the public welfare or injurious to other property in the area
as the 56.5-inch height is greater than the Building Code requires, however, the property does not appear
to be entirely fenced, and the existing fencing does not appear to meet the requirements of the Zoning or
Building Codes.
Recommendation: Denial of the request
Mr. Lee Williams, petitioner, showed where portion of fence was ripped out during construction. He stated
that the rest of property is fenced. He has a security system and alarm pool for any disturbances in the water.
Mr. Elwood Ervin asked what the reason is for not installing a perimeter fence.
Mr. Williams stated that the entire property is fenced so he doesn’t see the need for a fence around the pool
also doesn’t want one for aesthetics and the view.
Mr. Ervin asked Mr. Ward what would bring the perimeter fence up to code.
Mr. Ward stated that the zoning code doesn’t stipulate and that it is part of the building code.

A special exception is being requested to permit additional spaces to be located on adjacent property (McAllister's
property) per the attached aerial exhibit, due to proposed drive-thru improvements for Chick-fil-A. These improvements
are being proposed to allow for better traffic flow within the facility.
A shared parking agreement between Chick-fil-A and McAllister's allowing the use of 15 parking spaces in included
