The Board of Zoning Appeals met on Thursday, May 9th, 2024, at 5:15 p.m. in the Council
Chambers located at 45 E. Broad Street, Cookeville, Tennessee.

Consider for Approval the Agenda as Submitted. Michael Detwiler made the motion to approve
the agenda as submitted. Nancy Bohannon seconded the motion, and the motion was carried

Consider for Approval the Minutes of March 14th, 2024. Nancy Bohannon made the motion to

Consider a request for a variance to the height of an accessory structure exceeding that of
the primary structure located at 202 Freedom Avenue (Tax Map 054-D, Group B, Parcel
025.00). Request submitted by Richard Bugan. Mr. Christopher Phillips stated that property
owner Mr. Richard Bugan has submitted a request for a variance to allow the height of a proposed
accessory structure to exceed the height of the principal structure located at 202 Freedom Avenue.
Analysis: The subject property is identified as Parcel 025.00 on Tax Map 054-D, Group B and
contains approximately 0.74 acres. The property is zoned RS-10, “Single-Family Residential” as
are the adjacent properties to the east, south, and west. The property is bordered by CL, “Local
Commercial” to the north.
The petitioner has submitted a drawing of a proposed accessory building to be constructed within
the rear yard of the subject property. The petitioner states that the base of the proposed building
site lies above the height of the roof ridge of the principal structure. Section 204.8H, Additional
Standards for Accessory Structures notes,
“On any lot or tract of less than five (5) acres in size located in the RS-20, RS-15, RS-10,
RS-5, or RD Districts no accessory structure shall be of a height exceeding that of the principal
structure and/or of a size exceeding 50 percent of the total square footage of the principal
structure.”
Current GIS shows a slope of approximately 20% within the rear yard of the property. The
topographic contour directly behind the principal structure shows 1070 feet in elevation, and the
area depicted on the submitted drawing for the proposed accessory building shows 1086 feet in
elevation. The principal structure is a one-story single-family home. The proposed accessory
structure’s foundation would be approximately 18-20 feet higher than the elevation of the principal
structure’s foundation. The proposed accessory building will meet the required 20-foot rear
setback of the RS-10 District.
Section 233.9D, 3. Variances, d. General Standards for Variances states, “The particular physical
surroundings, shape, or topographic conditions of the specific property involved would result in a
particular hardship upon the owner as distinguished from a mere inconvenience, if the strict

application of this Zoning Code were carried out.” The topographic conditions of the subject
property provide a hardship for construction of the proposed accessory structure within the rear
yard of the property.
In the opinion of the Planning Division, the requested variance would not be detrimental to the
public welfare or injurious to other property in the area.
Recommendation: Approval of the variance request to the height of the proposed accessory
structure exceeding that of the principal structure.
Michael Detwiler made the motion to approve the variance request as recommended by staff.
Nancy Bohannon seconded the motion, and the motion was carried unanimously. Approved.
Consider a request for a variance to allow property located at 2131 Mine Lick Creek Road
(Tax Map 065-G, Group A, Parcel 002.00) to be subdivided into two (2) lots with one (1) lot
including an existing accessory structure with no principal structure. The accessory
structure is proposed to be converted into a single-family residence in the RS-20 District.
Request submitted by Ted Thomas. Mr. Christopher Phillips stated that property owner Mr. Ted
Thomas has submitted a request for a variance to allow his property to be subdivided into two (2)
lots with one (1) lot including an existing accessory structure with no principal structure. The
accessory structure is proposed to be converted into a single-family residence in the RS-20 District.
Analysis: The subject property is identified as Parcel 002.00 on Tax Map 065-G, Group A and
contains approximately 1.05 acres. The property is zoned RS-20, “Single-Family Residential” as
are all adjacent properties.
The petitioner has submitted a survey proposing to subdivide the current property into two (2)
lots. The newly created Lot #1 will contain the existing principal structure and measure 0.46 acres,
or 20,004 square feet. The newly created Lot #2 will contain the existing accessory structure and
measure 059 acres, or 25,580 square feet. The RS-20 District requires 20,000 square feet per lot.
The petitioner notes that the purpose of the subdivision is to sell the proposed Lot #2 and existing
accessory structure. The existing structure is proposed to be converted into a new single-family
residence. Both lots will be served by septic sewer service. The septic tank serving the existing
principal structure will remain on Lot #1. Lot #2 has been given TDEC approval for a new septic
system to serve an estimated house size of three (3) bedrooms, as noted on the proposed
subdivision plat.
The petitioner has stated that the property has been listed with a real estate company and that there
has been serious interest in the subject property if the variance is approved. He has stated that the
potential buyer will convert the accessory structure into a two (2) bedroom single-family home.
The current property was purchased as three (3) individual lots and the lots were combined in May
2017. The lots were combined for tax purposes. The existing principal home and accessory
structure were present at this time. The accessory structure was located on two (2) parcels and the
principal home was located on the third parcel. The combination of the three (3) parcels brought
the lot and existing structures into zoning compliance within the RS-20 District. The two (2)
proposed lots meet lot size requirements for the RS-20 District and setback encroachments for the
structure on the proposed Lot #2 are existing and not created by the proposed subdivision.
In the opinion of the Planning Division, the requested variance would not be detrimental to the
public welfare or injurious to other property in the area.

