COOKEVILLE PLANNING COMMISSION MINUTES MAY 22, 2006 The Cookeville Planning Commission met on Monday, May 22, 2006 at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Judy Jennings, Dr. Roy Loutzenheiser, Nina Lunn, Don Prince, Sam Sallee, Dr. Angelo Volpe, and Tod Williams. MEMBERS ABSENT: Jim Stafne & Chris Wakefield. STAFF MEMBERS PRESENT: James Mills, and Jayne Barns. STAFF ABSENT: Jim Shipley. OTHERS PRESENT: Ryan Williams, David Bilbrey, and Eddie Campbell. CONSIDER FOR APPROVAL THE AGENDA AS SUBMITTED. Dr. Angelo Volpe made the motion to approve the agenda with the following additions and corrections: Add Action Item #6: Consider for Action request to accept financial guarantee for the Meadows Subdivision. Request submitted by Ryan Williams. Add Action Item #7: Consider for Action Revised Preliminary Plat of the Resubdivision of Hearthwood Properties. Request submitted by Eddie Campbell on behalf of Hearthwood Properties. Study Item #1 Withdrawn: Consider for Study Rezoning 10 Royal Oak Drive and 1665 West Broad Street from RS-20 (Single-Family Residential) to CL (Local Commercial). Request submitted by Kevin McBroom. This item has been withdrawn from the agenda by the property owner. Don Prince seconded the motion and the motion carried unanimously. APPROVED, WITH CORRECTIONS. CONSIDER FOR APPROVAL THE MINUTES OF APRIL 24, 2006. Don Prince made the motion to approve the minutes of April 24, 2006. Sam Sallee seconded the motion and the motion carried unanimously. APPROVED. CONSIDER FOR APPROVAL FINAL PLAT OF FORREST COVE, 19 LOTS LOCATED OFF FORREST ROAD. REQUEST SUBMITTED BY DAVID BILBREY. James Mills stated that Mr. David Bilbrey of Advanced Inc. has submitted for approval a Final Plat of Forrest Cove, a 19-lot subdivision located off Forrest Road. The property submitted for subdivision approval is zoned as RS-10, Single Family Residential. Water and sewer line, electrical service, and street improvements have been completed. Street improvements have been completed through the gravel base stage and Mr. Bilbrey has indicated that he will financially guarantee the sidewalk installation. Staff recommended conditional final approval subject to the completion of the following within 30 days: • Submittal of Final Street Surface fee in the amount of $8,450 • Submittal of Warranty of Improvements in the amount of $10,000 • Submittal of Financial Guarantee in the amount of $8,000 for the completion of sidewalks • Completion of adjustments to water and sewer lines and appurtenances • Submittal and approval of as-built plans for water and sewer lines, and • Completion of several minor corrections to Final Plat, including the correct location of utilities and easements, additional utility easements, removal of abandoned easement, correct spelling of Forrest Road, location and sizes of drainage facilities, and location of proposed sidewalks. Don Prince made the motion to grant conditional Final Plat approval subject to staff’s recommendations. Sam Sallee seconded the motion and the motion carried unanimously. CONDITIONAL FINAL PLAT APPROVAL. COOKEVILLE PLANNING COMMISSION 2 MAY 22, 2006 CONSIDER FOR ACTION REVISED PRELIMINARY PLAT OF EYE CENTERS OF COOKEVILLE, PHASE II, 11 LOTS LOCATED ON NEAL STREET. REQUEST SUBMITTED BY STONEHENGE DEVELOPMENT. James Mills stated that AEI, on behalf of Stonehenge Development, has submitted for approval a revised Preliminary Plat of Eye Centers of Cookeville, Phase II, a proposed 11 lot commercial subdivision located off Neal Street. This proposed subdivision was originally granted preliminary approval in August of 2005. The original preliminary plat depicted a proposed subdivision of a 23.21 acre tract into 5 lots. The developer has proposed significant changes, including the addition of 6 more lots and additional street and utility construction, which requires re-submittal of the plat. The property now proposed for subdivision consists of approximately 37.87 and includes both tracts of the Eye Centers of Cookeville, Phase I division. The property is zoned as CR, Regional Commercial. The subdivision will require new street construction, which must be done to Major Collector Street construction standards, the installation of sidewalks on one side, and utility installation. A grading permit has been issued and some work has been initiated. Staff recommended conditional approval of Revised Preliminary Plat subject to the following: • Submittal and approval of water and sewer plans • Submittal and approval of drainage and storm water plans • Submittal of street and sidewalk construction plans • Resubmittal of Preliminary Plat depicted minor revisions • Dedication of additional right-of-way on Old Walton Road, and • Completion of preconstruction meeting prior to initiating any construction of improvements. Dr. Angelo Volpe made the motion to grant conditional revised Preliminary Plat approval subject to staff’s recommendation. Dr. Roy Loutzenheiser seconded the motion and the motion carried unanimously. CONDITIONAL REVISED PRELIMINARY PLAT APPROVAL. The Board wanted it noted in the minutes that no one was present from AEI or Stonehenge Development. CONSIDER FOR ACTION REQUEST FOR FLAG LOT AND FINAL PLAT OF RESUBDIVISION LOT 3 APPLE VALLEY ESTATES. REQUEST SUBMITTED BY HOLLADAY CHURCH OF CHRIST. James Mills stated that the Holladay Road Church of Christ has submitted for approval a request for a variance for a flag lot subdivision and a Final Plat of the Resubdivision of Lot 3 Apple Valley Estates, a two lot subdivision located off Holladay Road. Article X, Section G of the Subdivision Regulations provides that flag lot divisions may only be approved upon the approval of a variance by the Planning Commission subject to certain specific conditions. A flag lot is a lot which is accessed by a strip of land with a width less that the required street frontage which is behind a lot which meets the required street frontage. All of the required conditions would be met. The property proposed for subdivision is zoned as RS-20, Single Family Residential. Each of the proposed lots has access to the required utilities and has frontage on an existing public street. Staff recommended approval of the variance request and conditional approval of Final Plat subject to the review and approval of the applicable departments and to the approval of the County Environmentalist for the use of a subsurface disposal system. Don Prince made the motion to approve the variance request and grant conditional approval of Final Plat subject to the review and approval of the applicable departments and to the approval of the County Environmentalist for the use of a subsurface disposal system. Judy COOKEVILLE PLANNING COMMISSION 3 MAY 22, 2006 Jennings seconded the motion and the motion carried unanimously. APPROVED VARIANCE FOR FLAG LOT AND GRANTED CONDITIONAL FINAL PLAT APPROVAL. CONSIDER FOR ACTION REQUEST TO ACCEPT FINANCIAL GUARANTEE FOR THE MEADOWS SUBDIVISION. REQUEST SUBMITTED BY RYAN WILLIAMS. (THIS ITEM WAS ADDED TO THE AGENDA AT THE MEETING.) James Mills stated that Mr. Ryan Williams requests the acceptance of a Financial Guarantee to cover the completion of the binder surface in The Meadows, a 43-lot subdivision located off Bunker Hill and White Roads. A Final Plat of the Meadows was conditionally approved by the Planning Commission at its April 2006 meeting. All conditions for approval have been met with the exception of the installation of the binder surface, which Mr. Williams has been unable to complete due to poor weather conditions. The Subdivision Regulations provide that the binder surface installation may be financially guaranteed. The Public Works Department has estimated an amount of $15,400 as the cost for installation. Staff recommended approval of acceptance of Financial Guarantee to cover the completion of the binder surface in the amount of $15,400 for a period of up to one (1) year. REQUEST SUBMITTED BY EDDIE CAMPBELL ON BEHALF OF HEARTHWOOD PROPERTIES. (THIS ITEM WAS ADDED TO THE AGENDA AT THE MEETING.) James Mills stated that Eddie Campbell on behalf of Hearthwood Properties has submitted for approval a revised Preliminary Plat Resubdivision of Hearthwood Properties. He noted that the purpose of the revised plat was to reduce the number of lots from 3 to 2 and shorten the length of the proposed street improvements. Staff recommended conditional approval of Revised Preliminary Plat subject to the following: • Review and approval of the applicable city departments • Submittal and approval of plans for the provision of water and sewer service, if necessary • Submittal and approval of erosion and sediment control plans • Submittal and approval of drainage plans for the cul-de-sac and sidewalk construction plans • Submittal of results of core drilling or similar documentation that the existing drive meets the construction standards for city streets (a property owners agreement for the perpetual maintenance of the permanent vehicular easement will be required if the developer does not intend for it to be accepted by the City of Cookeville as a city street. • Provision of cul-de-sac (paved turn-around) at the end of the street, and • Completion of pre-construction meeting prior to initiating any construction. Dr. Angelo Volpe made the motion to grant conditional Revised Preliminary Plat approval of Resubdivision of Hearthwood Properties, subject to staff’s recommendation.