Recommendation: Approval of the variance request with the condition that a building permit is
pulled for the single-family dwelling unit within one (1) year of approval.
Mr. Ted Thomas stated that he initially bought this property as 3 lots, and he combined them for
tax purposes.
Mr. Elwood Ervin asked if Mr. Thomas is going to have the property replatted to show two lots.
Mr. Jon Ward stated that the property currently exists as one lot, and the property will be
subdivided into two lots with approval from this board.
Mr. Ervin asked what the plan of service is for this area.
Mr. Ward stated that this area has the same stipulations as the other unserved portion of the city
limits.
Michael Detwiler made the motion to approve the variance request as recommended by staff.

Consider a request for a special exception to allow a Hospice Residence Home/Assisted Living
Facility on the property located at 570 State Street (Tax Map 053, Parcel 018.11). Request
submitted by Curtis and Kelli Sipe. Mr. Christopher Phillips stated that property owners Mr. Curtis
and Mrs. Kelli Sipe have submitted a request for a special exception to reinstate a hospice
residence/assisted living facility for property located at 570 State Street.
Analysis: The subject property is identified as Parcel 002.04 on Tax Map 053 and contains
approximately 1.00 acres. The parcel was created as part of the Upper Cumberland Christian Home
Division, which was approved and recorded in 2007. The property is zoned RS-10, “Single-Family
Residential” and is contiguous with properties zoned RS-10, “Single-Family Residential” to the
north, east, and south, and as RM-8 “Multi-Family Residential” to the west. The Upper
Cumberland Christian Home, a 33-unit senior housing complex, is adjacent to the subject property
to the west.
The Planning Division has an extensive history with the property. The property was historically
operated as a group home. The Zoning Code was amended to allow the property to be used as a
hospice home and assisted living facility. The property was approved and used accordingly.
Hospice Residence Home/Assisted Living Facility is a use permitted on appeal (special exception)
in the RS-10 District, subject to the following conditions:
212.4D Hospice Residence Home/Assisted Living Facility meeting the following conditions:
1. Minimum lot area of 40,000 square feet shall be provided for such facility
2. Maximum of twelve (12) residents shall reside at the facility
3. Minimum of one (1) off-street parking space per maximum number of residents and
employees shall be provided at the facility
4. No freestanding signs shall be permitted
5. Shall be located on property contiguous with property zoned for multi-family residential
purposes and shall be accessed from the same street as the contiguous property zoned for
multi-family residential purposes

6. Structure shall be compatible with nearby residential structures in terms of scale and
appearance
7. Site plan and floor plan shall be submitted to and approved by the Board of Zoning
Appeals
8. Type 2 Screen/Buffer Yards as specified in section 208 of this Zoning Code shall be
provided along all property lines abutting property zoned or used for single or two-family
residential purposes
9. All requirements of the State of Tennessee that pertain to the use and operation of the
facility shall be met
10. Shall have been previously legally utilized as a group home
The special exception was last approved by the Board of Zoning Appeals on March 9, 2023. A
floor plan depicting the proposed utilization of the structure as a hospice residence home/assisted
living facility was submitted at that time. The floorplan depicted a total of 10 bedrooms to be used
for hospice/assisted living.
No changes are planned for the site, which was found to be compliant with the occupancy, signage,
parking, and screening requirements when approved in 2017 and confirmed again in 2022 and
2023. The site exceeds the minimum lot area requirement, and the exterior façade of the residential
structure will not be altered. Also, as noted, the site is contiguous with property zoned for multi-
family residential purposes and is accessed from the same street as the contiguous property zoned
for multi-family residential purposes. The application was submitted for reapproval of a previously
approved special exception for the property before the one (1) year expiration requirement as
stipulated in the Zoning Code.
In the opinion of the Planning Division, all established conditions can be met, and the property
appears to be particularly suitable for the proposed use.
Recommendation: Approval of the request, subject to compliance with all applicable provisions
of the Zoning Code.
Mr. Curtis Sipes, petitioner, stated that the project has been delayed due to waiting for the State to
approve their plans. He stated that he hopes this is the last time they have to go in front of the
Board of Zoning Appeals and plans to start construction in 3 to 4 months.
Elwood Ervin made the motion to approve the special exception request as recommended by staff.
Michael Detwiler seconded the motion, and the motion was carried unanimously. Approved.
Consider a request for a variance to reduce the rear yard setback from 20 feet to 18 feet for a
total reduction of two (2) feet and to reduce the side yard setback from 10 feet to eight (8) feet
for a total reduction of two (2) feet for roof overhangs of a proposed addition to the existing
single-family home located at 1918 Brown Avenue (Tax Map 040-F, Group E, Parcel 018.11).
Request submitted by Eleni Fragopolous. Mr. Christopher Phillips stated that property owner, Eleni
Fragopolous, has submitted a request for a variance to reduce the rear yard setback from 20 feet to
18 feet for a total variance of two (2) feet and to reduce the side yard setback from 10 feet to eight
(8) feet for a total variance of two (2) foot for roof overhangs of a proposed addition to the existing
single-family home located at 1918 Brown Avenue.
Analysis: The subject property is identified as Parcel 018.11 on Tax Map 040-F, Group E and
contains approximately 0.39 acres. The property is zoned RS-10, “Single-Family Residential” as

are the adjacent properties to the north, west, and south. The property is bordered by CI,
“Commercial-Industrial Mixed-Use” to the east.
The petitioner has submitted drawings showing a renovation and addition to the existing home.
The proposed renovations will not encroach into the 20-foot rear yard setback. The proposed
addition will be constructed at the south end of the existing home. The addition will encroach into
the rear yard approximately one (1) foot 11 inches and will encroach into the side yard setback
approximately one (1) foot 2 inches due to the overhang of the roof. The Cookeville Zoning Code
defines Setback as, “The horizontal distance measured at right angles to the property line of the
lot from the closest leading edge of a structure on the lot.” This would include the roof overhang.
Based on the submitted drawing, the southwestern corner of the proposed addition will also slightly
encroach into the read yard setback, approximately eight (8) inches.
The variance request represents a total variance of less than 10% within the rear yard setback and
less than 12% within the side yard setback. In the opinion of the Planning Division, the requested
variance would not be detrimental to the public welfare or injurious to other property in the area.
Recommendation: Approval of the variance request to reduce the rear yard setback from 20 feet
to 18 feet for a total variance of two (2) feet and the side yard setback from 10 feet to eight (8) feet
for a total variance of two (2) feet as depicted on the submitted drawing.
